RAPE- RA 8353 The penalty varies depending on the act itself and the circumstances surrounding it.

Reclusion Perpetua (Imprisonment from 20 to 40 years) is imposed on the offender if rape is committed
through sexual intercourse.

HUMAN TRAFFICKING- RA 9208 Any person found guilty of qualified trafficking under Section 6 shall
suffer the penalty of [life imprisonment] DEATH and a fine of not less than two million pesos but not
more than five million pesos'.

ILLEGAL DRUG - RA 9165 This Act, consisting of 101 sections, provides for importation of Dangerous
Drugs and/or Controlled Precursors and Essential Chemicals. It establishes offences and penalty
according to the different dangerous drug, regardless of the quantity and purity involved

MURDER- “ART. 248. Murder. Any person who, not falling within the provisions of Article 246, shall kill
another, shall be guilty of murder and shall be punished by reclusion perpetua, to death if committed
with any of the following attendant circumstances:

With treachery, taking advantage of superior strength, with the aid of armed men, or employing means
to weaken the defense, or of means or persons to insure or afford impunity;

In consideration of a price, reward, or promise;

By means of inundation, fire, poison, explosion, shipwreck, stranding of a vessel, derailment or assault
upon a railroad, fall of an airship, by means of motor vehicles, or with the use of any other means
involving great waste and ruin;

On occasion of any calamities enumerated in the preceding paragraph, or of an earthquake, eruption of


a volcano, destructive cyclone, epidemic, or any other public calamity;

With evident premeditation;

( pre- planned or pinagplanuhan)

With cruelty, by deliberately and inhumanly augmenting the suffering of the victim, or outraging or
scoffing at his person or corpse.

Generally, the elements of murder are:

1) That a person was killed;

2) That the accused killed him;

3) That the killing was attended by any of the qualifying circumstances mentioned in Art. 248; and

4) That the killing is not parricide or infanticide.

HOMICIDE- The crime of Homicide is defined and penalized under Article 249 of the RPC, which reads:
“Art. 249. Homicide. – Any person who, not falling within the provisions of Article 246, shall kill another,
without the attendance of any of the circumstances enumerated in the next preceding article, shall be
deemed guilty of homicide and be punished by reclusion temporal.”

while for homicide, the penalty is reclusion temporal with a duration of 12 years and 1 day to 20 years.

The elements of Homicide are the following:

(a) a person was killed;

(b) the accused killed him without any justifying circumstance;

(c) the accused had the intention to kill, which is presumed; and

(d) the killing was not attended by any of the qualifying circumstances of Murder, or by that of Parricide
or Infanticide.

PARRICIDE- Article 246. Parricide. - Any person who shall kill his father, mother, or child, whether
legitimate or illegitimate, or any of his ascendants, or descendants, or his spouse, shall be guilty of
parricide and shall be punished by the penalty of reclusion perpetua to death.

INFANTICIDE- Infanticide is the act of deliberately causing the death of a very young child (under 1 year
old). In the past, and in many societies, it was a widespread practice, permitted by different cultures
around the world. Nowadays, it is considered to be an unethical crime; however, it is still performed.

Article 255, in relation to Article 248 of the RPC,105 provides that the
offense of infanticide is punishable by reclusion perpetua in its maximum
period to death
“Art. 255. Infanticide. - The penalty provided for parricide in Article 246 and for murder in Article 248
shall be imposed upon any person who shall kill any child less than three days of age.

DOMESTIC VIOLENCE- RA 9262, It is a law the seeks to address the prevalence of violence against
women and their children (VAWC) by their intimate partners like their husband or ex-husband, live-in
partner or former live-in partner, boyfriend/girlfriend or ex-boyfriend/ex-girlfriend, dating partner or
former dating partner.

Offenders proven in court to be guilty of the crime shall be penalized with: imprisonment ranging from 1
month and 1 day to 20 years payment of P100,000 to P300,000 in damages mandatory psychological
counseling or psychiatric treatment.

ILLEGAL FIREARMS TRADE- 12 Years And 1 Day To 40 Years. The following are the unlawful acts punished
by reclusion temporal to reclusion perpetua, that is, from 12 years and 1 day to 40 years: Unlawful
Acquisition, or Possession of three (3) or more small arms or Class-A light weapons
CYBERCRIMES - The Philippine Congress enacted Republic Act No. 10175 or “Cybercrime Prevention Act
of 2012” which addresses crimes committed against and through computer systems on 12 September
