Introduction:-

In Hindu law, there’s a special way for married couples to take a break from living together
without getting a divorce. This is called “judicial separation,” and it’s talked about in Section 10 of
the Hindu Marriage Act, 1955. This section tells us the reasons why a husband or wife can ask a
court for permission to live apart for a while, even though they’re still married. These reasons
include things like being treated badly, someone being sick, or other serious problems in the
marriage. It’s like a way to hit the pause button on the marriage so the couple can figure things
out. But remember, talking to a legal expert is really important if someone wants to go this route.

What is judicial separation under Hindu law:-

In Hindu law, judicial separation is a legal arrangement established under


(Section 10 of the Hindu Marriage Act, 1955)

According to this act, judicial separation refers to a situation where a husband or wife seeks a
