QUESTION 1

Explain the various ways in which acceptance of a proposal may be communicated. Support
your answer with reference to the Contracts Act 1950 and relevant cases.

QUESTION 2

a) Milli proposed to sell his piano to Vanilla for RM 8,000 to be accepted within one
week. Vanilla agreed to buy the piano for RM 6,000. Immediately after receiving
Vanilla's reply, Milli sold the piano to Tim. Vanilla wishes to sue Milli for breach of
contract.

Advise Milli.

b) Malik was forced to enter into a contract to sell his bungalow to Wan for RM 500,000.
The original price of the house was RM 5 million. During the execution of the contract
Malik was threatened and pressured by Wan's very rude and large number of
employees. They threatened to use weapon and harm him.

Advise Malik as to the validity of the contract.

QUESTION 3

a) Identify and elaborate the duties a Principal owes to an agent.

b) David appointed Remy as his agent. He instructed Remy to sell his shop house at
Jalan Permai. According to the agreement the house should be sold at a price RM
500,000 within one year. After the appointment was made, Remy unfortunately had a
terrible accident. He was paralysed and could not perform his duties at all.

Advise David whether he could terminate Remy's appointment.

a) In the event of a breach of contract for the sale of goods, the Sale of Goods Act 1957
provides remedies for both the buyer and the unpaid seller.
Discuss the remedies available to an unpaid seller under the Act.

b) Ezral bought 25 pieces of ceramic plates after a sample was shown to him by Tom.
Ten of the plates delivered to Ezral were of the same orange colour as the sample
but the remaining plates were multi-coloured. Meanwhile Ezral used the ten orange
plates to serve food to his friends at his dinner party. When hot food was poured onto
the plates, it cracked.

Advise Ezral.

a) Timun bought a car by way of hire purchase. After seven months, she passed away
in an accident. Her husband, Carrot, wanted to know whether he has the right to
continue with the hire purchase. With reference to the Hire Purchase Act, advise
Carrot.

b) Fatin recently won a cash prize in a reality television show. She now intends to make
an early settlement on her Livina with Lingkup Finance under the hire purchase
agreement.
