AN ORDINANCE PROHIBITING LITTERING, DUMPING, THROWING OF GARBAGE,

RUBBISH OR ANY KIND OF WASTE IN PUBLIC AND PRIVATE PLACES OF BARANGAY
PAITAN STA. MARIA, PANGASINAN
WHEREAS, the Barangay Paitan is committed to the protection, preservation, and conservation
of the ecosystem;
WHEREAS, among the environmental stewardship of Barangay Paitan is to eradicate the

unsightly, unsegregated waste in streets, public and open places.
WHEREAS; the unsystematic waste disposal by households, store owners, vendors and
commercial establishments cause unsightly surroundings and spread of communicable disease;
WHEREAS; the practice of waste segregation to facilitate to reuse and recycling does not only
reduce the cost of collection and disposal of garbage but conserve the natural resources of
materials and avoid wasteful consumption of goods;
NOW THEREFORE; On motion of Barangay Kagawad , Solid Waste

Management Committee Chairman, duly seconded by Barangay Kagawad
and Sangguniang Barangay Members;
RESOLVED, as it hereby resolves, to enact, as it hereby enacts;
BE IT ORDAINED BY THE SANGGUNIANG BARANGAY OF PAITAN, SANTA MARIA,

PANGASINAN IN SESSION THAT;
ARTICLE 1. TITLE
SECTION 1. TITLE. This Ordinance shall be known and referred to as “Barangay Ordinance
Prohibiting Littering, Dumping, Throwing of Garbage, Rubbish or any kind of Waste in Public
and Private places of Barangay Paitan Sta. Maria, Pangasinan”.
ARTICLE II. COVERAGE.

Sta. Maria, Pangasinan”.
SECTION 2. COVERAGE. This Ordinance shall apply to open and covered public and private
places such as but not limited to public markets, alleys, roads, parks, sidewalks, watercourses,
immediate surroundings, rivers, canals, drainage and other water outlets.
SECTION 3. PURPOSE. This Ordinance is enacted for the following purposes;

a. To guide, control and regulate the generation of solid waste within the barangay and
promote orderly sanitary system for the same;
b. To promote and protect the health, safety, and convenience of the general welfare of
the inhabitants of the Barangay;
c. To enhance the total environment of the locality through the necessary control and
mitigation od negative environmental impacts of solid waste;
d. Encouraging the recycling and resource recovery of waste in own backyards through
composting, and,
e. Encouraging the salvaging of possible “recoverables” from solid waste for re-use and
recycling to production process.
SECTION 4. GOALS. The primary goal of this Ordinance is to enhance ecological balance of
the community through sustainable and integrated waste management.
SECTION 5. OBJECTIVES. The objectives of this Ordinance are the following;

a. To eradicate unsightly uncovered and overflowing waste containers in streets, public
places and open spaces;
b. To ensure round the clock cleanliness through the orderly management of waste;
c. To maximize and optimize sanitary resource recovery.
SECTION 6. DEFINITION TERMS. The following terms are defines as follows;

a. Littering- throwing, dumping, and/or the scattering of plastics, papers, residues,
waste materials, garbage, trash, rubbish and/or refuse.
b. Refuse- includes any other waste materials apart from plastics and papers.
c. Public Places- includes path roads, pathways, vegetation area, streets,sidewalks,
highways, parks, playgrounds, schools, business establishments, and residences.
d. Waterways- includes canals, drainage, sewers, creeks, stream rivers, swamp and
the like.
SECTION 7. PROHIBITED ACTS.

a. Littering, illegal dumping, illegal disposal of garbage.
b. Urinating, defecating, and spitting in public place.
c. Dirty frontage and immediate surroundings for establishment owners.
d. Improper and untimely stacking of garbage outside residence and establishment.
e. Obstruction (any dilapidated appliance, vehicle, and etc. display of merchandise,
illegal structure along sidewalks).
f. Dirty public utility vehicle, or no trash can or receptacle.
g. Spilling, scattering, littering of waste by public utility vehicle.
h. Illegal posting or installed signage, poster, and streamers.
SECTION 9. FINES AND PENALTIES. The following fines and penalties shall be imposed to
any person who violates specific provisions of this ordinance. He/She shall be issued with a
VIOLATION TICKET by an enforcer duly assigned by the Punong Barangay.

SECTION 7. PENALTIES. The following penalties shall be imposed to all violators of this
Ordinance.
1st Offense- a fine of pesos shall be imposed to any persons who found
violating this Ordinance plus a community service of 2 consecutive days.
2nd Offense- a fine of pesos shall be imposed to any person who found violating
this Ordinance plus a community service of 3 consecutive days.
3rd Offense- a fine of pesos shall be imposed to any person who found violating
this Ordinance plus a community service of 5 consecutive days.
SECTION 10. SEPARABILITY CLAUSE. If any provisions of this Ordinance or the application
of such provisions to any person or circumstances is declared unconstitutional, the remainder of
this Ordinance or the application of such provisions to other persons or circumstances shall not
be affected by such declaration.
SECTION 11. REPEALING CLAUSE. All existing ordinances or resolutions of this barangay
found to be inconsistent herewith are hereby repealed to modified accordingly.
SECTION 12. EFFECTIVITY. This Ordinance shall take effect in accordance with the provisions
of the Local Government Code of 1991.
ENACTED AND APPROVED by the Sangguniang Barangay of Barangay Paitan, Sta. Maria,
Pangasinan this .
