Foreign Contribution Regulation Act

Introduction

● NGOs are a vital in the progression of the economically and physically weaker
sections of the society. They are totally dependant on donations from domestic and
foreign sources to undertake their operations
● However NGOs often drift along an indistinct line to gain such financial help,like
forign funding, charity, Government-funded campaigns, corporates and more
● It is important to ensure the foreign funds collected are regulated to ensure they are
not used for malpractices that can affect the integrity and safety of India.
FCRA
FOREIGN CONTRIBUTION (REGULATION) ACT

● The primary purpose of the act is to regulate the inflow of foreign contributions and
ensuring that the received foreign contributions are not utilized for purposes other
than those specified under the legislation
● To regulate the acceptance and utilization of foreign contributions or foreign
hospitality by certain individuals or associations or companies
● To prohibit acceptance and utilization of foreign contribution or foreign hospitality
for any activities detrimental to the national interest
FCRA

● The act was enacted in 1976


● Revised in 2010
● Foreign contributions shall be applicable to an individual, hindu undivided family, an
association, companies and organization having a definite cultural, economic,
educational, religious or social programme are entitled to accept foreign contributions
under the FCRA. moreover they should meet the criteria set by the act by registering
themselves with the Central Government and funds can be recieved using one bank
FCRA

The FCRA does not specify registration under Income Tax Act as a precondition
for getting registration under the FCRA

Under no circumstances domestic contributions should be mixed in the bank from


which the foreign credit is recieved

FCRA is not regulated by RBI

Regulated by Ministry of Home Affairs, Government of India


Registration

● Form FC-8
● Audited Statement of accounts of past 3 years
● Annual reports specifying activities of past 5 years
● Location proposed for work
● Certified copy of the Registration Certificate
● Copy of permissions that were granted prior
application for registration
● Copy of resolution of governing body of the
organisation
● Copy of power of attorney
● List of members present in the organization
● Copy of any journal of the organization
Conclusion

FCRA was passed as an Act by the Parliament of India to consolidate and to


regulate the acceptance and utilization of foreign contribution or foreign
hospitality by individuals or associations or companies and to prohibit
acceptance and foreign contributions for transgressional purposes
