Every investigation by the Police shall be completed without unnecessary delay and charge sheet
submitted to the court. Throughout the process of investigation of case the police maintains the
record of all the leads and details, which is ultimately presented as report before the magistrate.
Such report is called as final report. It contains oral material , documentary material and the
conclusions that are drawn out by the police. It must be in the prescribed form as provided under
the Sec 173 of crpc.
It must contain :
1. Name of parties
2. Nature of information
3. Name of person who appear to be acquainted with circumstances of the case
4. Whether any offence appear to be committed if so by whom
5. Whether accused has been arrested if so by whom
6. Whether he has been release on bond
Magistrate is not bound by conclusion in final report. If not satisfied by final report magistrate
could ask for further investigation. Final report under Section 173 of crpc is outcome of complete
process of investigation made under Section 155(2) or section 156. Which says about power of
police to investigate cases that is cognizable or non cognizable with or without the order of
magistrate.
FINAL REPORT
Police officer has to make three different kind of report during the investigations different stages.
Under section 157 of crpc the preliminary report is provided and it must be filed to the
magistrate by officer in charge of the police station. When subordinate police officer report to the
officer in charge of police station under Sec 168 of crpc it is known as forwarding report. And
under section 173 of crpc says about final report
FINAL REPORT & CHARGE SHEET
Final report is the report which is ultimately presented before the magistrate , where the records
of all leads and details collected by police officer are included in final report. Final report and
charge sheet cannot be called as same in all situations. If in an investigation it is found that
evidence is sufficient for prosecution then final report could be also called as charge sheet and in
rest of situation final report could also be called as closure report. Generally and investigation
end with final report but under some exceptional circumstances it could happen that the police
may have to find further evidence, materials and submit it to magistrate along with his further
report.
Charge sheet could be called as specific type of final report . when an offence is committed and
there is sufficient evidence to prosecute the accused person who has committed the offence then
in such situation the final report could be called as the charge sheet.
