MOTION NOTIFYING SUPERVISED RELEASE VIOLATIONS, REQUESTING AN


ARREST WARRANT AND ORDER TO SHOW CAUSE HEARING

COMES NOW, RUBEN G. VELEZ-PEREZ, U.S. PROBATION OFFICER of this Court,

presenting an official report upon the conduct and attitude of Mr. Velez-Vargas, who was sentenced on

May 26, 2022, by Your Honor, to time served and to be followed by three (3) years of supervised release

after pleading guilty of Tittle 18:922 (g)(1) and Title 18:924 (a)(2) – Convicted felon in possession of a

firearm and ammunition. Mr. Velez-Vargas commenced his supervised release term on May 26, 2022.

Since Mr. Velez-Vargas commence to serve his supervised release term, he has violated the

following conditions:

1. MANDATORY CONDITION: “You must not commit another federal, state, or local

crime”.

2. STANDARD CONDITION No. 9: “If you are arrested or questioned by a law

enforcement officer, you must notify the probation officer within 72 hours”.

3. SPECIAL CONDITION: “The defendant shall not commit another Federal, state, or

local crime, and shall observe the standard conditions of supervised release

recommended by the United States Sentencing Commission and adopted by this

Court”.

On April 13, 2023, the undersigned Officer was telephonically contacted by a Puerto Rico Police

Officer who informed this writer that Mr. Velez-Vargas was involved in an incident at an establishment in

Mayaguez and that the incident was publish on the social media. The Puerto Rico Police Officer provided

thru text message the video and the news in related to an aggression caused by Mr. Velez-Vargas to a

bartender on a bar known as “Casa Kantina”. The Puerto Rico Police Officer provided the undersigned

with the telephone contact of the P. R. Police Officer in charge of the investigation.

Later, on the same date, the undersigned Officer contacted the P.R. Police Officer in charge of the

investigation who reported that they were going to locate Mr. Velez-Vargas for an interview. The P.R.

Police Officer was provided with Mr. Velez-Varga’s address of record and telephone contact numbers for

their benefit.

On April 14, 2023, the undersigned Officer contacted by telephone, P.R. Police Officer in charge

of the investigation and he reported that the incident where Mr. Velez-Vargas was involved, occurred on

Wednesday April 12, 2023, at approximately 2:00 a.m. P.R. Police Officer informed by telephone

communication that Mr. Velez-Vargas was cited to report to their Office Today at 2:00 p.m. for an interview

and that he will be in company of a legal counsel.

Later, P.R. Police Officer in charge of the investigation was telephonically contacted once again

and he reported that they are going to file criminal charges next Monday April 17, 2023, at the Mayaguez

District Attorney.

As per social media, news and videos, Mr. Kelvin Velez-Vargas was identified by the bartender of

the establishment “Casa Kantina”. The bartender publishes a message on Instagram social media platform

reporting that while the manager of the place told to a person that they must leave since they were going to

close the business, the person identified as Angel Orama, attack the manager, and his friend identified as

Kelvin Velez-Vargas, took what appears to be a cup and launched it towards the bartender and hit her on

her face. Additionally, the bartender publishes that while she told the individuals to go away, Kelvin Velez

grabs a crystal frame and launched it towards her and also tries to hit her. The bartender reports that she

clearly listens to them stating “that they will grab them on the streets”. The bartender reports on the social

media message that she fears for her safety.

Today, April 17, 2023, the undersigned Officer was reached by personnel from the Mayaguez pre-

trial services Office (OSAJ), who sent to the undersigned Officer the criminal complaints with the assigned

number of: 2023-05-050-03865, that were filed at the Mayaguez Courthouse. The criminal complaints

reports that Mr. Velez-Vargas will be charge for violations to the P.R. Penal Code, Article 241.C

(misdemeanor) Disturbance of Peace; two (2) counts for violations to the P.R. Weapons Lay 168, Article

6.06 (felony) carry and use of a white weapon; three (3) counts for violations to the P.R. Penal Code, Article

108 (misdemeanor) Aggression.

Wherefore, in view of the above-mentioned circumstances, it is respectfully requested that a

warrant for arrest be issued, so that Mr. Velez-Vargas be brought before this Honorable Court to show

cause why his supervised release term should not be revoked and thereupon be dealt pursuant to law.
