2023 Mow To Own Program

Properties Eligible

1. Only lots designated by the city of Akron for the Mow to Own program are
eligible.
2. The city has the absolute right to exclude properties from the program at
its discretion.
3. The property shall be vacant unimproved real property.
4. The property shall be physically contiguous to the adjacent owner-
occupant’s real property with a significant common boundary line. In the
case of a nonprofit purchasing the property it has to be located in the
nonprofit’s service area.
5. In the rare case where the adjacent property owner or nonprofits are not
enrolling in the program, a property owner not more the 300’ from the
property may be eligible.
6. The eligible property shall consist of no more than one lot. In some cases,
the city may authorize more than one lot on a case-by-case basis.
7. Situations not herein defined or deemed to be unusual shall be resolved
at the discretion of the Office of Integrated Development and Department
of Neighborhood Assistance.

Applicant Eligibility

Adjacent Property Owner Applicants


1. All applicants must own the contiguous property, and priority may be
given to owner-occupants of the contiguous property.
2. The applicant shall not be delinquent on any real estate.
3. If an owner-occupant applicant owns other properties in the city all of the
owner’s properties shall be registered through the Rental Registration
Program.
4. The applicant shall not have property maintenance, nuisance and/or
building code violations on any properties they own.

Nonprofit Owner Applicants


1. Nonprofit applicants must be a 501(C)(3) organization and the property
must be in their service area.
2. Priority between nonprofits may be given to the nonprofit 501(C((3)
applicant with the best plan for the lot.
3. The nonprofit applicant shall not be delinquent on any real estate.
4. The nonprofit applicant’s properties shall have all properties rental
registered.
5. The nonprofit applicant shall not have properties with maintenance,
nuisance and/or building code violations.
6. Priority will be given to the adjacent property owners.

Other Applicants
1. If ever the need arises where the contiguous property owner and a
nonprofit organization are not pursuing the Mow to Own program,
another potential applicant may be considered for the Mow to Own
Program.
2. The applicant must be an existing property owner within 300’ of the Mow
to Own lot.
3. The applicant must meet the eligibility requirements as the adjacent
property owner applicants and nonprofit owner applicants.

Eligible Activities

Applicants for the Mow to Own program must maintain the property in a reasonable
manner. Maintenance includes mowing and trimming the lot once every two weeks,
raking leaves, shoveling snow, and picking up trash on the property.

Applicants may improve the lot with landscaping, fencing, tree removal, grass
restoration, gardening and other improvements that benefit the neighborhood.
Parking of cars, storage of any kind, construction of buildings or parking lots
are prohibited for the Mow to Own program.

Mow To Own Process

1. The City of Akron will identify Mow to Own lots. If there is a Mow to Own lot next
to an improved property, they will receive a letter from the city along with
instructions on how to apply and the eligibility requirements.
2. If the adjacent owner is not eligible or interested, the lot will be offered to the
rear property owner. In the event there are no other adjacent property owners or
rear property owner, the entire lot shall be offered to nonprofits and other
property owners.
3. Once the application is approved, the city and applicant will enter into a contract
that specifies the program requirements, proposed improvements timelines,
and maintenance plan.
4. The Mow to Own program will be from contract signing through closing.
5. The deed for the vacant lot acquired through the Mow to Own program will
contain deed restrictions including, but not limited to, a restriction that the
acquired vacant lot may not be resold without written approval from the city of
Akron for two years from the closing date.
