Problems encountered by the Philippine Correctional System

○ Food - yung budget na nakalaan for food is hindi nadadagdagan kahit na parami nang parami
yung inmates. So eventually, need na ma-compromise yung nutritional value nung food.

○ Water - like sa food, most of the detention facilities may problem din sa water. Kulang yung
supply ng tubig. To the point na need pa nila magpabili or magpadala sa family nila para
magka-supply ng water to drink.

○ Delay in legal and court processes - Another problem is yung delay sa legal and court
processes. Imbis na mabilis lang mahatulan and makalaya yung mga taong nahatulan na not
guilty, tumatagal sila sa detention, which also nakakadagdag sa overcrowding problems sa mga
detention centers

○ Overcrowding - one of the most common problems sa PH is yung overcrowding. Maliit yung
spaces and kulang sa facilities. One example ay yung mga bunk beds, there are some na
dalawang tao sa isang bunk bed space. So sa isang room, hindi enough yung space for all of
them
○ Discrimination - kahit sa loob ng preso, di pa rin maiiwasan ang discrimination. Common
groups na victim of discrimination ay PWDs, mga matatanda, at mga member of LGBTQ+. Yung
iba naman, naddiscriminate dahil sa color (race), language, religion, and societal status.

Most common issues affecting older persons in jails:

● Discrimination inside the jail/detention cell because of their weak body


○ yung iba tinatawag silang masasakit na salita like inutil, matanda, gurang, etc.
● Inadequate access to the basic necessities inside the detention cell because of age
○ Palagi silang hindi priority and hindi nabibigyan ng sapat na needs nila
● Abuse, violence, and neglect are experienced
○ May mga iba naman na sinasaktan pa sila dahil hindi naman sila makakaganti dahil nga
mahihina na sila.
● Health and long-term care are often not prioritized by health service providers.
○ Since mga preso sila and matatanda na, hindi na sila priority ng health service
providers.

➢ Pregnant women - another problem is yung mga pregnant na PDL. Most of them, hindi
nakaka-receive ng check up na needed nila monthly. Prenatal care and postnatal care ay hindi
naibibigay. Then after that, after giving birth, ilalayo agad sa kanila yung baby at dadalhin sa
DSWD, since yung jail is not a good place to raise a child.
Congestion
● One of the biggest problems in detention facilities is this.
● 397% National congestion rate as of June 2022, bumaba na dahil sa efforts ng BJMP na
nag-ffocus sa decongestion ng mga national facility sa PH
● 438% in 2019 and 403$ in 2020
● Sa 470 detention facilities sa PH, 336 ay overcrowded.
● Ilang factors na nakapagpa-taas sa congestion rate ay ang delay in legal and court
processes and kulang sa infrastructure facilities

Proposed Solutions

● Dapat gawan ng paraan na mapabilis ang pag-process sa mga kaso, priority


ang mga vulnerable groups like matatanda.
● Consistently irereview mga cases to determine if meron na bang eligible na
makalaya due to Good Conduct Time Allowance
● Dapat nagtutulungan ang national and local government na mai-provide ang
basic needs ng mga detainees like food, water, sanitation, and health needs.
● It is important that nabibigyan parin ng respect ang rights and dignity ng mga
PDL
Proposed Solutions
● On Living Space and Issues of Congestion - malaki ang mahehelp ng mga Local
Government Units (LGUs) sa BJMP
and BoC sa gantong issue:
○ LGUs must financially support
yung mga detention facilities
ng BJMP and BoC sa
pagpapalawak and
pagdadagdag ng facilities
para makasabay sa pagdami
ng detainees
○ LGUs must also give financial
support or mag-provide ng
budget for food/medical needs
doon sa mga detention
facilities
○ LGUs also need to monitor and ensure na maayos and makatao ang treatment
sa mga detainees. Mas mababantayan nila ang mga lock-up cells.
● Malaki ang role ng LGUs sa pag-address ng problem sa Congestion on
Detention Facilities

Proposed Solutions
● On the Situation of Vulnerable
Populations
○ BJMP should also give
consideration sa mga vulnerable
groups like
● elderly women,
● women with disability in
detention,
● pregnant/lactating women in
detention,
● LBT women (Lesbian,
Bisexual, and Transgender)

○ Kailangan magpatupad ng policies na aligned sa needs nila like


■ psychosocial and medical services (all groups mentioned)
■ maintenance medicine or therapy (elderly, pregnant, women w/disability)
■ access to and contact with children and family (elderly and pregnant women)
■ ensuring access to needed hygiene and menstrual kits (all groups mentioned)
Proposed Solutions

● Food
○ Para masigurado na adequate ang
food na naibibigay sa bawat detainee,
with nutritional value na need ng
isang tao, BJMP should ensure na
priority ang food in terms of budget
and implementation.
○ Also, groups like pregnant or lactating
women should also be considered
dahil they more nutritional content on
their food since they also provide
food for their babies.

● On Water and Sanitation


○ Basically, it is important na may access
ang bawat detainee sa clean drinking
water anytime na kailangan niyang
uminom.
○ Kailangan din na ang water on
bathrooms is clean and always available
para sa health and cleanliness ng lahat.
○ LGUs may help sa pag-iimprove ng
detention facilities by providing safe and
clean water

● On Health
○ Health-care services should also be
provided consistently or regularly and
aligned sa medical needs ng bawat
detainee.
○ Pwedeng makipag-tulungan ang DOH
and LGUs para ma-ensure na hindi
napapabayaan ang mga tao sa
detention facilities in terms of their
health-care needs.
○ Syempre, special attention or extra care
should be provided sa mga physically vulnerable groups gaya ng:
■ elderly men and women
■ people with disabilities
■ pregnant and lactating women
