1. WHO MAY OPEN ACCOUNTS – Any person six years of age, able to read and write, and not suffering from any legal disability may open a personal savings
account in the Development Bank of the Philippines (the “Bank”). A father or mother may open a parental savings account for each of his or her minor children and
such account remains under the exclusive control of the parent until the minor reaches legal age at which time exclusive control passes to him, unless it is otherwise
stipulated at the time of making the deposit that withdrawal can be made by the minor also. A guardian, trustee or administrator may also open a savings account for
each person or estate committed to his care.
If the person opening a savings account cannot write, all of the required documents may be accomplished by a person other than an employee of the Bank. Said person
shall also sign said documents as one of the witnesses to the Depositor’s impression of his/her fingerprint thereon.
Deposits made jointly in the name of two or more persons can be withdrawn only upon presentation of withdrawal slip signed by all of them. For joint (“or”) accounts,
anyone of the named Depositors may make a withdrawal in accordance with the joint account agreement signed by them. Deposits made by a corporation, partnership,
or association can be withdrawn by an officer or employee duly authorized in the By-Laws or resolution by the Board of Directors of the said corporation, partnership
or associations, and made known to the Bank.
2. DEPOSITS – To open a savings account, a required minimum deposit for individual account and for corporate account will be accepted by the Bank which may be
made in person or through any authorized representative. Thereafter, the Bank will accept any amount of deposit to an existing account. The Bank reserves the right to
accept or reject a deposit by check. A service fee shall be charged the depositor whenever his/her personal check, deposited in his/her savings account, is not honored by
the drawee bank. A prevailing service fee shall be charged for interbranch deposits.
3. THE PASSBOOK – Upon the opening of a savings account, the Bank will furnish the Depositor a Passbook in which all deposits and withdrawals made by the
Depositor will be entered by the Bank and/or an ATM card as the case may be. The Passbook, however, shall be released only upon completion of requirements.
Possession of the Passbook shall raise the presumption of ownership and any payment/s made by the Bank upon the production of the Passbook and entry/ies therein of
the said withdrawal/s shall have the same effect as if personally made by the Depositor himself/herself.
The Passbook must be returned to the Depositor when the Depositor’s account is closed. A Depositor must not, under any circumstances, cause/write any entry on the
Passbook, as the Bank will not be responsible for any sum not properly recorded and acknowledged therein. No entry to the Passbook shall be made except by the Bank.
In the event of any discrepancy between the entries on the Passbook and those appearing in the records of the Bank, the latter shall prevail.
A Depositor must present his Passbook or ATM Card to the Bank whenever he makes a withdrawal. The Depositor shall keep the Passbook in a secure and safe place
accessible only to the Depositor or his/her duly authorized representative. In case the Passbook is lost or stolen, the Depositor shall immediately inform the Bank/report
the fact of said loss in writing, including the circumstances surrounding the same.
If the Passbook is not found within a reasonable time, the Depositor may file an application in writing for a new Passbook, in which case, the Bank may, at its option
cause a substitute Passbook to be issued to such Depositor on such terms of due verification, indemnity, publication and other conditions as the Bank may deem proper
while the original Passbook shall thereafter be void.
The Bank shall not be responsible for any payment/s made on a Passbook prior to its receipt of the notice of loss of the same. Upon the issuance of the new substitute
Passbook, the Bank will enter the Depositor’s outstanding credit balance as manifested in the books of the Bank.
4. HOW TO MAKE DEPOSITS – All deposits must be made by the Depositor or by his representative by accomplishing a DBP deposit slip. If the Depositor cannot
write, he must have the form filled out by a person other than an employee of the Bank.
5. HOW TO MAKE WITHDRAWALS – All withdrawals must be made by the Depositor in person by accomplishing a DBP withdrawal slip. Withdrawal from a
savings account by a person other than the Depositor may be effected upon filling up the “withdrawal by representative” portion of the withdrawal slip which is
likewise duly signed by the Depositor. If the Depositor cannot write, he must have the withdrawal slip accomplished by a person other than an employee of the Bank,
who must also act and sign said withdrawal slip as one of the two witnesses to the Depositor’s affixing of his/her fingerprint thereon.
Withdrawals from accounts carried in other online DBP Branches may be allowed upon presentation of the Passbook. The Branch covering the transaction shall request
for signature verification and approval of withdrawal slip from the Branch where account is maintained thru fax and the same will be sent back to transacting Branch
upon signature verification and approval with test key where the account is maintained. A prevailing service fee shall be charged for interbranch withdrawals.
A Depositor can withdraw up to the extent of the balance of his savings account. Withdrawals can be made anytime during the banking hours which shall be from 8:30
a.m. up to 3:30 p.m. from Monday through Friday, except for banking, legal and/or special holidays. Save in certain cases when, in the opinion of the Board of
Directors and the interests of the Bank so require, the Bank reserves the right to require the Depositor to furnish the Bank a 60-day written notice before any
withdrawal.
A corresponding service charge shall be deducted from the savings account the balance of which falls below the required minimum balance.
Withdrawals paid by the Bank prior to being informed/knowledge of the Depositor’s death shall be binding on the Depositor’s estate.
6. CLAIMS AGAINST ERRONEOUS ENTRY – Any claim against any erroneous entry in the Passbook must be made by the Depositor before leaving the Bank or
on the occasion when the entry is made otherwise the Bank shall be relieved from any responsibility in connection therewith.
7. INTEREST – Deposits shall earn interest from the day they are received. Interest on deposits shall be computed based on its Average Daily Balance (ADB) and
credited to the Depositor’s account at the end of each calendar quarter. Deposits below the required ADB during a particular quarter shall not earn interest for the said
period. The Passbook must be periodically presented to have interest posted thereon by the Bank.
8. CLOSING DEPOSITOR’S ACCOUNT – A Depositor may close his savings account by accomplishing a withdrawal slip for the entire balance credited to his
Passbook. Accounts closed within thirty (30) days from date of opening will be charged a service fee as prescribed by the Bank. Pursuant to Sec. 1 of Act. No. 3936, as
amended by P.D. No. 679 dated April 12, 1978, all deposits of money and/or accrued interest due to any Depositor known to be dead or who has not made further
deposits or withdrawals during the period of ten (10) years or more, shall be transferred to the Treasurer of the Philippines, to the credit of the Government of the
Republic of the Philippines.
9. CHANGE OF ADDRESS – Any Depositor who moves/transfers to some other place or changes his/her place of residence should immediately notify the Bank of
his/her new address to update the Bank’s records.
11. DORMANT ACCOUNTS – Accounts which are dormant for at least two (2) years shall be charged a monthly service fee based on current Bank prescribed rates.
12. EXTRAORDINARY FLUCTUATIONS - In case of extraordinary inflation or deflation of the currency stipulated herein, the provisions of Article 1250 of the
Civil Code of the Philippines shall not apply.
13. COLLECTIONS - All deposits shall be received as current deposits and will be similarly repaid. However, deposit of checks, drafts, money orders, treasury
warrants and others, shall be conditionally accepted as the same are still subject to collection and drawings against such deposits shall not be made/allowed until actual
payment of the proceeds have been received by the Bank.
If for any reason the proceeds of such deposited checks, drafts, money orders, treasury warrants and others, cannot be collected or if the Bank is required to return the
proceeds thereof, the pertinent entry/ies thereof made in the Passbook and in the Bank’s records shall be deemed automatically cancelled regardless of the time that has
elapsed and irrespective of whether the defective items can be returned to the Depositor. For this purpose, the Bank is hereby authorized to immediately execute the
necessary corrections or changes in the Passbook and/or in its records at the first opportunity. The Depositor assumes full responsibility for the validity and
genuineness of the items deposited including the correctness, genuineness and authenticity of all endorsements thereon.
In case the Bank is compelled to take judicial or extra-judicial action to enforce collection of any amount or debt arising from the account, the Depositor shall indemnify
the Bank for all costs and other judicial or extra-judicial expenses plus attorney’s fees in the amount of at least (10%) of the total amount due, including accrued
interests, which in no case shall be less than P20,000.00 plus cost of suit. Venue of such action or any action hereunder shall be at Makati City or at another place at the
Bank’s option.
14. BANK LIABILITY – The Bank, its officers, employees and representatives shall not be liable for any loss, claim, damages, suits of whatever nature, arising out
of or in connection with a systems or computer-related error, imperfect programming procedures, materials, workmanship or functioning of any computer or other
related equipment. The Bank shall have no responsibility for the unavailability of the Account’s funds due to government restrictions, involuntary transfer, exercise of
military or usurped powers or other causes beyond the Bank’s control, including force majeure. Force majeure shall mean circumstances beyond the control of the Bank
including, but not limited to strikes or other personnel difficulties, insurrection riots, national emergencies, war, acts of public enemies, fire, floods, typhoons or other
catastrophes or acts of God. The Bank shall likewise not be liable for any loss, damage, claims arising or resulting from compliance with any law, order, regulation,
direction or request of a regulating body or the courts.
15. The Bank reserves the right to amend any of the foregoing terms, conditions and/or regulations and in the event of such amendments, the same will be posted in a
conspicuous place in the Bank’s premises to serve as due notice to its Depositors.
16. INQUIRIES ON ACCOUNT – Disclosure of information on the Depositor’s account shall be subject to and in accordance with R.A. 1405 as amended (Law on
Secrecy of Bank Deposits). The Bank is likewise hereby authorized to respond and provide relevant information to the credit management organization of which the
Bank is a member.
17. ACCEPTANCE OF RULES – Savings deposits shall be made by the Depositor and received by the Bank subject to the foregoing conditions and regulations. The
Depositor agrees to said conditions, rules and regulations and consents to any and all modifications/amendments/revisions of the same. The Depositor likewise
recognizes that the provisions of applicable laws such as R.A. 9160 or the Anti-Money Laundering Act of 2002 shall apply.
18. Deposits are insured with PDIC up to a maximum of (Php500,000.00) per Depositor.
1. The ATM Card shall be available to all DBP personal savings account and current account Depositors.
2. The following services are available for twenty-four (24) hours a day, seven (7) days a week at the DBP ATM.
a. Cash Withdrawal – allows a maximum of five (5) withdrawals or P50,000.00 per day. Minimum of P200.00 and a maximum of P10,000.00 per
withdrawal.
b. Fast Cash Withdrawal – allows fast withdrawal of P500.00
c. Fund transfers – allows transfer of funds from one DBP account to another.
d. Balance Inquiry – allows the Depositor to inquire for the current & available ledger balances.
e. Check Book Request – allows requisition for 1 checkbook per transaction request.
f. Statement Request – allows special request for statement of account.
g. Debit Bills – allows the cardholder to pay bills to accredited Megalink institutions upon enrollment or with no enrollment for certain institutions.
h. Electronic Fund Transfer Point of Sales (EFTPOS) – a facility which allows the cardholder to pay at Megalink accredited department stores,
supermarkets, gas stations, etc.
3. The Depositor shall keep the ATM Card in a secure and safe place and ensure that the same is not placed in the hands of another person besides the Depositor or his
authorized representative. In case it is lost or stolen, the Depositor must immediately notify the Bank of said loss either thru phone or in person by accomplishing the
ATM Customer Complaints Form which shall take effect 24 hours after receipt of complaint. The Bank shall not be liable for any withdrawals made on the ATM prior
to the reporting of the loss.
4. Lost, stolen or physically damaged cards shall be replaced subject to the prescribed ATM Card replacement fee of DBP. For lost or stolen cards, cardholder shall be
required to execute an Affidavit of Loss.
5. The ATM card remains the property of the Bank and may be revoked/repossessed anytime upon notice in case of any violation of the terms/conditions/regulations of
its use. In addition, the Bank may withdraw/suspend the ATM card/services offered in connection therewith without prior notice.
6. The Depositor must not reveal the PIN or cause to reveal the PIN to any person under any circumstances.
7. The Depositor shall assume full responsibility for all transactions made by the use of his DBP ATM card whether or not made with his knowledge or authority.
8. The Depositor must notify the Bank of any error in ATM transactions/statements within 15 days from the date the error occurred.
9. The Bank or the Depositor, may cancel this agreement at anytime even without prior notice, subject to the applicable laws and regulations.
10 The Bank reserves the right to amend any of the foregoing conditions or regulations and in the event of such amendment, the same will be posted in a conspicuous
place in the Bank’s premises.
11. The Depositor agrees to the conditions, rules and regulations in the use of the ATM card and consents to any and all modifications/amendments/revisions of the
same.
12. Overwithdrawals due to a “system’s error” shall be collected or debited immediately from the Depositor. If collection efforts fail one (1) month from the time of the
system’s error/overwithdrawal, the same shall be referred to the Bank’s Legal Department for appropriate action.
