Balemo Comments To Foe

The document summarizes objections filed by the accused's counsel to the prosecution's formal offer of evidence in People of the Philippines v. Emily Balmeo, et als. for violation of Section 77 of PD 705. The accused's counsel objects to Exhibits A-E and G-M on the grounds that the affiants lacked personal knowledge of the document contents and preparation or the documents were not identified by the preparers. The accused's counsel also argues Exhibit E is self-serving. The counsel requests the court note these objections in considering the prosecution's evidence.

Accused.
x------------------------------------------x

COMMENTS/OBJECTIONS
TO PROSECUTION’S FORMAL OFFER OF EVIDENCE

Accused through counsel respectfully submit her comments or

objections to Prosecution’s Formal Offer of Evidence as follows:

A - This is being objected on the ground that the affiant has

no personal knowledge on the contents of the documents she
identified; she was not the one who prepared the documents and
she was not present during the preparation thereof. She is therefore
incompetent to testify thereon.

B - This is being objected on the ground that it is an

inadmissible evidence; this is purely hearsay and the affiant was
not presented on the witness stand to testify on this affidavit.

C, D, F and G- These are being objected for the same grounds in

Exhibit B.

E - This is being objected for being self-serving. The affiant

has no personal knowledge on the actual cutting and the crime
alleged in the complaint.

G, H, I, H, K, L, and M-This is being objected on the ground that

these documents were not identified by the person who prepared
the same, hence, these are inadmissible.

WHEREFORE, premises considered, it is respectfully prayed

of tis Honorable Court that this comments or objections be noted in
consideration of the admission of evidence offered by the
Prosecution.
