REVITALIZATION OF ANTI-DRUG ABUSE COUNCIL AND THEIR ROLE IN


DRUG CLEARING OPERATION

WHEREAS, Drug related incidents has been constantly present in our country and resulted in multiple crime
incidents despite efforts, of the PNP and other law enforcement agencies of the government;

WHEREAS, pursuant to Republic Act No. 716, otherwise known as the Local Government Code of 1991, the
government as the level of the barangay is take to promote the general welfare of its constituents through the
maintenance of Peace and Order situation there as through the enforcement of National and local laws;

WHEREAS, DILG issued Memorandum Circular No. 2015-63 dated June 16, 2015, emphasizing effort to
address Peace and Order, particularly to curb illegal drugs and other substances;

NOW THEREFORE, I Jolan L. Borce, Punong Barangay of Barangay san Gregorio La Paz, Abra, by virtue of
power vested in me by the law, do hereby revitalize the organization of the Barangay Anti-Drug Council.

Section 1. Composition

The said council shall be composed of the following:

Section 2. Power and Functions


 Conduct regular meetings at least once a month and call for special meetings whenever
necessary;
 Plan, strategize implement and evaluate programs and projects on drug abuse preventions the
barangay;
 Coordinate and collaborate with other institutions implementing programs and projects on
drug abuse at the barangay level;
 Continuously gather and update data on drug abuse and its effect on the peace and order
situation in the barangay including listing of drug users and pushers;
 Submit a monthly report to the MADAC through the PNP officer;
 Refers users and pushers to the police and other institutions for corresponding sanction,
rehabilitation and /or counselling;
 Monitor disposition and progress of drug related cases filled; and
 Perform other related functions

Roles and Responsibilities
- Prepare and maintain a confidential list of suspected users, pushers,
financiers and / or protectors of illegal drug trade in the LGU to be submitted
to the MADAC copy furnish the PNP and
- Establish rehabilitation / referral desks and process applications for
rehabilitation of drug dependents.
Pre- Operations
o Identification of drug affected house clusters, work places, streets, puroks,
sitios where manufacturer, delivery, sale or use ‘of illegal drugs are being
conducted and to report the same immediately to the PNP or PDEA.
o Conduct meetings, briefings prior to the launching of operations to ensure
positive results and safety of the operating teams and the community.
During Operations
 Ensure safety of the community and regularity of the operations.
 Extend other necessary assistance to the PDEA and PNP
authorities in its operations against illegal drugs including but not
limited to the preservation of evidence and protection of
witnesses and suspects against unlawful acts.
Post Operations
 The elected barangay officials present shall execute an affidavit
and act as witness in court hearings in the prosecution of drug
cases.
 Submit reports on drug clearing operations conducted, it any,
MADAC copy furnished the DILG Municipal Field Office.
For operations conducted by PDEA and PNP, an elected barangay official should be involved
immediately after the raid and be present to stand as witness during the conduct of inventory.

b. Roles and Responsibilities
 Coordinate Collaborate with other institution in the barangay, if any, the
eye in the Barangay BPATs is implementing programs and projects on
Anti-Illegal Drug Abuse
 Conduct consultative meetings with organization in the Barangay such as
the Parent Teachers Association PTA, YOUTH group, Senior Citizens,
Farmers Organization, Drivers Association, and other organization
existing in the community.
 Strengthen the family by promoting values parental care and guidance
that will prevent children from attempting to and/or use prohibited
drugs; LGUs local Police and PDEA on Anti-illegal Drug campaign.
 Conduct necessary seminars for the community on less dangers of illegal
drugs in coordination with the PNP;
 Empower the community in reporting drug related cases through on ward
communication with the PNP;
 Identify and implement sustainable livelihood as a program to former
drug pushers and drug users.

Section 4. Sunctions
 All concerned of local authorities are hereby advised to appropriate
substantial portion of their respective annual budget to the enforcement
of RA 9165 required by section 51 in all budget preparation under section
324 of local government code. Any local officials engaged in the
manufacture, sale, delivery, transportation and administratively to the
prevision of RA 9165.

Section 5. Meeting and Quorum


 The BADAC shall converse one week after approval of this executive order
to discuss the coming activities of the body. After the first organizational
meeting, the body shall meet at least once every quarter or anytime it
feels necessary to discuss issues and concern relative so its preparation
against calamities and disaster.
 Majority of all its member shall constitute a quorum.

Section 5. Meeting and Quorum

The Executive Order shall take effect immediately.
