    BEFORE THE HON’BLE 4TH JOINT CIVIL JUDGE, SENIOR DIVISION, NAGPUR

    SPECIAL DARKHAST NO. 148 OF 2016

    APPLICANT : Smt. Aloka Jaigopal Biswas

    Versus

    Smt. Daliya Arvind Biswas


    NON-APPLICANT :

    PURSIS

    The Jawarharlal Nehru Medical College, Wardha most humbly submits as

    under:

    1) That, this Hon’ble Court had passed order dated 10.04.2017, thereby

    directing the undersigned to deduct 1/3 salary of the Non-Applicant / Smt.

    Daliya Biswas and deposit the same before this Hon’ble Court in the present

    proceeding.

    2) That, in pursuance of the aforesaid order, the undersigned had

    deducted 1/3 salary of the Non-Applicant / Smt. Daliya Biswas for the month

    of August 2017 to December 2017.

    3) Thereafter, it was informed by the Non-Applicant / Smt. Daliya Biswas

    had informed the undersigned that she had preferred an appeal before the

    Hon’ble District Judge and that the Hon’ble District Judge pleased to pass an

    order thereby granting stay to the aforesaid order passed by this Hon’ble
    Court. In view of the stay granted by the Hon’ble District Judge, further

    deductions of the salary of Non-Applicant / Smt. Daliya Biswas was stopped.

    4) That, it has been recently learned by the undersigned, after receipt of

    the notice dated 26.08.2019, issued by the Counsel for the applicant, that

    the Hon’ble High Court has been pleased to quash and set aside the order

    dated _________ passed by the Hon’ble District Judge. By the said notice we

    are further called upon to deduct the 1/3 salary of Non-Applicant / Smt.

    Daliya Biswas and deposit the same before this Hon’ble Court.

    5) That, in compliance of the order dated 10.04.2017, the undersigned is

    depositing an amount of Rs.1,50,990 (Rupees One lack, Fifty Thousand,Nine

    Hundred & Ninety only) vide cheque bearing No.__________ dated

    ___________, drawn on the Panjab National bank i.e. the 1/3 salary of Non-

    Applicant / Smt. Daliya Biswas for the month of September 2019 & October

    2019.

    Hence this pursis.
