    MEMORANDUM OF AGREEMENT
    KNOW ALL MEN BY THESE PRESENTS :

    This Agreement executed and entered into 1st day of January 2023 by and between

    DEPARTMENT OF EDUCATION, Guinhalaran Integrated School- Secondary , a government educational


    institution, duly represented herein by KENNETH P. LACSON - Principal I, Filipino, of legal age, referred herein as
    First Party ;
    -And-

    JACOB A. JANOPLO, Filipino, of legal age, and a resident of Sitio Cubay, Brgy. Guinhalaran, Silay City,
    referred herein as Second Party ;
    Witnesseth  That-

    WHEREAS, since there is no watchman or personnel to guard the school after class specially at night when
    ransacks oftimes occur, the school is always ransacked and vandalized ;

    WHEREAS, after assessment of the damages and losses on the property of the school every time the facilities are
    stolen or destroyed, the school Administration has decided that the best remedy to prevent destruction and pilferage in
    school is to hire a watchman/utility ;

    WHEREAS, in spite of the conditions and limitations as stipulated in the offer in hiring a watchman/utility, the
    Second Party, upon receiving the information without hesitation and delay, applied and declared his willingness to accept
    the job;

    WHEREAS, the Second Party is not related to the representative of First Party and/or to any of its teaching staff,
    by affinity or consanguinity up to the fourth (4th) degree ;

    WHEREAS, the Second Party is not a Barangay Official, Barangay Tanod, etc. receiving compensation using
    government funds.

    NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE FOREGOING PREMISES, the parties hereby
    agree and stipulated the following :
    1. Effective Date of Agreement : January 1, 2023 to June 30, 2023
    2. Compensation : The Second Party shall be paid a monthly compensation of Eight Thousand Pesos (Php
    8,000.00), allocated and taken from the School MOOE. Monthly payment for the services shall be based upon the
    availability of fund of the School MOOE. There shall be no augmentation that will be taken from any school fund
    in excess of the amount stipulated in the contract.
    3. Working Hour : The Second Party’s working hour shall be from Monday- Friday (20 days), from 8:00am-12
    noon and 1:00 pm to 5:00 pm (8 hours) with minimum wage of Php 400 per day of the service for the period of
    January 1, 2023 to June 30, 2023.
    4. Duties and Responsibilities of the Second Party :
    a. Do the non teaching related task.
    b. Keep track of records and documents in the office.
    c. Observes all school policies and guidelines.
    d. Help the teachers and school administrators make reports required by the division, regional and national
    office.
    e. Assist the Disbursing officer and Principal in preparing for the Monthly Liquidation of the school MOOE.
    f. Agree that payment of monthly services shall be based upon the availability of fund of the School MOOE.
    g. Raise his grievance to the school’s Grievance Committee through a letter, and submit to its proper procedures
    and guidelines, and shall not get to any political affiliates so as not to complicate the existing or whatever
    conflict that transpired.
    5. Assumption of Risk : The First Party will not be held liable for any injury of the Second Party in the course of
    performance of his duty.

    6. The First Party is more than willing to extend its support if needed and necessary.
    7. Confidential Information : The Second Party undertakes not to disclose or devulge to any person outside the
    school any confidential knowledge or information which he may have obtained or will obtain in the course of his
    duty.
    8. Miscellaneous Provision : The Second Party shall perform the duties and responsibilities that will be assigned to
    him, with high standard of skill, effeciency, honesty, and obedience, whlie the first party must treat the second
    party with utmost respect and decency.
    9. Termination : The First Party has all the option to terminate, suspend, or cancel this Memorandum of Agreement
    anytime without prior notice and benefit of consent from the Second Party.

    To affirm our agreement stipulated above, we hereby affixed our signature below.
