helmet and jumping the red signal. On stopping them, you came to know that one of them
met with an accident due to potholes and is severely bleeding and due to non-arrival of the
ambulance they are taking him to the hospital. On further enquiry, you came to know that
the driver does not have a driving license and works as a day wager. While on his way to
work, he found the man lying injured on the road and in a rush to take him to hospital, he
left his helmet on the site of an accident. The driver expresses his financial inability to pay
increased fines. Recently, due to the enforcement of the new Motor Vehicles Act, you are
under severe pressure from your seniors for strict enforcement.
What will you do? What law would you apply(if any) in this scenario and why?
Solution
In this scenario, the most important thing is to promptly provide medical attention to the
injured person as the safety and well-being of all road users is my responsibility as a traffic
enforcer. If the hospital is nearby, they may be allowed to leave, but if it is far away, alternative
arrangements like an ambulance or contacting the police emergency number should be made to
ensure the safety of the victim and others.
After ensuring that the victim has received medical attention, I would take legal action
against the violators for their multiple traffic violations, including driving without a helmet,
running a red light, and driving without a license
These violations are serious and could lead to accidents and harm to others. As a traffic
enforcer, it is my duty to enforce traffic rules and ensure compliance for the safety of all road
users. The Motor Vehicles Act provides penalties for such violations, including fines and
imprisonment. Moreover, Through Republic Act No. 4136 and Republic Act No. 10054, the
estimated total fine: ₱ 5,500.00 (see Annex A.).
However, given the driver's financial situation and that they may have been motivated by
a desire to prevent the victim of the accident concerning a sense of urgency to get him to the
hospital as soon as possible, it must have meant that their action is circumstantial.
In addition, the purpose of the Motor Vehicle Act is to reduce the number of fatalities.
Having the motorist be responsible for paying the fine, on the other hand, would ensure that the
law is strictly enforced and would allow me, as a constable, to fulfill my responsibility as an
enforcer of the law. I would use my discretion and apply the law with some leniency, issuing
reduced charges for the violations. It should be noted that the driver's ownership of the
motorcycle and leaving the helmet at the accident site indicates that they travel regularly without
a license. I would advise the driver to apply for a license and to understand the importance of
following traffic rules for everyone's safety.
I would also educate all violators about the significance of obeying traffic rules and the
severe consequences of reckless driving. Furthermore, it is critical that governance ensures the
timely availability of medical help to victims to ensure social justice, as the lack of ambulance
services compels people to adopt unsafe measures for transporting the injured.
