EXECUTIVE ORDER NO. 037
Series of 2023

”AN EXECUTIVE ORDER CREATING THE LOCAL MIGRATION DATABASE


MANAGEMENT TEAM AND OF THE MIGRATION DATABASE IN BARANGAY
SALVADOR, CITY OF SANTIAGO THRU THE REGISTRY OF BARANGAY INHABITANTS
AND MIGRANTS (RBIM) AND FOR OTHER PURPOSE/S”

WHEREAS, Republic Act (RA) No. 7279, the Urban Development and Housing Act (UDHA) of 1902, provides
for a comprehensive and continuing urban development and housing program, establishes the mechanism for its
implementation and for other purposes;

WHEREAS, Section 37, Article IX of RA No. 7279 provides that Local Government Units (LGUS) shall set up
an effective mechanism, together with the appropriate agencies like the Commission on Population and
Development (CPD), the National Economic and Development Authority (NEDA), and the Philippine Statistics
Authority (PSA) to monitor trends in the movement of population from rural to urban, urban to urban and urban
to rural areas;

WHEREAS, the Commission on Population and Development, the National Economic and Development
Authority, and the Philippine Statistics Authority are likewise mandated to provide planning information to
national and local government planners on population projections and the consequent level of services needed in
particular urban and organizable areas i.e. early-warning systems on expected dysfunctions in a particular urban
due to population increase, decrease, or age structure changes;

WHEREAS, the Philippine Government respect the rights of the Filipino citizens to migrate and search for better
opportunities for employment and residence;

WHEREAS, the process of urbanization brings socio-economic inequality between rural and urban areas;

WHEREAS, migration has economic, social and environmental implications - both positive and negative for the
places of origin and destination;

WHEREAS, there is a need to understand internal migration patterns and factors to foster more balanced spatial
distribution of the population by promoting in an integral manner the equitable and ecologically sustainable
development of major sending and receiving areas;

WHEREAS, Local Government Units and Barangay Government Units are tasked to provide the required
programs and services for its inhabitants, including migrants, and manage the development problems arising from
the changes in its population structure;

WHEREAS, the Local Population Officer was tasked to establish and maintain an updated data bank to include
migration and other relevant demographic, social and economic data and information for program operations as
basis for development planning, policy-making and service provision;

NOW, THEREFORE, I, Sammy C. Sarmiento, Punong Barangay of Barangay Salvador, City of


Santiago, by virtue of the powers vested in me by law, do hereby order as follows:

Section 1. Creation and Composition of the Local Registry of Barangay Inhabitants and Migrants
(RBIM) Team. The Local Registry of Barangay Inhabitants and Migrants (RBIM) Team is hereby
created and shall be composed of the following:

Section 2. Duties and Functions. The RBIM Team SHALL perform the following duties and functions:
Punong Barangay: Over-all in charge and control
a. Develop a comprehensive Work and Financial Plan (WFP) for the establishment of the Local Migration
Database (LMB) through Registry of Barangay Inhabitants and Migrants (RBIM);
b. Identify champions and conduct advocacy activities for allocation of funds to support activities leading to
establishment of RBIM;
c. Undertake coordinative mechanism to ensure and monitor the overall implementation of activities in the
WFP for RBIM;
d. Ensure conduct of survey using the prescribed survey tools, encoding, processing and packaging of data
gathered;
e. Ensure the regular monitoring and updating of the Registry of Barangay Inhabitants and Migrants thru
Barangay Secretary tasked as Field Supervisor for the RBIM monitoring in the Barangay;
f. Conduct data utilization activity and ensure utilization of RBIM for program planning, monitoring and
evaluation purposes;
g. Advocate for the inclusion of Local Migration Data as administrative data to be collected by enumerators;
h. Perform other tasks necessary for the completion of the local migration database.

Section 3. The Secretariat. A Secretariat is hereby created, to be headed by Barangay Secretary.


The Secretariat shall perform the following duties and functions:

a. Ensure the privacy and functionality of the RBIM Database to be well kept and maintained at the Office
of the Barangay Secretary.
b. Provide secretariat service, preparation of the meeting0s and agenda, and document the proceeding of the
meetings and related activities of the RBIM;
c. Facilitate in the preparation of reports for consolidation, and their timely submission to concerned offices
and agencies;

Section 4. Meetings. The RBIM Team shall meet and convene every quarter or as often as necessary as may be
determined by the Chairperson.

Section 5. Data Privacy and Access to Information. All requests for information generated from the
LMIS/RBIM shall be processed in conformity to the Data Privacy Act of 2012 (Republic Act No. 10173) and the
President's Executive Order No. 02 dated 23 July 2016 as well as, the Freedom of Information Memorandum
Circular (FOI-MC) No. 01 s 2016 issued by the Presidential Communication Operations Office (PCOO).

Section 6. Separability Clause. —If any part or provision of this Executive Order is declared unconstitutional or
invalid, the same shall not affect the validity and effectivity of the other parts or provisions hereof.

Section 7. Repealing Clause. All local orders, rules and regulations issuances or any part thereof inconsistent
with the provisions of this Order are hereby repealed amended modified accordingly.

Section 8. Effectivity Clause. — This Executive Order shall take effect immediately or after posting in at least
two (2) conspicuous places in the municipality.
Let copies hereof be furnished to all concerned for information, reference, and guidance.
