ABOUT JUSTICE V R KRISHNA IYER

Justice V R Krishna Iyer was an Indian judge who became a


pioneer of judicial activism. He pioneered the legal aid
movement in the country. Before that, he was a state minister
and politician. As an activist lawyer, he served jail terms for the
cause of his poor and underprivileged clients. He was seen as an
ardent human rights activist. In addition, he campaigned for
social justice and the environment . A sports enthusiast and
prolific author, he was conferred with the Padma Vibhushan in
1999. His judgements continue to be cited in the higher
judiciary.

Government Law College Thiruvananthapuram, entrenched in the


glorious legacy of more than one hundred and forty years, is one of
India’s oldest institutes imparting legal education.The college is
widely acclaimed for its international and national seminars,
symposiums and workshops organized throughout the year,
alongside the prestigious All India Moot Court Competition with
a count of 16 exhilarating editions, the Alternate Dispute
Redressal competition (ADR), and the Trial Advocacy
Competition which elicits the participation of students from
institutions across the country.
ABOUT MOOT COURT SOCIETY

The Moot Court Society has been in place for decades producing some of the
country's finest lawyers. Government law college, Thiruvananthapuram is
widely acclaimed for its All India Moot Court Competition with a count of
16 exhilarating editions and 9 stellar editions of Alternative Dispute
Redressal (ADR) Competition and Trial Advocacy Competition. We are
proud to announce the 17th edition of All India Moot Court Competition
for the Justice Krishna Iyer Ever Rolling Trophy.

About the competition

Moot court competition is one of the most exciting activity for


law students where students can sharpen their skills for their
future practice as lawyers. The purpose of the activity is to help
law students understand how real courts function, their code of
conduct and the use of formal language. Mooting is a great way
to develop one’s confidence, research, speaking and writing.
Participating in moot court is not just great for budding
advocates but also for future judges and arbitrators. Most
universities hold inter-college and intra-college moot sessions
that prepares students for their future endeavours.

Greetings from Government Law College, Thiruvananthapuram.

It is with immense pleasure that Government Law College


Thiruvananthapuram, presents the 17th All India Moot Court Competition
to be held from 2nd to 4th of February, 2023. We take this opportunity to
invite your esteemed institution to participate in the competition and
extend to us the privilege of hosting your team.

It will be our endeavour to create an atmosphere of invigorating intellectual


challenges and the opportunity to learn court craft through simulated
experiences in the competition. We look forward to a positive response.
Rules & Regulations

DATE AND VENUE

The 17th All India Moot Court Competition will be held from 2nd to 4th of
February, 2023 in the Government Law College, Thiruvananthapuram campus.

ELIGIBILITY

The Competition is open to all Law Colleges and Faculties/ Departments of Law
in India, recognized by Bar Council of India. The participation is limited to the
L.L.B students in both three year and five year schemes. Students pursuing post
graduation in law and students undergoing non-professional/ correspondence
course are not eligible to participate in the competition.
TEAM COMPOSITION
Each institution participating in the competition can send a team comprising
of a minimum of two or a maximum of three students. There can be two
speakers and one researcher designated in each team. Teams shall identify the
speakers and researcher during registration.

REGISTRATION PROCESS
1. The participating teams will have to register themselves through the link
given herewith. The team should pay a registration fee of Rs. 3500/- and
furnish the details of the same through the registration form.
2. The registrations will be allotted on a first come first serve basis. There
shall be a cap of a total of 24 teams for the competition.
3. A "team code" will be provided to each team and that code alone
shall be marked on the memorial and no other indication should be made
identifying the institution or the name of the participants.
4. The participants shall wear the badge provided by the society throughout
the duration of the competition.
COMPETITION FORMAT
1. The language of the Court shall be English.
2. The Inaugural ceremony and drawing of lots will be held on Thursday,
2nd February, 2023.
3. There will be two Preliminary rounds for argument followed by Quarter-
Final, Semi-Final and the Final round.
4. Preliminary rounds will be held on 3rd February, Friday.
Top Eight teams shall qualify for the Quarter-Finals. The Quarter-Finals will
be held on the same day after concluding the Preliminary rounds.
5. The Quarter-Finals will be a knock-out round. Qualification to the
Quarter-Finals will be based on the highest aggregate of score of the teams in
the preliminaries (inclusive of memorial marks).
6. The Semi-Finals will be a knock-out round and will be held on the
following day, 4th February.
7. The Finals will be held on the same day after the completion of the Semi
Finals i.e 4th February.
8. Each team is expected to be prepared with written memorials and oral
arguments to represent either sides of the case. The Court will follow the
procedure within accepted norms of judicial practice and in case of doubt or
dispute in the matter of procedure or facts; the decision of the presiding
members of the committee of judges in each Court shall be final.
9. The participants will have to carry with them all necessary materials
including books, reports, journals etc. True copies will be accepted. The
Library of Govt. Law College, Thiruvananthapuram can be utilized for
reference purpose only.
10. The dress code of the participants during the Court sessions is as provided
below:-
Female participants :- White saree and black blouse/ white salwar with
black over coat/ black suit;
Male participants :- White or black pants and white shirt with tie/ black
suit.
11. Each team will be allotted 35 minutes to advance their arguments
including rebuttal. The team members may divide the given time in such a
way that each speaker shall not exceed 20 minutes or subceed 10 minutes.
12. The best researcher will be selected on the basis of an
interview conducted on 3rd February by a panel of judges including eminent
lawyers and academicians.

MEMORIAL GUIDELINES
1. Each team must prepare memorandums dealing with jurisdiction, issues
involved in the problem, summary of arguments and arguments supported by
authorities, conclusion and prayer for both the Petitioner’s and Respondent’s
sides respectively. Memorandums must be in English. The body of the
memorandum shall not exceed 25 typed pages. The cover page, table of
contents, index of authorities, jurisdiction, statement of facts, annexure,
appendices and back cover are not included in the above mentioned 25 pages.
However these 25 pages include questions presented, summary of pleadings,
conclusions and foot notes. Any issue or pleading, not discussed within the
body of the Memorandum shall not be permitted to be raised in the Court.
2. Four hard copies of the memorial of the Petitioner's side and four hard
copies of the memorial of the Respondent's side shall be submitted to the
General Convenor of the moot court society via post, on or before 25th
January, 2023.
3.The teams shall submit soft copies of their written memorials by email
on or before 20th January, 2023.
4. Each day of delay shall entail a penalty of 1 mark each.
5.The identity of the institution shall not be revealed anywhere in the
memorial.

JUDGING CRITERIA

There shall be a committee of judges selected for each court from among a
panel of judges constituted for this purpose which includes eminent judges,
lawyers and academicians from all over India. The Finals will be presided
over by a full bench of Hon’ble Judges of the High Court of Kerala. Each
Court will award marks for oral arguments to each individual participant
and team. Each individual’s marks for oral arguments will be added with the
memorandum marks to make the individual’s marks out of 100. Out of 100
marks the division of marks for each individual participant is as follows:-
1. Written Memorandum -20 Marks
2. Oral Arguments - 40 Marks
The distribution of marks for oral arguments is as follows:
1. Correct articulation of facts, factual analysis and use of 5
evidence
2. Correct articulation of legal issues and analysis of issues 5
3. Knowledge of law and its interpretation 5
4. Skill of advocacy and persuasiveness 5
5. Response to questions 5
6. Use of authorities and citations 5
7. Court manners, Clarity, brevity and ingenuity 5
8. Language, style and General impression 5
Total (Out of 40 marks)
Total (Out of 40 marks) x 2 = Marks out of 80 for Oral Arguments
9. For the best researcher, the judging criteria shall be inclusive of marks
secured for memorials added to the average marks provided by the expert
panellists during researcher's interview.
10. Any dispute regarding the conduct of the competition will be referred to
an APPELATE committee consisting of the Principal/Chairperson and three
faculty members and their decision shall be final.

RESEARCHERS INTERVIEW GUIDELINES

The Researcher's interview shall be conducted on 3rd February, 2023.

In a team consisting of 3 members, the member designated as the


researcher shall take part in the interview.

In a team consisting of 2 members only, one of the speakers has to be


designated as the researcher for the purpose of the interview and the
same should be duly indicated in the registration form.
General Rules
Organisers imply the moot court society of the Government Law
College, Thiruvananthapuram.
Competition means the 17th All India Moot Court Competition, 2023
for Justice V R Krishna Iyer Ever Rolling Trophy.
Participating team means the teams which have duly completed
registration for the competition as per the rules given above.
Participating college/institution/university shall be presumed to be the
present institution of the participating team.
The rules of the Moot Court Competition shall be strictly adhered to
and any deviation therefrom would attract disqualification or other
penalties as decided by the organizers.
Decisions taken by organizers in case of any doubt, dispute,
disqualification etc. shall be final.

Each individual participant shall upload the individual registration


form attached herewith, and also present it to the Convenor, Moot
Court Society, Government Law College, Thiruvananthapuram at the
time of the competition
Miscellaneous
General Etiquette

The participants are expected to behave in a dignified manner and not


to cause any unnecessary inconvenience to the organizers. Distance is
to be maintained from the judges during the Competition and also
outside the court rooms.

The organizer’s reserve the right to take appropriate actions for any
unethical, unprofessional and immoral conduct.
INTERPRETATION OF THE RULES

The organizer’s decision as regards the interpretation of rules or any


other matter related to the competition will be final.
If there is any situation which is not contemplated in the rules, the
organizer’s decision on the same shall be final.
The organizers reserve the right to vary, alter, modify, repeal any of
the above rules if so required and as they may deem appropriate at
anytime during the competition.
Any dispute arising in the Moot court rooms during the rounds would
be at the discretion of the presiding officer of the respective court
room.
If there is any kind of conflict, the decision of the principal,
Government Law College Trivandrum will be final.
