AN ORDINANCE SETTING GUIDELINES FOR HONORING DECEASED


PUBLIC ELEMENTARY AND SECONDARY TEACHERS OF CAMALIGAN,
CAMARINES SUR, AND OTHER CIVILIANS THEREOF WHO HAD RENDERED
DISTINGUISHED SERVICE BY DRAPING OVER THE CASKET WITH THE
FLAG OF THE REPUBLIC OF THE PHILIPPINES.

WHEREAS, 24-E OF Republic Act 8491 provides that the flag, may be
used to cover the casket of the honored dead of the military, veterans, National
Artists and civilians who have rendered distinguished service to the nation,

WHEREAS, Republic Act 8491 also provides that the local government
unit concerned shall be the one to determine the civilians who have rendered
distinguished service to the nation,

WHEREAS, the LGU Camaligan recognizes the great responsibilities


and performance that the teachers are doing. Barangay Kagawad EDGARDO A.
ESTRELLA of Barangay San Lucas proposed Resolution No. 51 requesting the
Sangguniang Bayan of Camaligan to enact an ordinance honoring said deceased
teachers,

WHEREAS, it is but fitting and proper for public elementary and


secondary teachers of Camaligan to be accorded the same rites as those given
to the military considering that by the nature of their profession, they had been
multi-tasked, among them as election tellers and guardians of the vote of the
people, as census enumerators to assist the government in establishing a
reliable data network, as molders of the youth and advocates of values, as
leaders assigned in hazardous places, etc.;

WHEREAS, deceased civilians who are residents of Camaligan who


had rendered distinguished service to the community such as heroic deeds,
philanthropic deeds, outstanding achievements in the fields of medicine, sports,

literature and other equally important endeavors should also be accorded with
the same honor,

. WHEREAS, the LGU of Camaligan will provide the Philippine Flag


which will be used to cover the casket of the deceased teacher and civilian who
had rendered distinguished service,

NOW THEREFORE, on motion by councilor ALFREDO A. AZUTILLO


duly seconded by Councilor Jose O. Agomaa;

BE IT ORDAINED by the Sangguniang Bayan of Camaligan that;

SECTION 1. TITLE – This Ordinance shall be known as “ An Ordinance


Honoring the deceased public elementary and secondary teachers and other
deceased civilians of Camaligan who had rendered
distinguished service to Camaligan.”

SECTION 2. DEFINITION OF TERMS = the following terms as used in this


Ordinance shall be taken to mean the following:

1. Casket – coffin.
2 .Civilians – one engaged in civic not military pursuits.
3. Deceased – death, demise.
4. Distinguished – marked, eminent, recognized, treat
with honor.
5. Drape – to cover with, or adorn with cloth.
6. Flag – shall mean the Philippine National Flag.
7. Interment – burial.
8. Military – all branches of the Armed Forces of the
Philippines including the PNP, the Bureau of Jail
Management & Penology and the Bureau of Fire
Protection,
9. Teachers – one who teaches in school.
10. Veterans – a former soldier or serviceman.
11. Wake – vigil, watch over the dead.

SECTION 3. DECEASED CIVILIANS TO BE ACCORDED WITH HONOR BY


DRAPING OVER THE CASKET WITH THE FLAG OF THE
REPUBLIC OF THE PHILIPPINES.

1. Deceased public elementary and secondary teachers of Camaligan.


2. Other deceased civilians of Camaligan who had rendered distinguished
service to the nation and who were determined by the LGU to be accorded with
honor by draping over the casket with the flag of the Republic of Philippines.

SECTION 4. PROHIBITION. The following are prohibited:

1. That the flag shall not be lowered to the grave or allowed to touch the ground,
but shall be folded solemnly and handed over to the heirs of deceased person.

2. That the flag shall not be flown half mast.

SECTION 5. IMPLEMENTING GUIDELINES – the following shall be observed:

1. The heirs of the deceased teacher/civilian shall notify the LGU Officials of the
death of the teacher/civilian.

2. The LGU shall determine whether the deceased civilian have rendered
distinguished service to the nation and is worthy of the honor to be given by
draping the casket with the flag of the Republic of the Philippines.

3. The Philippine flag being provided by the LGU of the LGU will be delivered to
the place where the remains of the deceased lie in state.

4. The flag will be draped over the casket such that the white portion/triangle
shall be at the head, the blue portion shall cover the right, and the red portion on
the left side of the casket.

5. The flag shall be draped over the casket during the last night of the wake and
before the burial.

6. The flag shall be folded by any Municipal Official or


Barangay Official present during the burial, the flag folded solemnly shall be
handed to the heirs of the deceased.

SECTION 5. REPEALING CLAUSE – any provision of ordinance, rules and


regulations and parts thereof in consistent with the provision of
this ordinance are hereby repealed, or modified accordingly.

SECTION 6. SEPARABILITY CLAUSE – Should any portion or provision of this


ordinance be declared unconstitutional or invalid, the other
parts or provisions thereof which are not affected thereby
shall continue to be in full force and effect.

SECTION 7. EFFECTIVITY – This ordinance shall take effect immediately upon


its approval.

ENACTED: October 3, 2011.
