No.: 001/000621 Detective Benjamin Handzel, Maine State Police- Major Crimes Unit- South, being first duly ‘sworn, deposes and states upon information and belief that: On or about November 24, 2022, in the Town of Poland, Androscoggin County, State of Maine, JUSTIN BUTTERFIELD (dob:08725/1988), did intentionally ot knowingly cause the death of another human being, namely GABRIEL DAMOUR (dob: 05/17/1984), or did engage in conduct that manifested a depraved indifference to the value of human life and which in fact caused the death of Gabriel Damour, all in violation of 17-A MRS. § 201(1)(A) & (B). LY: EX STATE OF MAINE ANDROSCOGGIN, SS AFFIDAVIT IN SUPPORT OF ARREST WARRANT (MR.CrimP. 4(b)) AND INITIAL DETERMINATION OF PROBABLE CAUSE (M.R.CrimP. 5(d)) To: Any Judge of the District Court or Justice of the Peace. I, Benjamin Handzel, being a duly sworn and deposed Maine State Police Detective, state the following: Tam employed as a detective with the Maine State Police and currently assigned to the Major Crimes Unit, Southern Field Division. I am a sworm law enforcement officer and a 2018 graduate of the Maine State Police Academy. I have served as primary and co-primary investigator in numerous complex death cases to included infant deaths, suicides, and homicides. The following facts and circumstances lead this affiant to believe that JUSTIN BUTTERFIELD (date of birth 08-25/1988) committed one count of the crime of Murder 17-A MRS. Sec. 201 in the Town of Poland, Maine, on or about November 24, 2022: 1 4. ‘On November 24, 2022, Androscoggin County Sheriff's Office received a 911 call from Wesley Burgess of Poland, ME. Wesley advised ASO dispatch that a Justin Butterfield told him that his brother transformed into the terminator, and he killed him. Wesley advised he went to 14 Poplar Drive and saw a male on the floor with a screwdriver in his stomach. ASO Deputy Connor Pinkham arrived on scene at 1031 hours. Dep. Pinkham is familiar with the residence and recognized a resident of 14 Poplar Drive, Justin Butterfield, standing in the doorway. Justin was ordered to come down to Dep. Pinkham and Justin was detained. Dep. Pinkham noticed body parts on the front porch. Dep. Pinkham opened the front door of Poplar Drive and saw a deceased male on the couch. Det. Connor Walton met with Wesley Burgess at his home. Wesley was the individual who called 911 and notified law enforcement that there may have been a murder. Wesley informed Det. Walton of the following: a, Wesley and his brother Mark were working on a trailer adjacent to where Justin Butterfield lives. They left to retrieve more supplies. ‘When they returned to the trailer, they noticed Justin was inside of the trailer where they were working. b. Wesley knows Justin to live in the trailer park and knows Justin to have mental health issues. ©. Justin complained that his feet and legs were hurting. 4. Justin told Wesley that he just “beat up the terminator” and that the terminator looked like his (Justin's) brother, Gabriel. e. Fearing for Gabriel's safety, Wesley asked Justin where Gabriel was. Justin told Wesley that Gabriel was safe in another galaxy. £ Justin explained that he was “fighting” the terminator for 24 hours and was kicking him. g. Justin told Wesley that the terminator “fucks people in the ear and that ‘makes them go crazy.” Justin also mentioned that the terminator ‘jerked off” in front of Justin’s daughter. 1b. Justin stated he beat the terminator up with a shelf. Wesley said Justin told him that the terminator put his hands on Justin's throat, which caused Justin to “lose it.” Justin said that's when he cut off the terminator’s penis and ears. i, Justin brought Wesley over to his house, located at 14 Poplar Drive. Wesley noticed body parts on the front porch and became scared. Justin entered the residence and Wesley stood in the doorway. ‘Wesley observed a body with its face covered. k. Wesley assumed this body to be that of Gabriel, Justin’s brother. Wesley said he saw what appeared to be a screwdriver sticking out of the body. 1 Wesley observed Justin pick up a black BB gun rifle and begin hitting the body with it, and then poking the body. m. Wesley immediately left and called 911. 1, Justin told Wesley the terminator was taking a “dirt nap” and he was waiting for the terminator to wake up for round 2. ©. Justin told Wesley that he was the first person to have killed a terminator. Wesley was disturbed that Justin was laughing about killing someone and seemed so proud of it. p. Wesley showed Det. Walton the text messages from Justin, who texted him yesterday (11/23/22). The text messages were incomprehensible, and I was unable to decipher anything Justin was trying to say. q. Wesley stated he observed a note near the front porch that Justin wrote to the terminator for when he wakes up. 6. Maine State Police Evidence Response Technicians entered the residence under the authority of the Maine Medical Examiner’s Office. They observed the following: a. The genitals of the body appear to have been cut off. b. There are numerous objects impaled into the body, including hypodermic needles, a caulk gun, a baseball bat, and a tire iron. c. There are numerous hypodermic needles stuffed into the mouth, eyes, and ears of the body. 4. There is a severed penis and severed ear on the front porch railing. ¢. There are numerous tools, including pliers and knives with red/brown stains, hair, and what appears to be flesh on them. 7. Maine State Police Detective Corporal Reid Bond arrived at the Androscoggin County Sheriff's Office and entered an interview room where Maine State Police Detective Corporal Mike Chavez had begun talking with Justin Butterfield. Justin stated that he had terminated the terminator. Justin stated that the terminator was made to look like someone close to him but would not specifically say who the terminator was made to represent. Justin stated that the terminator had some tattoos similar to those of his brother but there also was a different tattoo, so he knows it was not his brother. Justin stated that he fought the terminator for a lengthy period of time and at times the terminator was coming at him with a knife. Justin stated that at one point the terminator ran to a different room in the house and was repeatedly yelling for help. Justin stated that he believed he was able to destroy the terminator by striking it in the head. Justin stated that he beat the legs of the terminator with the handle of a car floor jack as hard as he could, and he knows the terminator was not human because he didn’t break any bones while doing this. Justin expressed being angry at the terminator because it was talking to him and making reference to putting him in a mental hospital. Justin stated that he believed the terminator was created by the government. 8. Justin told Detectives that once the terminator was no longer alive, he cut of the penis of the terminator with a pair of hand-held grass cutters. Justin stated that he cut open the stomach of the terminator and did not believe there were real human intestines inside its stomach. Justin stated that he cut off the ear of the terminator because he didn’t want him listening, Justin stated that he also bumed the eyes of the terminator because he didn’t want him looking at him. Justin stated that he stuck hypodermic needles in the body of the terminator. Justin stated that he picked up the body of the terminator from the floor and placed it on the couch inside his home. Justin stated that he has picked up his brother in the past and the terminator was much heavier than his brother. 9. Lobserved a photograph of the tattoo of the deceased male on the couch. There was a tattoo of on the neck with the name “Justin.” I observed a booking photo of GABRIEL DAMOUR (DOB 05/17/84) with this tattoo. 10. On 11/25/22, an autopsy was conducted on Gabriel Damour by the Maine Medical Examiner's Office. Dr. Funte determined the cause of death to be sharp force trauma, blunt force trauma, and strangulation. Dr. Funte ruled the manner of death a homicide. In light of all the above stated facts, your affiant has probable cause to believe that Justin Butterfield has committed one count of the crime of Murder in violation of 17-A M.R.S. Sec 201. WHEREFORE, your affiant prays that a warrant of arrest issue for JUSTIN BUTTERFIELD (DOB 08/25/1988) for one count of Murder, 17 M.R-S. Section 201(1)(A) and that the defendant be held without bail until his first court appearance in Maine, 1, Benjamin Handzel, depose and swear, upon information and belief, that all of the information contained within this Probable Cause Affidavit is both truthful and accurate to the best of my knowledge.
