TRO’s Comments :

In this case collection of Rs.2,16,39,233/- has already been made and demand of
Rs.5,95,86,000/- is outstanding. The bank account and debtors have already been attached.

During the previous quarter, the debtors were identified and notice u/s.226(3) of the I.T. Act,
1961 was issued on 25/05/2018.

The company has gone into liquidation and Liquidator, Mr. Laxman Digambar Pawar, has been
appointed by the NCLT in the case of Hi Tech Engineering Corporation India Pvt. Ltd., Pune.
Further as per the telephonic conversation with the Liquidator, Mr. Laxman Digambar Pawar,
the liquidation process has already been initiated and 2 properties of M/s Hi Tech Engineering
Corporation India Pvt. Ltd., Pune have been sold, the amount of which has been transferred to
Bank of Maharashtra being the 1st secured creditor. Further, it has been communicated
telephonically by the liquidator, Mr.Laxman Digambar Pawar, that next they are going to
liquidate unsecured properties and in due course, he will intimate the status of when
departmental claim for recovery will take place. The courtesy letter dated 21-06-2019 sent to the
assessee has been returned back by the post unserved.

Constant efforts in coordination with the Liquidator are being made for the recovery of
outstanding demand.

Further progress will be reported in the next quarter.

During the previous quarter , it was reported by the AO that the assessee
got its books of accounts duly audited for A.Y. 2011-12 and 2012-13 on 14/03/2018 with
an inordinate delay and the same has been filed before the ITO (TDS)-1. Pune only on
30/03/2018. However the assessee has audited the Books of Accounts but no Return
has been filed.

It has been gathered that due to centralization the assessment for A.Y. 2011-
12 and 2012-13 are pending with the ACIT , Central Circle, Belgaum. The AO has been
requested to pass on the information for A.Y. 2011-12 and 2012-13 in respect of the
assessee and the directors to the respective jurisdictional AO for initiating further
necessary actions at their end. On the basis of Tax Audit Report ,the debtors shall be
identified and further progress will be reported in the next quarter.
