DETROIT BOARD OF POLICE COMMISSIONERS Minutes of the Board of Police Commissioners Meeting Thursday, April 21, 2011 The regularly scheduled meeting of the Detroit Board of Police Commissioners (BOPC) was held at Detroit Police Headquarters, 1300 Beaubien, room 328-A, Detroit, Michigan, on Thursday, April 21, 2011. Commission Chair Jerome L. Warfield, Sr. in the chair, and Mr. George N. Anthony as secretary, convened the meeting at approximately 3:05 p.m. Present: Commissioners Adela Rivera, Toney Stewart and Donnell R. White The presence of all four (4) members established a quorum. Assistant Chief (AC) Chester L. Logan represented the Department. The invocation was given by Evangelist Dora Hatcher. On motion by Commissioner Rivera the BOPC approved the meeting agenda with the following addition under item 7: vote on meeting minutes for April 14, 2011. On motion by Commissioner Rivera the BOPC approved the meeting minutes for April 7, 2011 and April 14, 2011. Chairman Warfield announced that the BOPC office will be closed on Friday, April 22, 2011 because of the Good Friday holiday, and again on Monday, April 25, 2011 as a budget required furlough day. The office will reopen on Tuesday, April 26, 2011. Secretary Anthony reported on the number of citizen complaints received in and through March 2011. The total number of complaints received in March 2011 was 143 which represented a 13% decrease when compared to March 2010s figure of 165. The year to date total through the end of March 2011 was 341 which represented a 10% decrease from last years total of 381. The BOPC received the report.

The BOPC prepared resolutions for members who were retiring from the Department. Commissioner White read the members names: Sergeants Jerry Shoate and Maria CoxBorkowski, as well as Police Officer Michael Hughes. On motion by Commissioner Rivera the BOPC approved the resolutions. Chairman Warfield also recognized the retirement of Officer Myra Gracey. Chairman Warfield announced the next meeting date for the BOPC as being Thursday, April 28, 2011 at 3:00 p.m., police headquarters, 1300 Beaubien, #328-A. In addition, he announced that Chief Godbee will present the Departments 1st Quarterly Report on Wednesday, April 26th, at Charity Lutheran Church, 17220 Kelly Rd., from 6:00 p.m.8:00 p.m., and that the Detroit Police Chaplain Corps will host a Gospel Concert on Friday, April 29th, at 6:00 p.m., at Greater Mt. Zion Church, 15600 Evanston. Commissioner Rivera made a statement commending Department members for their response to a recent incident involving her aunt. The BOPC entertained oral communications from the public: Mr. R. Ector indicated that he and others recently held an open carry event and made other statement regarding openly carrying a firearm. Mr. E. Moore, liaison to Councilman Kenyatta, acknowledged the retired officers. Ms. B. Smith commented on a newspaper report that police wanted to cease testing bullets due to being overloaded with work and observed that this action could hinder investigations. She also commented on Michigan Supreme Court Justice Robert Youngs proposal to reduce the number of judges in the state. Evangelist D. Hatcher commented on the need for bigger jails; that inmates can do things in the community; and that prayer works. Ms. S. Pannell stated that she expected police to help when called and that the courts are letting criminals go. Mr. O. Collins said that he had been stopped by officers approximately 10 times over the last 3 months regarding open carry. He did not understand why he was being stopped and wanted to know the procedures for approaching citizens who openly carry. AC Logan read the Departments procedure. Ms. M. Lacy asked about Department reforms that could take an additional 2 years. She observed that the community was not receiving information except in the newspaper. AC Logan responded that the Department has made considerable progress last year and indicated that there are nuances in technology improvements. He also stated that the monitors and DOJ were excited about the Departments progress and that the goal is to be in compliance this year. The 2 years extension gives the Department a cushion for maintenance.

Mr. R. Scott commented on the consent decrees. He stated that he was disappointed in the Judge Cook and that the monitor is being paid good money and should come before the community. Mr. C. Brown addressed the issue of open carry and noted that officers can be sued for violating citizens civil rights. Mr. Brown asked that the city ordinances be amended to conform to state law. Mr. Brown was advised that the city council has the authority to change ordinances. Ms. J. Semma (7 Ds Tow) wanted to know the status of the towing permits. DC Ben Lee advised that the Zoning Department should complete their letters on Tuesday. Mr. N. Wilson complained that he was arrested for armed robbery and on a weapons charge March 10, 2011, but the armed robbery charge was dropped. He claimed that the officer lied on the witness stand and that his complaint filed with Internal Affairs was dropped. Mr. Wilson was referred to OCI representatives as well as to DC James Tolbert and Lieutenant Herbert Miles. On motion by Commissioner Rivera the meeting adjourned at approximately 4:00 p.m.

On April 14, 2011, officers of the Eastern Di strict responded to the 14000 block of Glenfield on a Person Shot. As a result of their inve stigation, a subject was arrested and charged with Assault with Intent to do Great Bodily Harm, Felon in Possession, and Felonious Assault, Felony Firearm, and Habitual 4th D egree..
Twelfth Precinct
On April 13, 2011, while on patrol in the area of Wyoming and Eaton, officers of the Twelfth Precinct investigated a vehicle for a traffic vi olation. Subsequent to their investigation, a subject was arrested and charged with Carrying a Concealed Weapon, Felon in Possession, Felony Firearm, and Habitual. The officers also confiscated a weapon.
Tenth Precinct
On April 11, 2011, officers of the Tenth Precinct responded to the 13000 block of LaSalle on a Kidnapping. Subsequent to their investigation, officers arrester a subject who was later charged with Felony in Possession of a Firearm, Fel ony Firearm 2nd Degree, and Habitual 4th Degree. A weapon was confiscated as a result of their inve stigation.
Northeastern District
On April 12, 2011, officers of the Northeastern Di strict responded to the 11000 block of Mound road on a Person Shot. Due to their quick response, a citizen in the area held the wanted subject until officers arrived. The subject was arrested and charged with Assault with Intent to Murder, Assault with Intent to Commit Great Bodily Harm, Felonious Assault, Carrying a Concealed Weapon, and Felony Firearm.

3. NEW BUSINESS RESOLUTIONS: RESOLUTION HONORING SERGEANT JERRY SHOATE WHEREAS Mr. Jerry Shoate was promoted to the Detroit Police Department on August 12, 1985 upon graduating from the Detroit Metropolitan Police Academy. He was assigned to the Sixth Precinct; and WHEREAS Police Officer Shoates assignments also included the Special Crimes Section, Narcotics Section, and the Seventh Precinct; and WHEREAS Police Officer Shoate displayed tremendous diligence and aptitude and was promoted to the rank of Investigator on October 3, 1995 and was assigned to the Narcotics Enforcement and the Eighth Precinct Investigations Operations Unit; and WHEREAS Investigator Shoate was promoted to the rank of Sergeant on March 20, 1998 and was assigned to the Eighth Precinct Investigations Operations Unit. After successfully completing Officers Candidate School, Sergeant Shoate was assigned to Records & Identification, where he remained until his retirement; and WHEREAS Sergeant Shoate was the deserving recipient of numerous awards that included one (1) Meritorious Service Award, two (2) Departmental Commendations, four (4) Departmental Citations, five (5) Perfect Attendance Awards, one (1) Super Bowl Award, one (1) Rosa Parks Funeral Award, and one (1) All Star Game Award; and WHEREAS Sergeant Shoate diligently served the Department and the citizens of Detroit with integrity, loyalty, and dedication for 25 years. He received numerous letters of commendation from citizens, superiors and other law enforcement agencies making him the consummate professional. NOW THEREFORE BE IT RESOLVED That the Detroit Board of Police Commissioners, speaking on behalf of the Detroit Police Department and the citizens of the City of Detroit recognize the lifelong commitment to Public Safety of Sergeant Jerry Shoate. His pride and dedication have been invaluable assets to the Department and merit our highest regard. We thank and congratulate you, Sergeant Jerry Shoate. HUGHES WHEREAS Mr. Michael Hughes was promoted to the Detroit Police Department on January 27, 1986 upon graduating from the Detroit Metropolitan Police Academy. He was assigned to the Tenth Precinct; and WHEREAS Police Officer Hughes worked in several units within the department which included the Tactical Services Section, Fourth Precinct, Narcotics Enforcement Section and Fleet Management Section where he served until his retirement in January 2011; and WHEREAS Police Officer Hughes was the deserving recipient of numerous awards that included one (1) Meritorious Service Award, six (6) Departmental Commendations, four (4) Departmental Citations, one (1) Perfect Attendance Award, one (1) Super Bowl Award, one (1) Rosa Parks Funeral Award, and one (1) All Star Game Award; and
