AND ON COUNTERPART STAFF AND FACILITIES TO BE
PROVIDED BY THE CLIENT

Project Appreciation
In accordance with the Tor (Terms of Reference) the broad objective is for the provision
of contracting services for the “Construction Management and Construction
Supervision for Phase 1 Infrastructure and Building of Dar-ul Aman Administrative
Complex”. To meet these objectives, an appropriate Contractor will be appointed by the
Tender Authority.

The purpose of the contract is site supervision and contract management services as the
Engineer, for the Works Contracts) in terms of quality, time and cost. For successful
achievement of the project, understanding the project management structure is very
important. It is understood from the ToR, management structure will be formed under
three main responsible bodies:

• The Ministry of Urban Development and Housing (MUDH)


• Beneficiaries (Other Governmental ınstitutions)
• Client’s Nominated Project of each specific projects

MUDH as the Contracting Authority is responsible for tendering, contracting,


administration, overall project supervision, review and final approval of the reports,
financial management including payments of project activities and is responsible for
programming and monitoring of actions in the relevant sector.

The Beneficiary refers to the users of the buildings to be reconstructed under the project
and stake holders who are responsible for the overall coordination between the MUDH

The Client’s Nominated Project Managers are responsible for the technical
implementation, coordination, supervision, assessment, execution, management and
sustainability of the project and the liason and communicate with the stakeholders and
all related approvals submitted through the Consultants as stated in Tor 2.1 (d).

We recommend to establish a Steering Committee by the responsible bodies and the


related stakeholders to discuss the project progress, verify outputs & results and discuss
actions for the successful implementation for a common mind and decision even in
technical details. The meetings may be arranged at quarterly intervals and on ad hoc
basis when necessary.. The Consultant will prepare agenda and technical progress
reports for the Beneficiary and other relevant parties at least 2 weeks in advance of every
Steering Committee meeting by e-mail including the information about problems
encountered, the activities in the last period and the activities to be performed within
next period.

The Consultant, OPTIMAL PMO, will present all relevant information and documents
to enable an assessment of the progress of the work, as well as all information on
unforeseen circumstances that might jeopardise successful implementation of the
Contract. In the latter case, the we will submit to the Contracting Authority a range of
potential mitigation actions deemed necessary in order to overcome such unforeseen
events. The final decision on which actions to implement will be taken thereby.

The Contracting Authority will be primarily responsible for day-to-day monitoring of


project implementation via a process of close collaboration with the Consultant;
ensuring that reports and other project outputs are submitted in accordance with the
time-schedule defined in ToR; facilitating the timely approval of reports and other
project outputs; facilitating cooperation and collaboration with the Beneficiary.

The Terms of Reference has identified the following to be the main purpose of the
supervision services for the project:

1. To undertake supervision services for the project in order to ensure that it complies fully
with the Contract which will be signed between the Consultant and the Contracting
Authority.
2. To carry out the duties assigned to the Consultant in the Contract during the
implementation of the project.
3. To provide a staff of suitably qualified experts and engineers who are competent to
carry out all of the supervision duties according to this Terms of Reference and the
Contract.

Although no major difficulties are envisaged to undertake the services, it will be


important to consider and take into full account the following issues when undertaking
the duties of the Consultant:
• Ensuring the highest safety standards for the workforce and the construction sites
• Ensuring effective planning and optimal cost flow for construction activities
• Ensuring highest consideration for the environmental and social safeguards since
the refugees are the most vulnerable people.

A) ON THE TERMS OF REFERENCE


The ToR (Terms of Reference) is generally clear in their definition of the scope of the
services and reporting requirements requested from the Consultant including
background information, objectives-purpose-expected results, assumptions-risks,
logistics-timing, staff-office-facilities, monitoring-evaluation process. Nevertheless, the
Tenderer would like to make a few observations about the implications of the procedures
or arrangements set out in the Terms of Reference or listed in the scope of work of the
Consultant:

Contract timing
It is noted in the ToR the period of the Contract will be 60 months from the intended
start date. This time interval good in respect of the extensive scope of the project
including supervision services for the 9 buildings/headquarters having more than
330.000 m2 and with all ınfrastructure facilities. It is needed high performance from
experts and good organisation from the Project Manager. On the other hand, it is
understood in the ToR, for each of the buildings assigned Clients Nominated PM
will lead to effective and efficient implementation.

Office accommodation and facilities


It is noted in the ToR, office accommodation for each expert working on the
contract is to be provided by the Client excluding the relevant facilities. We
understood we will establish a new operational office based in Kabil for our core
team. In order to facilitate collaboration with the Contracting Authority and the
Beneficiary, we will ensure Key Experts in our core team permanently serve at the
headquarters and the construction sites. We will support our Key Experts with
sufficient Non-Key Experts, plus administrative and technical support staff
furthermore appropriate office equipment, transportation vehicles and safety
equipment’s, site equipment’s under the project fund by ensuring regular payments
for the employees.

Site Transport for the Project Staff


The Consultant, we, will provide its own on-site transportation for his staff by
appropriate transporting vehicles including fuel, maintenance & service, pay toll,
etc.

Project Cooperation and Reporting


The present proposal assumes that the our team will be available whenever needed
to clarify contractual issues and will provide supplementary information where
required in a timely fashion with a view to achieving the contractual objectives and
requirements in this respect. Reporting requirements are very well defined in the
ToR including report name, its content, submission time intervals, way of
presentation and approvals. Specific evaluation and monitoring indicators will be
defined based on agreed implementation mile-stones and time schedule after
approval of the our Inception Report.

Laboratories /Testing Equipment


We understand that the laboratory facilities to be provided by the Client. We
recommend these laboratories will be established by the Contractors if approved by
the Client.

Site Access
All site works will be implemented under officially written permissions of the
Consultant under information of the Contracting Authority in order to ensure
smooth construction works with the collaboration of local authorities and
construction sites natives. We will provide to our staff as well as any site visitors
legitimately invited to assist in the process of the works and its administration or to

monitor on behalf of the Contracting Authority, all necessary Personal Protective


Equipment on a serviced loan basis within the contract price to enable individuals
to gain safe access around the site under the control of the us. Also we will provide
all necessary safe means of access to all the site areas to which access is reasonably
required for his staff to discharge their duties.

The Consultant’s Role


The success of the project will depend to a great degree on the ability of the
Consultant, in his capacity as the core team of experts, to work in close harmony
with the Contracting Authority, as well as with the Beneficiary. We firmly believe
that the experience gained in many years of working in Europe and Turkey on
similar projects funded by the European Union and such organisations and together
with our local sub-consultant Green Desc we will provide the proposed team with
the necessary knowledge and expertise to ensure a smooth and efficiently run
project and thus to achieve the stated objectives. Our action is to ensure the flowing
progress of the work without reasoning any delays. There are in actual fact just very
few ad-hoc issues that require such immediate attention on site works, but some
issues have spill-over effects and even indirectly are related to cost and time. The
sole exception to this general rule is of course when there is a real danger to life and
limb – i.e. whenever the health and safety of the workforce is directly threatened.
Then We are obliged to take immediate action.

Project Staff
As it is defined in the ToR, we enclose the Experts’ CVs”. We already have
experienced experts in our company and in our local sub-consultants having
appropriate professional qualifications and the collective skills and experience
manage all components of the Contract. We think that the number and qualifications
of both key-staff/experts and non-key experts defined in the ToR will be enough
for a supervision team to organise and implement the project tasks. We will provide
necessary backstopping and support staff for this team as we told in our organisation
and methodology description.

Key Issues Affecting Achievement of the Objectives

As already pointed out, we will carry out his duties in accordance with the
Conditions of the Contract concerning “Construction Management and
Construction Supervision for Phase 1 Infrastructure and Building of Dar-ul
Aman Administrative Complex” in conformity with the local and international
standards.

Key issues in achieving the objectives on this contractual basis will be:

Partnering and Project Coordination


A key development in the promotion and execution of the project is good
coordination with the Contracting Authority, and other project parties moreover
effective liaison with the End Recipient in technical matters. Partnering involves
the parties coming to a mutual realisation that, if they work efficiently together from
the start, the result will be better than if they do not. It is about transparency and

trust and values, shared objectives and continuous improvement. Such an approach
also minimises delays, shares risks and benefits, adds value and not cost, creates a
better working environment and ensures that everyone wins.

We are encouraged to ensure that all representatives have a common approach for
acting on the project and performing the activities in the same manner, it is
important – already at an early juncture – to:

• Set the main aims of the partnership;


• Agree key roles and responsibilities;
• Set key dates and programme;
• Agree outline philosophy in principle objectives, problem solving and
reporting procedure;
• Agree a formal meeting programme.

The aims of partnering need to be agreed prior to forming the partnership and
developed as the project progresses.

We believe that key aims should be:

• Planning context and programme certainty;


• Successful relationship, short and long term;
• Proactive third party management;
• Efficiency of process – involving evaluation, expertise and systems.

The introduction of the partnering philosophy has been a key factor in the activities
in resolutely reducing costs whilst providing and improving levels of service
provided to their clients across the globe. Partnering encourages all parties to work
together to agree a common goal.

Typical benefits from a strong partnering approach include:

• Financial - improved cost efficiency leading to major savings.


• Programme - the potential to reduce project life-cycles by efficiencies in
decision-making and approvals processes.
• Quality of Service - maintaining and progressively and jointly improving on
the level of service.

Especially for the site works, safe and secure access to the site under permission of
the Consultant is essential in order to execute construction activities according to
the occupational health and safety rules. Public and private stakeholders on the local
and regional level need to be informed and ready cooperate informally and formally
in order to ensure safety and effectiveness in site works.

Personalities are important in a partnering team, as it is difficult for people to step


outside their traditional role. It is important to have the right blend of people within
the partnership team who are committed to its success. Trust, honesty and integrity
are essential ingredients. Initially members have to be carefully selected to ensure
that they fit in with the team and with the ideology and approach. Our Key
Satff/Experts and Clients representatives will clearly have key parts to play in
making partnering work for this Project.

Selection and mobilisation of an experienced, qualified and motivated


project team
The right supervision team especially the core team consists Key Experts is the
essential prerequisite for the successful implementation of the subject supervision
services as the ToR points to this crucial factor. The supervision team members,
introduced in the ToR, have been selected for their previous experience and
knowledge of projects of a similar nature; each one is able to make an immediate
and lasting contribution. The Consultant will seek to encourage all staff to work in
a co-operative and efficient manner that yields benefits to all, facilitates timely
responses and approvals, focuses on critical areas of quality and budget, and
encourages ideas that save time and money. The completeness and clarity of the
site works and the relevant tests depends on high qualified and motivated
supervision team. Additionally: experience, competence and resources of the
Contracting Authority and the Beneficiary are very important in order to support
the supervision team so they can give high quality and effective services within
well-defined general approach and attitude. On the other hand availability of
certified test laboratories is important for the implementation of all kind of relevant
tests in scope of the project. Environmental oversight is the crucial part of the
supervision services which directly affects the project future.

Development of quality management and financial management


systems and progress reporting procedures
We will exercise all reasonable care in the development of systems to protect the
interests of the Contracting Authority and ensure the efficient supervision services
and quality-quantity assurance for the works. The systems will be designed to
provide rapid and accurate information on the project to ensure that the Contractor
can maintain a continuously updated management information system and effective
control of finances and progress under inspection of the Contracting Authority. A
high quality of management products and services is conditional for a successful
supervision procedure.

Effective monitoring and review of adherence to Works Programme


We will maintain a regular and detailed review of Works progress against detailed
overall and sectional programmes of working which will be required from, and be
prepared in accordance with the Contract. Early identification of problems or
underperformance areas, and the need for appropriate corrective action, will be
closely monitored and ensured. Agreement among project parties on approach,
content and timetable for all activities especially milestones is substantial.

Central financial management systems and accounts with centralised


reporting of overall project progress
The Contracting Authority’s administrative procedures in place to facilitate timely
decision making and payment are other important key issues in our opinion. The
Contracting Authority may also require assistance with the establishment of, or
compliance with, standard systems and reporting procedures to ensure that
information provided on the Project will be coordinated and summarised in a form
as required by the Financing Memorandum if any. The establishment and
monitoring of project accounts to ensure the implementation of appropriate
drawdown requests under disbursement procedures as well as compliance with the
Financing Memorandum are major issues which may require early action within the
Project schedule.

Terms of Reference is prepared very well and clear enough to explain all work steps to be
handled.
We have some further suggestions and our special contributions to the Terms of Reference
to be integrated in our scope of works:
We have included several additional positions which is not mentioned in the RfP. However; we
think these experts/consultants will contribute to the quality of the services provided which
leads to better outcome;
• Risk Management Specialist since it is one of the main critical mile stone of the Terms
of Reference so we plan to add an experinces Risk Management Expert just focused and
followed this task in coordination with the site management team and with some site
visits to check whether the implementation is on going in line with the action plans
• LEED Expert & Facade Consultancy; climate change and the energy demand are the
world common problem and the new challenging issues which adversely affects the
development of the countries. So we need to be get prepared for the climate change risk
and try to decrease also the energy usage so that the LEED Expert will focus on this
issue and prepare an approach how to integrate them in to the design and the
implementation of the public buildings.
• Seismic Engineer; since Afghanistan is in the seismic zone; a very experienced
consultant which has a great experience in terms of seismic isolated structures have been
added to the technical team with overall review of the design and design changes if any
and follow through some site visits also.
• Increasing the public participation is our main concern and the communication and the
stakeholder management for the succesfull implementation of the project

• We plan to make the contractors to set up Visual Observation Network (VON) utilized
by means of online supervision of the site for the Consultant and the Contracting
Authorities and other related Government Institutions (Beneficiariesin the project)
• For All Risk Insurance policies of Contractors’, our insurance expert shall check them
for the convenience to the Contractors’ contract conditions.
• Capacity Building and Training of the local staff is our main concern not only for this
project but also for all other assignement we have completed before which contributes
a lot for the sustainability of the services to be provided after our project.

Our suggestions and futhers are explained in detail here above and in the methodology of
our technical proposal;

COMMUNICATION & STAKEHOLDER MANAGEMENT


One of the important aspects of the
Project is the communication and
coordination between the
institutions and finally the
beneficiaries, end users and the
stakeholder management. The
Ministry of Urban Development and
Housing has executed visionery
programs and projects.
We, as the Construction
Management and the Supervising
Consultant, has also a mission and
the responsibility about the
awareness raising of these
investments.

One infographic/videographic has been prepared by us; emphasizing the following main
component of the Project;
• The details and the description of the Administartive Buildings each
• The investment cost of the Projects
• Information about the other similar investments
• Added Value of these investments
• Contrubition for the employment of the citizens in the region and the Social Benefits
• And the most’s of the investment (capacity, # of beds, services to be provided, etc.)
In addition; the content for the social media has been prepared and submitted for the approval
of the Contracting Authority and / or related ministries free of charge if requested by the
Contracting Authorities.

COORDINATION BETWEEN THE INSTITUTIONS AND THE FOLLOWING OF


THE DOCUMENTS

The following investment is subject to the coordination of the several authorities, from the
Govermental institutions to the Service Providers, from the universities to the Municipalities.
Considering the urgency and the emergency nature of the Project; We have assigned one of our
staff just dedicated for the strictly following of any documents, operation, transaction, work and
process about any disciplines or the sub-component of the projects which leads to the increase
in the efficiency and effectiveness and the smooth implementation of the projects in due time
and quality.

EMERGENCY – DISASTER RELATED ARCHITECTURE & DESIGN

Afghanistan is among the most exposed countries to disaster risk in the world due to its seismic,
topographic and climactic characteristics. Seismic risk is the most critical one and the country
experiences on average one earthquake with a magnitude 5-6 per year. In terms of exposure, of
its territory, its population are located on seismic zone.

In this scope which aims to make a disaster-resilient cities on the individual, familial and
institutional level, one of the most important subjects is to integrate the disaster resiliency
parameters into the design of the structures and the architecture.
We; are very familiar and have completed sesimic and climatic risk mitigation projects
succesfully. Based on this experience; we have proposed to take into consideration of non-
structural risk

Examples of the utilities components include mechanical and electrical equipments and
distribution systems, piping and conduit, tank, fire extinguisher, etc. Following figures show
some techniques of strengthening utilities components;

These are non-structural components that belong to occupants of the building. Examples
include office, computer, and communication equipment, cabinets and shelving for record and
supply storage, library stacks, kitchen, furniture, movable partitions, lockers and vending
machine.

Briefly; considering the seismic risk not only the main structural system but also non-
structural elements are also so crucial to reduce the risk of earthquakes in other words to
increase the safety of occupants against natural hazards. It is fact that numereous injuries of
occupants result from the fact that basic structural systems are designed neglecting non-
structural components. Therefore, We as the Supervisor Contractor, will be providing
some connection details during the design review period for the architectural components,
mechanical, plumbing and electrical items on the construction drawings as a guidance fort he
contractor

ENERGY-EFFICIENCY & GREEN BUILDING CONCEPT

Considering the Climate Change and our experience in Turkey; we will also provide more
energy efficient solutions in Dar-ul Aman Administrative Complex and greener approach
during the construction works by also having a value engineering to proof the economy also.

FACADE Peer & Bid Review

One of the most complicated and multi disciplinary technical and critical subject is the selection
of the materials of the facade, description of the details, the peer review and the control, and to
provide the optimum solutions between the design and the final products in terms of cost &
quality so that the construction will be durable, smooth and energy efficient and using the
maximum benefit of the day light. Therefore; the proposed facade system by the designer will
be reviewed in terms of architectural, structural, energy and thermal performance and the cost
correlation.

Façade Expert will review one set of the final architectural drawings and applicable
specification sections for the building enclosure and provide comments on remaining concerns
on the enclosure design paying particular attention to the details and interfaces as shown on the
drawings. We will again also review and comment on the requirements in the specifications for
samples, technical data, mock-ups, and performance testing. The objective of this review is to
identify details, requirements, or methods which may compromise the water tight integrity
and thermal performance of the building in order to call these identified items to the attention
of the architect of record and the owner for their action. Issues such as constructability and
material compatibility need to be examined by the commissioning agent and specific guidance
should be supplied via written documentation to the owner and the architect of record at each
phase of review. Materials that appear to be poor choices based on durability and a potential
for rapid replacement need to be identified, especially on sustainable projects, where product
replacement requiring new resources in a short time frame should be examined versus the use
of a more durable product that may not be as environmentally appropriate on first selection.
If any details, plans, or specifications are modified by the architect of record, the we will review
these prior to issuance of the design documents to the Contractor. If elements recommended for
change have not been completed, the commissioning agent should provide written
documentation to the owner, indicating what risks may be associated with not implementing
these items.

The peer review process is an important step in assisting the architect of record in making good
decisions on the selection of materials, and method of integrating those materials into a durable
building envelope.

Environmental Aspects
Necessary measures for environmental safety aspects shall be taken in order to not disturb the
third parties. In this context the most recent local, international and EU Environmental
Regulations are required to be taken into consideration particularly during the supervision of
the construction works. The Project shall be executed under the ‘Environmental Management
Plan’
Within this scope Consultant shall also be responsible for the supervision of the Contractors’
onsite environmental management practices (waste management, noise, etc.) shall be monitored
and report to the Client in his monthly progress reports. For relevant supervision and instruction
of the applications to the Contractor shall be monitored.
The reports shall also include environmental management practices followed for mitigation of
environmental impacts of the works. All the requirements that takes place in the Contractor’s
Contract shall be realized.

Follow of labour salaries in site:


- No worker let to work without insurance
- Working of small age labour shall be restricted
- Working of foreign shall be restricted
- No totally hand over of the works to completely to a sub-contractors shall not be allowed
- Notices dealing with the labours salaries that are published in each public building shall be
restrict and seriously followed. It is strictly followed that the workers salariesshould be
paid on time each months without delay
- Supervision staff shall report every month about the financial issues site to the Project
Manager

POST-OCCUPANCY EVALUATION

We as the consultant is aware of the fact that; the Ministry, Beneficiaries(other Clients –
Ministries) has given specific importance to the views of the beneficiaries, end users and the
citizens in order to increase the quality of the similar future projects based on the lessons learned
and the impact analysis done.

Although; it may be the subject of another component; we will contribute with one Social
Expert for the pre and post-occupancy evaluation;

• To analyze the impact of the Project on the social life,


• To determine the adverse impact if any and to mitigate,
• To increase the benefits and the advantages of the Project,

TRAINING

If we are awarded for the Contract, it is planned to conduct training session for our consultancy
technical team. These sessions shall include theoretical trainings and practical sessions.
Training Program shall be handled both in office as a workshop and site. The instructors of the
Training Program planned to be as follows, (shall be agreed with the Client).

- Laboratories
- Suppliers

I. Contract Management

Since the Contract shall be under FIDIC, in order not to face with any contractual problems
during the course of the Services and to maintain trained technical people after the Project,
the Personnel shall be trained on Contract issues. How to read the Contract, the clauses that
show paramount importance to follow, etc. The Contract Management Training shall be
given by;
1) Project Manager/Foreign Personnel – In order to get an international perspective
2) Project Manager or his acting staff /Local Personnel – In order to match the critical
points with local conditions

II. Supervision Phase

We aim to train our personnel in the light of the technical conditions.

Site Training

After the completion of training of consultancy technical teams, the team members shall
continue activities on site. In order to train the technical staff of the Contractors, some important
construction applications shall be realized on site. For this purpose, professional firms shall be
invited to site. Besides the supplier firms, the laboratories shall also give trainings on the test
subjects. Also one of the aim of site training program is to make the contractors’ technical staff
get to be familiar to the inspection forms we are going to use on site. Training on health/safety
& environmental aspects also shall be handled on site.
