CASE STUDY QUESTION (15%)

In Apartment IOI, there is Joseph who has been staying there for 5 years. Joseph wants to sell his
car as he needs to buy a new washing machine and refrigerator. He agrees to sell his car which
cost RM50,000 to Raj for only RM10,000. But somehow, his friend who owed him money paid
the money now so he has sufficient money to purchase the two house appliances. Joseph refuses
to perform the contract with Raj and he claims that the contract price is way below the market
value of the car, makes the contract void.

Joseph’s neighbor is a married couple, Kaman and Kamila who have been married for 10 years.
Kaman wrote a promise that he will give Kamila monthly maintenance allowance of RM2,000 a
month after they got married if she agreed to stay home as a housewife, in which Kamila did.
Now, things are not working out between Kaman and Kamila, so they decides to separate.
Kamila wants to claim the money Kaman owed her, as according to her, Kaman only paid her
monthly allowance in their first year of marriage.

Based on the scenario above,


1. advice Joseph whether a contract exists between Joseph and Raj
2. advice Kamila on her rights under law of contract.
