The Competent Authority has accepted your offered rates in
connection with the subject work. The total cost of the work at
the accepted rates works out to Rs. 1472793.1 (Rupees Fourteen
Lakh Seventy-Two Thousand Seven Hundred And Ninety-
Three Rupees And Ten Paise Only)

A sum of Rs.29500 deposited as Earnest Money vide

IREPS reference ID PE64417619608 has been retained towards
initial Security Money for due and faithful fulfillment of the
contract, and the balance Security Money will be recovered
from the progressive bills @ 6 % of the bill amount till it
reaches 5 % of the contract value in terms of clause 16.1 of
GCC - 2022. The balance amount of the security money of
Rs.44139.65/- may either be deposited in cash or will be
recovered at a percentage deduction of 6% from the periodical
payment on account of work done, to make the full Security.
Security deposit will be recovered only from the running bills
of the contract and no other mode of collecting SD such as SD
in the forminstruments like BG, FD etc. shall be accepted
towards security deposit. Security deposit shall be returned after
the physical completion of the work, clearance of allcontractual
finalbills and further maintenance period of 12(Twelve)months
after the date of completion of the work and as certified by the
Competent Authority. TheCompetent Authority shall normally
be the authority who is competent to sign the contract. If this
Competent Authority is of the rank lower than JA Grade, then a
JA Grade Officer (concerned with the work) should issue the
certificate.

You are requested to submit Performance Guarantee in the

form as given in Clause 16.4 of GCC - 2022 equivalent to 3 %
of the contract value amounting to Rs. 44183.79 (Rupees
Fourty-Four Thousand One Hundred And Eighty-Three Rupees
And Seventy-Nine Paise Only) within 21 days from the date of
issue of Letter of Acceptance, valid up to stipulated date of
completion plus 60 days so that contract agreement can be
executed. A penal interest of 12% per annum shall be charged
for the delay beyond 21days, if the contractor fails to submit the
requisite PG even after 60 days from the date of issue of LOA,
the contract is liable to be terminated. The value of PG to be
submitted by the contractor will not change for variation up to
25 %(either increase or decrease). In case during the course of
execution, value of the contract increases by more than25% of
the original contract value, an additional Performance
Guarantee amounting to 3% (Three percent) for the excess
value over the original contract value shall be deposited by the
contractor. The performance Guarantee (PG)shall be released
after physical completion of the work based on 'Completion
Certificate' issued by the competent authority stating that the
satisfactorily. The Security Deposit shall, however, be released
only after passing the final bill based on 'No Claim Certificate'
from the contractor. Whenever the contract is rescinded, the
Security Deposit shall be forfeited and the Performance
Guarantee shall be encashed. The balance work shall be got
done independently without risk & cost of the failed contractor.
The failed contractor shall be debarred from participating in the
tender for executing the balance work. If the failed contractor is
a JV or a Partnership firm, then every member/partner of such a
firm shall bedebarred from participating in the tender for the
balancework in his/ her individual capacity or as a partner ofany
other JV/Partnership firm. The engineer shall notmake a claim
under the Performance Guarantee except for amounts to which
the President of India is entitled under the contract
(notwithstanding and/ or without prejudice to any other
provisions in the contract agreement) in the event of:(i) Failure
by the contractorto extend the validity of the Performance
Guarantee as described herein above, in which event the
Engineer may claim the full amount of the Performance
Guarantee. (ii) Failure by the contractor to pay President of
India any amount due, either as agreed bythe contractor or
determined under any of the Clauses/Conditions of the
Agreement, within 30 days of the service of notice to this effect
by Engineer. (iii)TheContract being determined or rescinded
under provisions of the GCC, the Performance Guarantee shall
be forfeited in full and shall be absolutely at the disposal of the
President of India.

The entire work shall be completed within 6 month from the

date of issue of Letter of Acceptance. Carry
maintenance/warranty period of 12 months after the date of
completion of the work.
Labour License: As per General Conditions of the Contract, you
are to get yourself registered, if not already registered, with the
Asst. Labour Commissioner(Central) concerned as required
under the Contract Labour Regulations Act- 1970 & 71 and
obtain a License from the Asst. Labour Commissioner
(Central)and produce the same to this office before
commencement of the work failing which the contract awarded
will be terminated on the ground that you have not complied
with the legal provision of the said Act and the Earnest Money
will be forfeited.

Shramik kalyan portal: Contractors must get themselves

registered in Shramik Kalyan Portal. After receiving of LOA,
they have to enter the details of LOA within15 days. They have
to enter the details of workmen engaged against the concerned
LOA. They have to enter the payment details i.e. minimum
wages, PF, ESI etc. in the Shramik Kalyan Portal. The agency
should give certification that they have entered the payment
details in Shramik Kalyan Portal along with the Bill. Above
provisions shall be applicable for contractual labours who are
working in Railway premises under Railway supervision.

ON ACCOUNT PAYMENT: a) On account Payment to the

extent of 85% of Supply items on the total unit prices of such
items included in the schedule only after supply, inspection,
testing & acceptance of material. All invoices shall be
accompanied by the following. i) Supplier s challan for supply
items only. ii) Manufacture s certificate for large value items
wherever necessary as decided by Railway Engineer duly
countersigned, along with Inspection certificate granted by the
Sr. DEE/G/KGP or his authorized representative iii) Certificate
of current statutory taxes and duties. iv) Detailed entries made
in the measurement book. For supply of materials against
schedule of price, the payment will be made only to the extent
of materials required by purchaser. On account payment will
commence only when schedule assessment is approved by the
purchaser. (b) After successful erection & testing of material to
the satisfaction of railway in terms of contract, payment to the
extent of remaining 15% of supply & 100% of erection price
(after adjustment of 85% vide (a) above, if any) will be payable
by Railway. NOTE: Contractor s supply items/Railway s supply
items will beissued to contractor of purchaser depot for erection
purpose on submission of indemnity Bond on stamp duty. The
indemnity bond shall be in the prescribed form. The contractor
will safeguard against the theft etc. on material till the complete
assets are taken over by Railway.

Final Payment: Balance payment (after adjustment of on

account payment, if any) will be payable by the purchaser
through the Final bill after satisfactory completion of the entire
contractual work, satisfactory operation and handing over of the
assets to the Railway duly tested and commissioned subject to
compliance of the following. No claim certificate in favour of
Railways issued by the contractor. ii. Detailed entries in the
measurement book. iii. Supply of one set RTF and three sets of
blueprint of as erected drawings, pertaining to the work (if
 required). iv. On supply of catalogue and Operation
Manual/Instruction Books wherever applicable.

GST: Rates accepted are inclusive of GST @ 18%.

Consignee: SSEE/North/KGPwill draw the measurement of the

portion of work as completed by you and forward the bills for
payments. Please meet the above consignee or the Field Officer
i.e. Asstt. Divisional Electrical.Engineer(G)/S.E. Rly/KGP
concerned for necessary instructionsr
