AFFIDAVIT OF NON-INTEREST, DESISTANCE, WAIVER AND QUITCLAIM
I, ORLAND DENIEGA NGALIS, of legal age, Filipino and resident of
Brgy. Abaga, Libungan, Province of Cotabato, upon our oath depose and state, THAT:
1. On September 06, 2022, at about 9:14 AM, a road crashed incident
transpired along Libungan-Cagayan National Highway particularly at Public Market Site, Brgy. Poblacion, Libungan, Province of Cotabato, involving the following vehicles: (1) a 10 (ten) wheeler Fuso Fighter Truck owned by CHRISTOPHER TIO DATUWATA, and driven by a certain RENE BENGIL ALBORO together with his helper JOMAR PANES CANINDO; (2) a Toyota Hilux Conquest, color black Mica with plate number NGY1364 owned and driven by ORLAND DENIEGA NGALIS; and (3) a black Honda Click 125 motorcycle with plate number 1101-473330 driven by ROWEL GERODIAS ENCABO;
2. Considering the circumstances which was not intended as it was an
accident and the fact that both parties have freely and voluntarily agreed to settle the matter involving the resulting damage and injuries sustained in the agreed sum of ONE HUNDRED FIFTY THOUSAND PESOS (PhP150,000.00), I, ORLAND DENIEGA NGALIS hereby desist from filing any case or complaint and to prosecute or testify against the owner of the 10 (ten) wheeler Fuso Fighter Truck owned by CHRISTOPHER TIO DATUWATA and/or their driver, RENE BENGIL ALBORO together with his helper JOMAR PANES CANINDO, for the damage on the said vehicle as well as any and all injuries sustained including any and all actions that may be filed on account of that vehicular accident. As such, I have hereby waived any right that I, ORLAND DENIEGA NGALIS may have arising therefrom and forever release, by this quitclaim, CHRISTOPHER TIO DATUWATA and/or their driver, RENE BENGIL ALBORO and his helper JOMAR PANES CANINDO from any kind of liability on account of that accident;
3. I am stating for the record that I have voluntarily executed this non- interest, desistance, waiver and quitclaim knowing fully well that I can no longer file any case or complaint, whether criminal, civil or administrative, and prosecute or testify against each other for the damage sustained by our said motor vehicles, as well as any and all actions that may be filed on account of that vehicular accident;
4. I am executing this non-interest, desistance, waiver and quitclaim to
attest to the truth of the foregoing facts in order to apprise the proper authorities of my desistance to file a case or complaint, testify against and prosecute against the afore-said parties for the damage on our said motor vehicles as well as any and all injuries (if any) including any and all actions that may be filed on account of that vehicular accident and for whatever legal purpose this may serve.
