PROMISSORY NOTE WITH WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

receipt of which is hereby acknowledged as indebtedness in the Office of the Chief, Provident Fund, Philippine Army (OCPF,
PA.)
I hereby undertake to pay the said institution or order herein-mentioned loan with interest at ___% per annum and in
________ monthly equal installments effective ______________20___. If the equal installment shall have not been collected
or paid on due date, said unpaid installments shall earn compounded surcharge of 1% interest monthly until fully paid. To
further secure the payment of said loan, I hereby appoint with the understanding not to revoke this appointment, without written
authority of said institution, the Director of Finance Center, PA/ Chief AFPFC as my Attorney-in-fact in payment of said loan
and is authorized to deduct and collect through his authorized agent the sum of

To pay directly to OCPF, PA in case Director, FCPA/ Chief AFPFC failed to effect billing of my account or payment may have
been deferred and/or cut-off for whatever circumstances.
Misrepresentation, falsification or any similar acts committed by me: OCPF, PA shall automatically suspend my loan
privileges indefinitely. I further agree that in the event of my separation from the service (AFP) or employment before full
payment of herein loan, I bind myself to pay in full any outstanding amount of this loan or authorize OCPF, PA to deduct the
equivalent amount to proceeds of my commutation benefits, lump sum pay or monthly pension and other benefits from AFP
until all outstanding balances have been fully paid.
I hereby agree to give and grant OCPF, PA full power and authority to receive/ collect and deduct from my investments
and deposits present and/ or future with other financial institutions and to encumber or sell any other properties, assets or
income which may come into its knowledge and possessions to recover and satisfy payment of unpaid loan including its
interests and other charges.

In case of court litigation, I also promise and agree to pay Attorney’s fee in the amount equivalent to 20% of the total
account due and liquidated damages in the sub-equivalent to 10% of the total sum and 30% of the total sum payable as actual
and consequential damages as maybe adjudged by the court including interest and submits myself to the jurisdiction of the
Court.
The borrower further agree that any overpayment due to overcollection from his/her pay and allowances, benefits and
other claims shall be assessed and refunded to the borrower upon written demand of the borrower filed with the OCPF.
However, in the event that the borrower does not file a written demand within ten (10) years from the succeeding month after
the month of the last installment for the loan, said overpayments shall be considered waived in favor of PAPF.
