    OF NON-FORUM SHOPPING

    We, GRACE ASUNCION M. CASTAÑARES, Filipino, of legal


    age, married; JOSEPHINE M. CASTAÑARES, Filipino, of legal age,
    married; MANUEL M. CASTAÑARES, JR., Filipino, of legal age,
    married and JOSE M. CASTAÑARES Filipino, of legal age, married, all
    are residents of Barangay Linao, Minglanilla, Cebu, after having been sworn
    to in accordance with law, hereby depose and say:

    1. That we are the complainant in the above-entitled case and we have


    caused the preparation of the foregoing complaint;

    2. That we have read and understood all the contents thereof and the
    same are true and correct to the best of our knowledge and belief based on
    authentic records;

    3. That the pleading is not filed to harass, cause unnecessary delay or


    needlessly increase the cause of litigation;

    4. That the factual allegations therein have evidentiary support or if


    specifically so identified, will likewise have evidentiary support after a reasonable
    opportunity of discovery;

    5. That based on our personal knowledge, we have not commenced any


    other action or proceeding involving the same subject matter raised in this case in
    the Supreme Court, Court of Appeals, or any Division thereof, or any other
    tribunal or agency; and to the best of our knowledge, no such action is pending
    with the Supreme Court, Court of Appeals or any Division thereof, or any other
    tribunal or agency; should we thereafter learn that a similar action of proceeding
    has been filed or is pending before the Supreme Court, Court of Appeals, or any
    Division thereof, or any other tribunal or agency, we undertake to promptly inform
    this Honorable Court or any of the aforesaid courts, such other tribunal or agency
    of this fact within five (5) days therefrom.
