Dear Ma’am,
A pleasant day.
This letter is intended for some clarifications for the release of HAZARD PAY in Northern Samar Provincial Hospital
and Provincial Health Office, excluding Administrative Personnel in the entitlement of the said Pay. As stated in
section 3 of Magna Carta for Public health workers (R.A 7305), Definition of Health workers who are engaged in
Health and Health-related work and all person employed in hospital, sanitaria, Rural Health Units, Main centers,
health infirmaries, Barangay Health Stations, Clinics and other health-related establishments owned and operated
by Government or its political subdivisions with original charters and shall include medical, allied health
professional, Administrative and support personnel employed regardless of their employment status shall be
entitled for Hazard Pay with classification of high risk and Low risk, granting twenty five (25%) to PHW who’s salary
Grade 19 and below, Five (5%) for salary Grade 20 and above who rendered twelve (12) or more days. In the case
of Gil G. Cawad et.al vs Florencio B. Abad as his capacity as DBM Secretary, the Supreme court upheld the validity
of DBM-DOH Joint circular as to the qualification of actual exposure to danger for the PHW entitlement to hazard
pay. It is clearly indicated in the circular that personnel who works in hospital are covered with Hazard pay, thus,
administrative office shall be included in the said pay because the location of the office is still in the Hospital and
still considered Hazardous. Under section 3 of New Rules on Hazard pay of DBM-DOH Joint circular No.1, series of
2016, relevant provisions states;
3.1 HAZARD PAY- Hazard pay is an additional is an additional compensation for performing
hazardous duties and for enduring Physical hardships in the course of duties.
As a general compensation policy, and in line with section 21 of R.A. No. 7305, hazard pay may be
granted to PHWs only if the nature of duties and responsibilities of positions, their actual
services, and location of work expose them to great danger, occupational risks, perils of life, and
physical hardships as determined by the Secretary of Health, or by head of agency or the Local
Chief Executive, with the Approval of the Secretary of Health.
3.2.1 Specific work areas in Hospitals, sanitaria, leprosaria, and infirmaries such as patients
wards, intensive care units, operating rooms, outpatient departments, and other Medical
Departments where PHWs are in contact with patients with contagious and communicable
diseases and handle hospital Paraphernalia used in patients such as linen, food, utensils, bed pan,
etc.
3.2.2 Specific Work areas in Provincial Health Offices, City Health Offices, Municipal Health
Offices, Rural Health Units, and Health Centers where PHWs are exposed to out-patients with
contagious and communicable diseases.
The provisions are very clear, there is no exclusion of administrative personnel because they constitute as part of
Hospital and Provincial Health Offices, and it is not meritorious if the provincial Government will exclude them to
avail the benefit that are intended for them. We, respectfully request for a quick response from our matter.
