Subject: - Submission of JointOption form in view of the Honourable Supreme Court

iudoement dated 04.11.2022 in the matter of Special Leave Petition (C) No.s 8658-8659 of
2019 bv employees / ex- employees
This is in continuation to the circular issued under Memo No. Pers/2O1231205-215 dated
13.01.2023 explaining the provisions in brief about the judgement of Hon'ble Supreme Court
dated 04.1 1.2022, arising out in the matter of Employees Provident Fund Organisation & An.
Etc vs Sunil Kumar B. & Ors. Etc.
Subsequent to the said circular, all employees/ ex- employees were informed vide circular
issued under Memo no. Pers/201231231-241 dated 07.02.20231o view their EPS data and
requested to verify and confirm the data while submitting their undertaking through the portal
(URL epf,neepco-spark.co.in) on or before 18.02.2023.
As per the provisions explained in the above stated circulars, the Joint Option has to be
exercised by members & pensioners and submitted to EPFO latest by 3 March 2023, as per
Judgement of Hon'ble Supreme Court. However, EPFO is yet to issue any format for Joint
Option or any clarification/guidelines in this regard. Hence, it may be noted that arrears to
be paid and pension payable cannot be ascertained as of now.
Now, as a precautionary compliance & to meet the deadline as stated in the judgement, it has
been decided that we may submit Joint Option form to respective RPFCs for those employees
and ex-employees who are willing to opt for enhanced pension.
Accordingly, Joint Option format(s) for serving employee(s) and for superannuated employee
(s) (attained 58 years of age as on 01 .09.2014 or after) are attached herewith as annexures
Annexure-l (Superannuated Employees) to Annexure-ll (Serving Employees). The same
may be downloaded from the NEEPCO portal (www.neepco.co.in) under (URL epf.neepco-
spark.co.in) and filled up format in original may be submitted, in triplicate.
ln case of superannuated employees, the forms may be submitted to the Head of HR of

Establishments/ Projects/ Plants easily accessible to the superannuated employees on
or before 24.02.2023. Superannuated employees who are unable to visit NEEPCO office may
send a legible scanned copy at [email protected] and send the original by post to the ln-
charge TBS Cell, NEEPCO Corporate Office, Shillong so as to reach on or before
24.02.2023. While sending the e-mail, superannuated employees should clearly mention -
Joint Option Form, employee number and Annexure- I in the subject matter.
Serving employees is to submit their form to HR dept at their present location on or
before 24.02.2023 positively. However, the employees posted at Corporate Office, Shillong
may submit their form to Corporate HR Establishment dept., Shillong.
The duly filled in and signed Joint Format Option received from the employees / ex-
employees in original is to be submitted to the Secretary, EPF Trust, Shillong latest by
27.02.2023 by the concerned HR Dept of the respective locations.
All the employees/ex-employees desirous of opting for higher pension may comply with the
above. However, all are hereby informed as already stated, this is an advance action being
