RESOLUTION EMBODYING PROVINCIAL ORDINANCE NO. 2021-252, AN


ORDINANCE AMENDING SECTION 4 OF PROVINCIAL ORDINANCE NO. 2020-244,
‘AN ORDINANCE PROVIDING PROTECTION AGAINST ONLINE FRAUD, ONLINE
SCAM AND PROVIDING PENALTIES THEREOF’

WHEREAS, the State recognizes the vital role of information and communications
technology in nation-building;

WHEREAS, Republic Act No. 7394, otherwise known as the Consumer Act of the
Philippines, declares that it is the policy of the State to protect the interest of the consumer,
promote his general welfare and to establish standards of conduct for business and industry to
implement measures to achieve, among others, the protection against deceptive, unfair and
unconscionable sales acts and practices;

WHEREAS, Republic Act No. 8792, otherwise known as the Electronic Commerce Act,
among others, recognizes the vital role of information and communications technology in nation-
building aimed at facilitating domestic and international dealings, transactions, arrangements,
agreements, contracts and exchanges and storage of information through the utilization of
electronic, optical and similar medium, mode, instrumentality and technology to recognize the
authenticity and reliability of electronic data messages or electronic documents related to such
activities and to promote the universal use of electronic transactions in the government and by
the general public;

NOW THEREFORE, on motion of the Honorable Domingo B. Oso, Jr., Floor Leader,
and upon the sponsorship of the Honorable Jason R. Gonzales, which was duly seconded;

BE IT RESOLVED, as it is hereby Resolved, by the Sangguniang Panlalawigan ng


Iloilo to enact the following Provincial Ordinance:

PROVINCIAL ORDINANCE NO. 2021-252

AN ORDINANCE AMENDING SECTION 4 OF PROVINCIAL ORDINANCE NO. 2020-


244, “AN ORDINANCE PROVIDING PROTECTION AGAINST ONLINE FRAUD,
ONLINE SCAM AND PROVIDING PENALTIES THEREOF”

SECTION 1. Section 4 of Provincial Ordinance No. 2020-244 is hereby amended by


substitution to read, as follows:

“SECTION 4. Obligation of the Third-Party-Service courier. The Third-Party-


Service courier is under obligation to open the parcel at the instant request of the
buyer/receiver, subject to the following limitations:

4.1 The actual opening of the parcel must be done by the buyer/receiver in
front and/or in the physical presence of the Third-Party-Service courier;

4.2 As a condition precedent for the opening of parcel, as well as to


provide security and protection to the Third-Party-Service courier, duly
signed Proof of Delivery and Return containing statement of complaint
and/or reason(s) for non-acceptance/return. At any given time, Proof of
Delivery and Return must be readily available at all times.

Failure of the Third-Party-Service courier to comply the same shall be punishable


under Section 5 of this Ordinance.”

SECTION 2. Separability Clause. If for any reason or reasons any part or provision of
this Ordinance shall be held unconstitutional or invalid, other parts or provisions hereof not be
affected thereby shall continue to be in full force and effect.

SECTION 3. Repealing Clause. All previous ordinances inconsistent with this Ordinance
shall be deemed repealed or modified accordingly.

SECTION 4. Effectivity. This Ordinance shall take effect immediately upon approval and
compliance of posting and/or publication requirement(s) as required under the Local
Government Code.

RESOLVED FURTHER, to furnish copies of this Resolution, the Honorable Governor


Arthur R. Defensor, Jr.; all City/Municipal Mayors of component Local Government Units
(LGUs); Mr. Jacques Oscar Coscolluela, Corporate Solutions Manager, LBC Express Inc.
Western Visayas; Mr. Erwin Villanueva, Branch Manager, WWW Express Philippines; Ms.
Shella Medecinio, JRS Express; Mr. Jemmuel Paguntalan, QuadX Inc.; Mr. Anthony Dulay,
LBC Express Inc.- Western Visayas; the Chief of the Regional Anti-Cybercrime Unit, Region
VI, Police Regional Office VI, Camp Delgado, Iloilo City; the Offices of the Provincial Legal
Officer, the Honorable June S. Mondejar, Chairperson, Committee on Ordinances, Legal Matters
and Inter-Government Relations, the Honorable Rolando B. Distura, and the Honorable Jason R.
Gonzales, Chairperson, Committee on Economic Affairs and Investment, all of the Province of
Iloilo, for their information and reference.
