I. Topic: SPECIAL PENAL LAWS, REPUBLIC ACT NO. 3019 “ANTI-GRAFT AND CORRUPT PRACTICES ACT”,
REPUBLIC ACT NO. 10883 “NEW ANTI-CARNAPPING ACT OF 2016”, REPUBLIC ACT NO. 7877 “ANTI-SEXUAL

violation of rules and regulations duly promulgated by competent authority or an offense in

of the carnapping shall be denied bail when the evidence of guilt is strong.

RA NO. 3019
TERMS DEFINITION
1. Statement of policy It is the policy of the Philippine Government, in line
with the principle that a public office is a public
trust, to repress certain acts of public officers and
private persons alike which constitute graft or
corrupt practices or which may lead thereto.
2. "Government" includes the national government, the local
governments, the government-owned and
government-controlled corporations, and all other
instrumentalities or agencies of the Republic of the
Philippines and their branches.
3.  "Public officer"  includes elective and appointive officials and
employees, permanent or temporary, whether in the
classified or unclassified or exempt service
receiving compensation, even nominal, from the
government as defined in the preceding
subparagraph.
4. "Receiving any gift" includes the act of accepting directly or indirectly a
gift from a person other than a member of the
public officer's immediate family, in behalf of
himself or of any member of his family or relative
within the fourth civil degree, either by
consanguinity or affinity, even on the occasion of a
family celebration or national festivity like
Christmas, if the value of the gift is under the
circumstances manifestly excessive.
5. "Person"  includes natural and juridical persons, unless the
context indicates otherwise.

RA NO. 10883
TERMS DEFINITION
1. Body building a job undertaken on a motor vehicle in order to
replace its entire body with a new body
2. Defacing or tampering with a serial number refers to the altering, changing, erasing,
replacing or scratching of the original factory
inscribed serial number on the motor vehicle
engine, engine block or chassis of any motor
vehicle. Whenever any motor vehicle is found to
have a serial number on its engine, engine block or
chassis which is different from that which is listed
in the records of the Bureau of Customs for motor
vehicle imported into the Philippines, that motor
vehicle shall be considered to have a defaced or
tampered serial number

TERMS DEFINITION
1. Work, Education or Training -Related, Sexual Work, education or training-related sexual
Harassment harassment is committed by an employer,
employee, manager, supervisor, agent of the
employer, teacher, instructor, professor, coach,
trainor, or any other person who, having authority,
influence or moral ascendancy over another in a
work or training or education environment,
demands, requests or otherwise requires any
sexual favor from the other, regardless of whether
the demand, request or requirement for submission
is accepted by the object of said Act.

1. Why is there a need to implement RA no. 3019?


 There is a need to implement this law because it is the principle that a public office is a public trust, to repress certain acts of
public officers and private persons alike which constitute graft or corrupt practices or which may lead thereto. And also, to
monitor public officials if they receive unsolicited gifts or presents of small or insignificant value offered or given as a mere
ordinary token of gratitude or friendship according to local customs or usage

2. How important is Anti-Carnapping Law in the Philippines?


The anti carnapping law is important in the Philippines is because when the crime is committed with violence, intimidation or use
of force, the imprisonment sentence is for 30 years and one day to 40 years. If the owner, driver, occupant of the carnapped
motor vehicle was killed or raped, the person found guilty would be sentenced to life imprisonment. Meanwhile, any person
involved in the concealment of the crime of carnapping would be imprisoned from six to 12 years and fined with the acquisition
cost of the motor vehicle, engine or any other part involved in the violation.

3.Under RA. No. 3019, in what instances that you will be convicted to graft and corruption?
Possible instances that you will be convicted to graft and corruption would be Persuading, inducing or influencing another public
officer to perform an act constituting a violation of rules and regulations duly promulgated by competent authority or an offense
in connection with the official duties of the latter, or allowing himself to be persuaded, induced, or influenced to commit such
violation or offense.

4.What are the three types of harassment?


The three types of harassment are Work, Education or Training -Related, Sexual Harassment. Work, education or training-related
sexual harassment is committed by an employer, employee, manager, supervisor, agent of the employer, teacher, instructor,
professor, coach, trainor, or any other person who, having authority, influence or moral ascendancy over another in a work or
training or education environment, demands, requests or otherwise requires any sexual favor from the other, regardless of
whether the demand, request or requirement

5. What can you say about RA no.7877 or the “Anti- Sexual Harassment”?
What I can say about this law is that everyone shall value the dignity of every individual, enhance the development of its human
resources, guarantee full respect for human rights, and uphold the dignity of workers, employees, applicants for employment,
students or those undergoing training, instruction or education.

Graft and corruption are problems that have plagued the Philippines for so long as our government has been in existence. Time
and time again news outlets and media report public officials, elected or not, to be involved in acts which constitute graft,
corruption, or both. Even with the passage of Republic Act. No. 3019, otherwise known as the Anti-Graft and Corruption Law,
these problems are never solved. Arguably, it can be said that the law has minimized and suppressed graft and corruption, and
the penal provisions thereof discourage public officials from committing the same. Nevertheless, these problems persist. This
study was conducted to analyze selected Supreme Court rulings applying Republic Act No. 3019, specifically the most common
acts committed in violation thereof, the defenses set up by the accused, and the ruling of the Supreme Court as can be generally
derived from them. Content analysis was the research design used and a sample of the cases the Supreme Court decided on with
respect to Republic Act No. 3019 was studied and analyzed. Of the decided cases, 40% of the cases was resolved in favor of the
accused. The remaining 60% was resolved against them. The acts alleged against the several accused, the defenses they
interposed, and the reason for the ruling of the Supreme Court for or against them varied widely and are discussed in detail in the
respective portion.

Corruption erodes the trust we have in the public sector to act in our best interests. It also wastes our taxes or
rates that have been earmarked for important community projects meaning we have to put up with poor quality
services or infrastructure, or we miss out altogether.

2. What can you do to prevent carnapping?


One of the tips would be Listening or watching the news could keep you updated to the modus operandi of
carnappers. Most of the carnapping syndicates change their styles to make it harder for authorities to capture them.
One of the newest carnapping modus is called “bump and ride” where car thieves would rear end a motorists vehicle,
forcing the passenger/s to exit the vehicle. The carnappers would then force their way in the victim’s vehicle and
quickly drive away with the stolen car.

Harassment is associated with increased risk of anxiety, depression, and post-traumatic stress disorder, as well
as diminished self-esteem, self-confidence, and psychological well-being. And this could have a huge impact on
