CONTRACT OF EMPLOYMENT

Entered into between:

(Herein after referred to as “EMPLOYER”)

1. COMMENCEMENT
This contract will begin in January 14, 2022 and continue until terminated as set out in clause 4.

2. PLACE OF WORK
Manila

3. JOB DESCRIPTION
Job Title: TSR

4. TERMINATION OF EMPLOYMENT
Either party can terminate this agreement with two weeks written notice.

5. WAGE

5.1 The employee’s wage is P16,000.00 per month and shall be paid in cash on the 15th and 30th of
each month shall be:
15th- Php8,000.00
30th- Php8,000.00
Transportation Allowance will be given every 30th day of the month worth Php500.00
5.2 Night- Shift Differentials per hour of work performed between 10:00 pm and 6:00 AM will be
compensated. Except for Programmers who work from home.

5.3 The employee will receive holiday pay only if he has been notified to work. Otherwise, he is
required to have a mandatory leave or off duty during holidays with no holiday pay.

5.4 Other benefits will also be received such as SSS, Philhealth and Pag-ibig will be given as soon as
the Management is set with the full benefits plan.

The employer shall review the employee’s salary/wage once a year.


6. HOURS OF WORK
6.1. Philippine Time
Normal working hours will be from 7:00am to 3:00pm
6.2 Overtime will only be worked if agreed upon between the parties from time to time.
6.3 The Employee will be paid for overtime at a premium rate of 25% (regular OT) over the hourly rate.
Only with explicit agreement with the employer.
(Article 82, of the Labor Code states that the provisions of the Labor Code on working conditions and rest
periods shall not apply to managerial employees. This includes overtime pay for overtime work. Thus
managerial employees are not entitled to overtime pay for services rendered in excess of eight hours a
day.)

7. PUBLIC HOLIDAYS
7.1 The employee will be required to have an unscheduled leave or mandatory off during holidays unless
explicitly notified by the employer to report for work. Should this be the case, the employee will then be
compensated accordingly.
7.2 If the employee works on a public holiday he/she shall be paid double.

8. VACTION LEAVES and SICK LEAVES


8.1 The employee is entitled to have 6 Vacation Leaves and 6 Sick Leaves for the whole year. Those leave
is to be taken at times that is convenient to the employer.
8.2 The employee must be notify the employer as soon as possible in case of his/her absence from work
through illness.
8.3 Only the Sick Leave will be convertible to cash at the end of the year calendar.

9. CONFIDENTIALITY AND NON-DISCLOSURE


Any and all kinds of information pertaining to the PROJECT, COMPANY, and any of its CLIENTS, including,
but not limited to, internal systems, procedures and process in connection with your employment shall be for the
sole purpose of being able to execute work properly. All these information are declared to be confidential and shall
be exclusively for and behalf of the COMPANY and CLIENTS. You are strictly prohibited from any authorized
disclosure or reproduction of the same at any time during or after your employment with us. SIMPLEWARE
reserves the right to institute the appropriate civil action and exhaust other legal remedies available to recover
damages and other reliefs against you for any unauthorized revelation or disclosure of such confidential
information.

10. NON-COMPETE CLAUSE


The Employee shall not engage either direct or indirectly with any leads, prospects and clients 2 years
after termination of contract.

11. GUIDELINES
The guidelines will be available in the Employees Handbook.

12. GENERAL
Any changes to this agreement will only be valid if they are in writing and have been agreed and signed by
both parties.
