PREAMBLE

we the entire members of the National Association of Kwara State Students (NAKSS) having

firmly and solemnly resolved to live in harmony and unity under a common entity. And to

provide a constitution which shall be a frame of reference in the conduct of the affairs of the

entity, promotion of the welfare of the members and the association in a conducive atmosphere

for the realization of aims and objectives, we do hereby make and give to ourselves this

constitution.

ARTICLE ONE

GENERAL PARTICULARS OF THE ASSOCIATION

SECTION ONE:

NAME: The association shall be known and be addressed as The National Association of Kwara

State Students (NAKSS) Fudma Chapter

SECTION TWO:

MOTTO: The motto of the association shall be Unity and Strength for Nationalism.

SECTION THREE:

LOGO: The logo of the association shall be the map of Kwara State carrying red touch light, a

pen and graduation cap.

SECTION FOUR:

ORGANS OF THE ASSOCIATION: The organs of the association shall be General Congress

and Executive Council.

SECTION FIVE:

CITATION

This constitution shall be cited and referred to as the Constitution of National Association of

Kwara State Students (NAKSS) Fudma chapter as established in 2019.

ARTICLE TWO

SUPREMACY AND LIMITATIONS OF THE CONSTITUTION

SECTION ONE:

I. The provision of NAKSS constitution is supreme over all members of National

Association of Kwara State Students.

 II. If the provision of this law (NAKSS) is inconsistent with the provision of the school

constitution (FUDUMA Constitution), the constitution of the school is supreme and

shall prevail, while this law shall, to the extent of its inconsistency be void.

III. The association shall not be governed nor shall any person or group of people take

control of the association or any part thereof except in accordance with the provision

of this constitution.

ARTICLE THREE

AIM AND OBJECTIVES

SECTION ONE

The aim of the association shall at all times and in all spheres conform with the fundamental

objectives and directives principles of NAKSS policy as enshrined in the constitution of the

Federal Republic of Nigeria and accordingly the association shall pursue the political,

economical, social and educational interest of the members.

SECTION TWO

the objectives of the association shall be:

i. To promote peaceful coexistence between Kwara state students and other students of

the university in other to promote cooperation and understanding among all students of

FUDMA.

ii. To promote and encourage close relationship between local and state government

authorities and various chapter of National Association of Kwara State Students

(NAKSS) nationwide.

 iii. To foster mutual respect and understanding among indigenes of Kwara State on one

hand and various chapters of the association on the other hand.

iv. To bridge the wide communication gaps between state indigenous students and Kwara

State Government.

v. To initiate and execute programme(s) and activities designed to raise fund for the

benefit of the members of the association.

vi. To organize programme, symposia, debates, quiz, etc. for the educational

enlightenment of its members.

vii. To promote health awareness, environmental sanitation and socio-cultural

development of Kwara State.

viii. To carry out other activities that may be conducive and not inconsistent with the

objectives of the constitution.

ix. To keep an up-to-date database of Kwara State students and make such available to

appropriate bodies for assistance, scholarship, and other forms of empowerment.

ix. To undertake other activities which in the opinion of the association are ancillary

incidental or conducive to the promotion of the aforementioned aims and objectives.

ARTICLE FOUR

ORGANS OF AUTHORITY

SECTION ONE:

i. there shall be the General Congress, which shall be the supreme authority body and all

registered members of the association are members of this body.

ii. There shall be an executive council, which shall comprise of all elected executive members of

the association.

ARTICLE FIVE

MEMBERSHIP AND FELLOWSHIP

SECTION ONE:

i. Membership of the association shall be open to every students of Kwara State indigene

irrespective of his/her religion, ethnic group, place of birth, sex, social education, political

believes, or economic status.

a. A person must be an undergraduate student of this school.

b. A member shall accept the aims, objectives, principles and fundamental rules, policies and

programs of the association.

c. A person shall be a financial member of the association.

d. Each member shall pay the prescribed annual due.

SECTION TWO:

Fellowship: shall be an ex-official of the association who distinguishes himself/herself in the

course of the association.

SECTION THREE:

TERMINATION OF MEMBERSHIP

i. Membership shall lapse on ceasing to be registered members of the association either upon

graduation or expulsion from an institution.

ii. Any member that contravenes the provision of the constitution and found guilty of gross

misconduct shall be subjected to expulsion.

ARTICLE SIX:

RIGHTS AND DUTIES OF MEMBERS

i. Every members must assist in protecting, propagating the principles or policies and programs

of the association.

ii. Every member must protect and safeguard the interest of the association.

iii. Every member shall have the right to be voted for except where exempted by other provision

of this constitution.

iv. Every member shall have access to helpful information and details about the association.

v. Every member shall have the right to present his/her suggestion(s) and grievance and shall be

processed.

vi. All members shall have the privilege to make use of facilities provided by the association

with permission from the appropriate authorities.

vii. All members of the association shall have the right to attend all its activities except where

restricted by other provision of this constitution.

viii. Every member must uphold this constitution.

ix. New members shall have the right to obtain copy of the association constitution upon

registration.

x. Members shall have equal right to the association while their duties may vary.

xi. Any member using associations property shall pay any prescribed amount into the association

purse for maintenance in case of damages as may be agreed upon by 2/3 executive council.

ARTICLE SEVEN

GUARDIANS

SECTION ONE

i. Grand patron shall be the highest ranked official in the school who is an indigene of Kwara

State.

ii. The composition of patrons and patronize shall be four outstanding personality, who are staff

and indigenes of Kwara State.

iii. Patrons and patronize has no executive power and their tenure in office is one year re-appoint

able.

iv. The association shall enjoy the influential and financial support of the patrons and patronize.

v. The removal of I, II and III above shall be subjected to the ratification of executive council

even before the tenure elapse.

SECTION TWO:

i. The association shall have legal adviser whose chamber base in Kwara State or a Kwaran,

whose practices outside the shore of the state.

ii. The Commissioner of Women Affairs shall be the association’s social adviser or as may be

appointed.

iii. The adviser(s) who will among other things:

a. Liaise with the association.

b. Oversee the activities of the association.

c. Assist the association in other areas where it is deemed necessary.

d. The patron and patronize shall be entitled to certificate of participation after their tenure.

SECTION THREE

i. The association shall through the director of finance meet always with the patrons, patronize,

adviser and fellows for the purpose of seeking assistance but with concept of at least 2/3 majority

of the executive council made aware of such development.

ii. Records of all visitations made to solicit for assistance must be kept in the format below and

made accessible to the members of the association.

ARTICLE EIGHT

CONGRESS

FUNCTIONS

i. Shall deliberate on all matters brought to its attention either by the executive, senate and

committee set up with the reviewing of the constitution.

ii. In the event of debate, member(s) shall seek and obtain the permission of the presiding officer

by raising up his/her hand.

iii. Shall approve all decisions of executive, senate and judicial council brought before it.

iv. In the event of vote to take a decision, the discretion of the presiding officer shall be taken, on

either by raising up his/her hands, voice cote or secret open ballot depending on sensitivity of the

issue at stake.

v. The congress shall be bounded strongly by the code of conduct outlined in the standing order

of a senate council.

SECTION TWO

POWERS

i. Shall be the supreme and highest arm of authority of the association.

ii. Shall have the power to question any elected, selected or appointed officials of the association

on any issue concerning the association affairs.

iii. Shall have the power to dissolve any of the executive council, senate council, judicial council

and any committee if found guilty of collective responsibilities in either misappropriation, bias,

favoritism or any other agreed serious offence.

iv. The power of dissolution is subject to 2/3 majority of the congress and such congress must

draw member from at least 2/3 institution with registered structure with Management and

National Headquarters.

v. The congress enjoy the power to suspend any part of the constitution which may cause

hindrance to the progress of the association with at least 2/3 majority of the congress in support

of such motion.

vi. Shall have the only power to impeach any member of the Association.

ARTICLE NINE

THE GENERAL EXECUTIVE COUNCIL

OFFICERS

There shall be the following officers for the administration of the association affairs:

- The president

- Vice President

- General Secretary/Director General

- Assistant General Secretary

- Financial Secretary/Director of Finance

- Treasurer

- Social Director

- Social Directress

- Director of Welfare

- Director of Public Relation I

- Auditor General

SECTION TWO

FUNCTION

i. The council shall direct the affairs of the association and carry out activities delegated by the

congress and approved by the senate council.

ii. The council shall present annual budget to the senate council through the office of president,

secretary general and financial secretary which shall be in conformity to (Article Nine, Section

Three, Sub-Section of this Constitution).

iii. Perform other function(s) as may be conferred on them by other provision of this constitution.

iv. The president and secretary general on behalf of the council shall duly sign other

correspondence and presentation on the legislative council.

SECTION THREE

DUTIES OF OFFICES

1. THE PRESIDENT

i. Shall be the head of the executive council

ii. Shall be the Chief Spokesman of the association.

iii. Shall be in consultation with and through the General Secretary Summon all the executive

and conventional meetings of the association except otherwise stated in this constitution.

iv. Shall preside over the executive and conventional meetings.

v. Shall be the principal signatory to the association bank account.

vi. Shall supervise and co-ordinate all aspect of the associations activities.

vii. Shall have casting vote at both executive and conventions meeting in the event of tie in vote.

viii. Shall sign all the minutes of the meetings after adoption.

ix. Shall deliver a written presidential stewardship report at every convention.

x. Shall perform such other function(s) as may be conferred to him/her by other provision of this

constitution.

xi. Shall present the annual budget of the association to the executive council at the inaugural

sitting.

xii. Shall be contested for by student schooling on the campus.

xiii. Shall be number one citizen of the association.

xiv. Shall not leave the campus for (4) four consecutive weeks.

xv. Shall have not more than five (5) appointees with the approval of the executive Council

xvi. Shall respect all the resolution of the executive council.

2. VICE PRESIDENT (ADMINISTRATION)

i. Shall act for the president in his/her absence.

ii. Shall be the second citizen of the association

iii. Shall be charged with the responsibility of keeping up-to-date database of the association

members and be responsible for the collation.

iv. Shall perform other functions as may be conferred on him/her by other section(s) of this

constitution.

v. Shall be the assistance to every office especially where his/her attention is called.

vi. Shall respect all the resolution of the executive council.

3. GENERAL SECRETARY/DIRECTOR GENERAL

i. Shall be responsible for the general secretarial duties of the association.

ii. Shall after consultation with the approval of the president convene either executive or

conventional meeting(s) as the case may be.

iii. Shall in conjunction with the president prepare the agenda for the executive and congress

meeting(s).

iv. Shall record and keep minutes of both executive and congress meeting(s).

v. Shall handle all the association’s correspondence both internal and external.

vi. Shall preside over the executive or congress meetings in the absence of both president and the

vice presidents.

vii. Shall represent the association with any other official in any discussion and deliberation

involving the association with order of the president.

viii. Shall be in custody of all association stamp and seal.

xi. Shall perform other functions as may be conferred on him/her by other provisions of this

constitution.

x. Shall respect and distribute the resolution of the executive council.

4. ASSISTANCE GENERAL SECRETARY

i. Shall assist the General Secretary in the performance of his/her duties.

ii. Shall be empowered to act and perform all the duty with the rights and powers of the General

Secretary in the latter’s absence.

iii. Shall work in hand in hand with Vice President (Administration) in collating the database of

all the NAKSSITES.

iv. Shall obey the resolution of the executive Council.

5. FINANCIAL SECRETARY (DIRECTOR OF FINANCE)

i. Shall collect all money due to the association

ii. Shall issue receipts for money so collected.

iii. Shall keep proper and accurate accounts of the association.

iv. Shall be one of the signatories to the association’s bank account.

v. Shall handover all money received by him/her to the treasurer not later than 24hours or deposit

same into association account not later than 48hours in the absence of the treasurer.

vi. Shall counter sign any withdrawal of fund by the treasurer.

vii. Shall present on quarterly basis, the association’s account to the executive Council.

viii. Shall evaluate all projects and/or activities to be undertaken by the association and explore

avenues of cutting down cost while maintaining the quality of such project or activity.

ix. Shall make all financial documents available to the audit committee when requested.

x. Shall give a financial statement at all conventional meeting(s).

xi. Shall present a written report at the expiration of his/her tenure of office to the congress.

xii. Shall represent the association in all financial matters in relation to other association, clubs,

societies, etc.

xiii. Shall perform other functions as may be conferred on him/her by other provision(s) of this

constitution.

xiv. Shall be held responsible at the first instance for any misappropriation and mismanagement

of the association fund(s).

xv. Shall make available copies of the proposed budget for the association.

xvi. Shall obey the resolution of the Senate Council.

6. TREASURER

i. Shall keep the association’s bank pass-book and be responsible for the safekeeping of all

money belonging to the association.

ii. Shall collect any money received by the Financial Secretary/Director of Finance and keep

such for not more than 48hours before depositing such into the association’s bank account.

iii. Shall issue receipts to the Director of Finance for all money received.

iv. Shall be one of the signatories to the association’s bank account.

v. Shall keep a proper account of all income and expenditure of the association.

vi. Shall keep an impress account of not more than Five Thousand Naira (N5,000) or as may be

approved by the executive Council.

vii. Shall not release any money in his/her care except on the presentation of a written request

signed by the president and approved by the Director of Finance.

viii. Shall report any defaulter to the executive Council for the appropriate action(s).

ix. Further to the proceeding sub-section (viii) where the Director of Finance is absent, he/she

shall release such money on the presentation of a written approval by the president and acts on

behalf of the Director of Finance.

x. Shall submit on request in written form the association’s bank account books and documents

for auditing.

xi. Shall perform other functions as may be conferred on him/her by other provision(s) of this

constitution.

xii. Shall obey the resolution of the Senate Council.

7. PRO I AND II

DIRECTOR OF PUBLIC RELATION I AND II

i. They shall in consultation with the president, prepare and issue release on the association’s

activities.

ii. They shall publicize all the activities of the association prior to and after the occasion(s) in the

Newspaper, radio, TV and other mass media.

iii. They shall make when necessary, personal contacts with other associations on the association

behalf.

iv. They shall make necessary releases available for the presidents of the affiliated chapters.

v. They shall in consultation with the executive, be responsible for the internal and external

publication of the activities of the association.

vi. They shall be the image makers of the association.

vii. They shall prepare press releases on the association’s activities and send same subject to the

approval of the executive council to the press.

viii. Shall be in charge of maintenance, uploading and updating of association website.

ix. They shall perform such other duties as may be required of them by any other provision(s) of

this constitution.

x. They shall obey the resolutions of the executive Council.

8. SOCIAL DIRECTOR AND SOCIAL DIRECTRESS

i. shall be responsible for the association’s social activities arrangement.

ii. Shall forward to the office of Director of Finance any precede from such activities i.e. social

activities and obtain receipt(s) for it bearing the signatory of president.

iii. Shall furnish the Executive Council, the Senate Council and the Congress on social

expenditures of the association for approval through the Director of Finance.

iv. Shall prepare a detailed income and the expenditure account on social activities embarked

upon by the association.

v. Shall perform other duties as may be delegated to them by any other provisions of this

constitution.

vi. Shall obey the resolution of the executive council.

vii. The office of Social Directress shall be contested for by female.

9. DIRECTOR OF WELFARE

i. Shall with the approval of the president be responsible for the maintenance of all social and

welfare properties of the association e.g. vehicle, chairs, public address system, etc. in the

association secretariat.

ii. Shall furnish the Executive Council, Legislative Council and Congress on the welfare

expenditure of the association for approval through the Director of Finance.

iii. Shall perform such other duties as may be delegated to him/her by other provision(s) of this

constitution.

iv. Shall be the custodian of any of the association properties subject to the approval of the

president

v. Shall obey the resolution of the executive Council.

10. SPORT DIRECTOR

i. Shall be the chairman of the Sport Committee.

ii. Shall be responsible for organizing of Sport Activities for the association from time to time.

iii. Shall be entrusted with the safe-keeping of association’s sport equipment.

iv. Shall be responsible for the welfare of the association sport men and women.

v. Shall represent association in the meeting related to sport activities called by other bodies

which association have link with.

vi. Shall perform other functions as may be conferred on him/her by other provisions of this

constitution.

vii. Shall obey the resolution of the executive Council.

11. AUDITOR

i. Shall have adequate knowledge of the association account.

ii. Shall be empowered to audit the account of the association.

iii. Shall submit his/her findings to the Senate Council on quarterly basis.

iv. Shall submit all relevant report to any external audit committee or auditor set up by the Senate

Council.

v. Shall keep watch of other offices to ensure full performance and proper appropriation of funds

by elected or appointed officers.

vi. Shall obey the resolution of the executive Council.

SECTION FOUR

POWER AND CONDUCT OF EXECUTIVE COUNCIL

i. The president or any other person so appointed shall present the council’s plan and decisions to

the senate council for notification, ratification and approval. Any approved or ratified decision(s)

shall be constitutionally binding on every member except the two-third (2/3) majority of the

congress revoke the executive approval for such ratification.

ii. Without prejudice to the provision of Section two and three of this article, with regards to the

executive council, the doctrine of collective responsibility shall apply in/on all actions or

decisions of the council.

iii. They shall be entitled to monthly stipends and sitting allowance as they case maybe

depending on the financial capacity of the association.

ARTICLE TEN

THE LEGISLATIVE ASSEMBLY

COMPOSITION

i. comprises of a member each from the 16 local government of Kwara state.

SECTION TWO

PRINCIPAL OFFICERS OF THE LEGISLATIVE ARM

The legislative arm shall have the following officers.

i. Speaker

ii. Deputy Speaker

iii. The Clerk

iv. The Chief whip

SECTION THREE

DUTIES OF THE LEGISLATIVE ASSEMBLY OFFICERS

1. THE SPEAKER

i. Shall be elected from among the legislative members but shall have the record of

at least three legislative sitting as a returning member.

ii. Shall preside over legislative Council meetings.

iii. Shall through the clerk summon meetings of legislative Council and extra-ordinary

meetings of assembly

iv. Shall interpret the constitution and such interpretation shall be reversible by the

2/3 (two third) majority of the member present.

2. THE DEPUTY SENATE SPEAKER

i. Shall deputize for the Speaker at the Council Meeting(s) and other

functions in the absence of the Senate President.

ii. Shall be elected from among the congress members but shall have the record of

at least three legislative sittings as a returning member

iii. Shall perform other functions as he/she may be directed by the Speaker in accordance with

the provision(s) of this constitution.

iv. Shall be Chairman Constitution review committee.

3. THE CLERK

i. Shall be elected among the legislative members.

ii. Shall take records of legislative Council meeting(s) and extra-ordinary meeting(s)

of the council.

iii. Shall in consultation with the speaker summon meeting(s) of the

senate council and extra-ordinary meeting(s) of the council.

iv. Shall make available and read minutes of the last meeting.

4. THE CHIEF WHIP

i. Shall be elected from the legislative members.

ii. Shall maintain discipline during the legislative council session.

iii. Shall maintain order of the Legislative Council session.

iv. Shall take attendance during the Legislative Council session.

v. Shall recommend for dismissal any member who absent himself/herself from

(3) consecutive meetings of the council without the permission of the council.

vi. Shall not vote during an election but be the electoral officer of the council.

vii. Shall serve as sergeant at arm.

viii. Shall be in possession of the maze.

ix. Shall ensure that all legislators put on their Identity Card.

x. Shall be the Chairman Disciplinary Committee.

SECTION FOUR

POWERS AND FUNCTIONS OF SENATE COUNCIL

i. To serve as a legislative body

ii. There shall be no legislative sitting in the absence of maze.

iii. To give approval to the executive council before any proposed expenditure

exceeding Hundred Thousand Naira (N100, 000) may be made out of the

association’s fund.

iv. shall be entitled to sitting allowance at every legislative sitting to legislators.

v. To serve as a balancing tool between the executive and the congress.

vi. To conduct bye election for the executive council.

vii. To give all major policy decisions of the Executive Council which may include

among others decisions that may affect the existence and/or the image of the

association in the form of signing of agreement or congress with bodies, raising

or lowering or membership dues, etc.

viii. Shall monitor the Executive Council in the implementation of its programme

through the Budget, Monitoring and Implementation Committee.

ix. To give legislative backing(s) to the committees established by the Executive

Council for any task.

x. Shall have the power to set-up any standing or ad-hoc committee(s) as may deem fit,

subject to the provision of the constitution.

xi. This Legislative Council shall have the power to suspend, remove or dissolve member(s)

of such committee(s).

xii. Shall receive Three (3) copies of the budget proposal at least Two (2) weeks before

presentation to the session.

xiii. Shall have the power to suspend and remove any member of any committee, if

found wanting; and shall also have the power to suspend any erring member of the

executive.

xiv. Shall appoint the audit committee.

xv. Other principal officers of the Legislative Council shall not enjoy any power of voting in any

sitting except for the Speaker in the case of tie in vote.

xvi. Shall have the power to suspend any officer of the Association.

xvii. The suspension above should be spell out in terms of Days.

ARTICLE ELEVEN

PROCESS OF TRANSITION

SECTION ONE

The following guide shall be followed in the process of transition of power within the

association:

i. At about thirty days (30) the last congress to be held, the incumbent executive shall nominate

at least 3 representative from each of three senatorial districts into the electoral committee and

submit such to the General Secretary for onward transmission to the Senate Council for scrutiny

and inauguration.

ii. The body set up by virtue of Sub-Section (1) above shall have the power and responsibilities

of organizing a free and fair election within the Executive Council.

iii. The setting up of the Electoral Committee shall not mean the dissolution of the incumbent

Executive Council.

iv. The electoral committee shall make arrangements for the swearing of the new officers

immediately after the election subject to the notification of the general member.

v. The electoral committee shall not be influenced in its action by anybody or body of persons in

anyway.

vi. The electoral committee will conduct bye-election subject to the recommendation of the

executive Council.

SECTION TWO

ELECTION

i. Election shall be held at the last convention.

ii. Any officer(s) removed shall not be eligible to contest any election to any office.

iii. Any member shall not be eligible to contest for more than two (2) times and not for the same

office provided it is not in contrary to Article Five of this constitution and satisfied other

requirement of electoral guidelines.

iv. Election shall be conducted by Open Secret Ballot System.

v. The candidate who share the highest votes cast would be returned as elected.

vi. A lone contestant must secure (2/3) of the total votes cast otherwise there must be another

election into that office.

vii. In the event of having two or more candidates scoring the same and the highest votes, the

election to that office must be declared NULL and VOID and another election must be effected.

SECTION THREE

POWERS AND FUNCTIONS OF ELECTORAL COMMITTEE

i. Shall have power to accept or reject the application of the candidates if the papers are not well

submitted or the candidate has been found wanting to any committee before, which automatically

ban his/her candidature.

ii. Shall approve all the candidates’ agents for the election once they have been registered with

the electoral committee

iii. Ban on campaign activities shall be lifted twenty (20) days to the Election Day.

iv. Candidates contesting the election shall obtain nomination papers.

v. Nomination papers shall serve as application forms.

vi. The electoral committee shall conduct manifestoes which every contestant must participate.

vii. Manifesto day shall be a day prior to the Election Day and no campaign shall be allowed on

the Election Day.

viii. The ballot paper shall be counted before and immediately after the elections in the presence

of candidate agent(s).

ix. The results shall be released immediately after the ballot paper has been counted.

x. Reference to Section (2) Sub-Section (vii) and (viii), the bye-election must be conducted by

the electoral committee within one hour of the earlier election.

xi. Nomination shall be accepted for the provision of the Section Two, Sub-Section

(vii) if the papers are submitted within one hour after election was announced.

xii. Shall disqualify a vote if there is any misconduct or misrepresentation.

xiii. There shall be a voter’s register i.e. the name of each voter marked after he/she has obtained

a ballot paper.

xiv. Shall accept nomination forms a day i.e. 24hours before the election.

xv. Shall release electoral guidelines at least 21days to the election.

xvi. A contestant must have at least one semester ahead before contesting.

xvii. An executive of one Local Chapter shall not be eligible to contest for any National post at

the same time.

SECTION FOUR

TENURE OF OFFICE

i. The tenure of office of all officials of the association shall be 365days from the day of

inauguration.

ii. Any candidate elected at the General Election shall hold office till the next transition day

provided he/she does not resign his/her office.

iii. Any candidate elected at the General Election shall resign upon graduation.

iv. No member of association may hold one or more of the offices in the association for more

than two tenures.

SECTION FIVE

RESIGNATION, SUSPENSION AND IMPEACHMENT OF OFFICERS

i. Any officer is free to resign provided that the Council accepts his/her resignation.

ii. Any officer who wants to resign shall hand-over his/her letter of resignation to the President

through the General Secretary.

iii. Any office vacated shall be filled according to the following injunctions.

iv. Resignations of the president of the Executive Council must be submitted to the executive

Council, which shall conduct the bye-election to fill the vacant post if the resignation is accepted.

v. Resignation of the Vice President(s) if accepted by the Executive Council be communicated to

the executive Council who shall conduct bye-election into that office.

vi. Resignation of the General Secretary if accepted shall be communicated to the Executive who

shall conduct a bye-election to fill its vacant post.

vii. Resignation of other officers of the Executive Council if accepted shall be communicated to

the executive Council which shall conduct bye-election into such office.

viii. Any officer of the association may be suspended/impeached from the office If he/she does

anything contrary to the provision of the constitution, failure to discharge his/her duties as

required by this constitution and/or if he/she fails to abide by the stipulations of his/her oath of

office.

ix. In Suspending/Impeaching any officer of the association from office, the following

procedures shall be followed:

a. A vote of guilt of misconduct shall be passed to the executive Council and some of the

members present at the sitting shall sign such allegation.

b. Executive council shall constitute on –ad-hoc committee to investigate the allegation and

make recommendation.

c. Some selected members shall be involved for fair-hearing, If the affected officer does not

conform with ad-hoc committee of the executive Council report or recommendation.

d. The congress shall be the supreme body to decide on this.

SECTION SIX

HAND-OVER PROCESS

i. During the dissolution of the Executive Council, they shall make both oral and paper

presentation of properties and documents to the incoming Executives in the presence of the

Advisers and patrons of the association.

ii. The out-going executive shall leave at least 10% of the total revenue generated in the

association account for the incoming executive.

iii. The out-going president shall on behalf of the executive read annual report prepared by the

Secretary General to the congress.

ARTICLE ELEVEN

SECTION ONE

MEETING

i. Meetings shall be conveyed by the president in consultation with the General Secretary.

ii. Emergency meeting of the congress may be called at the instance of the president or if two

third (2/3) can sign the notice calling for such a meeting.

iii. The president shall convey at least five (5) congress meeting during his/her tenure.

iv. The quorum of the executive meeting shall be two-third (2/3).

v. Any Executive meeting cannot hold if at least any of these members are not present, the

President, Vice President and General Secretary.

vi. The minutes shall be approved by a motion, which shall be seconded by any member present

at the meeting for which the minutes were taken.

vii. Any motion properly tabled and seconded shall receive the attention of the meeting.

viii. The motion shall be passed to the presiding officer for action.

ARTICLE TWELVE

SECTION ONE

THE ACCOUNTS

Account shall be maintained in single general accounting for:

i. Journal

ii. Dinner

iii. General Administration (Sport, Social, Secretariat, etc.)

SECTION TWO

PREPARATION AND PRESENTATION OF ACCOUNTS

i. Detailed income and expenditure account shall be prepared and presented in quarterly bases to

the executive Council by the Director of Finance and copies be made to the various organs of

authority.

ii. Such person shall within one week of collecting such money render a proper account of how

much money have been spent to the Financial Director.

iii. Authentic receipts capable of independent verifiability shall be for such accounts.

iv. On no account shall the Treasurer release any money or Director of Finance approves any

requisition for money on unapproved expenditures by the Executive Council.

v. No person who has not properly accounted for any money collected shall be eligible to collect

further sum of money from association purse.

vi. Under no circumstance whatsoever shall the money realized through social and other

activities embarked upon to generate fund for the association be spent independent of the

Director of Finance. Such money shall be passed through the Director of Finance for recording

purpose to the Treasurer immediately the money is received.

vii. In addition, the person in charge of the activities concerned shall keep the detailed accounts

of the income and expenditure, which shall be passed, to the Director of Finance within one

week of the completion of the task. Verifiable and authentic receipt shall back all expenditure.

viii. Every officer of the association shall take care and give proper account of association

properties entrusted in his/her care and handover same to his/her successor by means of a well

prepared document designed for his purpose by the Finance Committee not later than one week

before the swearing in of the new Executive Council.

ARTICLE THIRTEEN

COMMITTEES

SECTION ONE

The association shall have the following standing committees:

i. Finance Committee

ii. Publicity Committee

iii. Social Committee

iv. Audit Committee

v. Alternative Dispute Resolution Committee

vi. Constitution Review Committee

SECTION TWO

i. The association shall have the following ad-hoc committee.

ii. Auditing committee and any other committee as may be necessitated by circumstances with

approval from the executive council.

SECTION THREE

COMPOSITION OF MEMBERS

Members of the committees mentioned above in Article Sixteen, Section One, except Alternative

Dispute Resolution Committee and Section Two shall not be more than seven members.

i. The committee shall be selected and be approved by the by the Executive Council

ii. Membership of the committee shall compose of at least two (2) persons from each of the three

senatorial district in Kwara State.

iii. A person cannot serve in more than one of the standing and ad-hoc committees at a time.

iv. The Executive Council of the association shall have the power to set-up its own ad-hoc

committees for other necessary purpose with the approval of the Council.

v. The secretaries of the committees shall be from the Executive Council.

vi. Secretaries of the committees shall be answerable to the Executive Council on the action of

the committee.

SECTION FOUR

FUNCTION OF THE COMMITTEES

A. FINANCIAL COMMITTEE

i. Shall be headed by the Financial Secretary

ii. Shall assist the Financial Secretary on the collection of Financial assistance o donations and

dues.

iii. Shall advice the Financial Secretary on how to generate funds.

iv. The Financial Secretary shall be answerable to the Executive Councils for the actions of the

committee.

v. The tenure of office of the committee shall explore at the same time with that of Financial

Secretary.

vi. Secretary of the committee shall be answerable to the Executive Council on the actions of the

committee.

B. PUBLICITY COMMITTEE

i. Shall be headed by the Public Relation Officer I

ii. Shall be deputized by the Public Relation Officer II

iii. Shall assist the Public Relations Officers in discharging their duties.

iv. Shall create social awareness and improve the image of the association.

v. The Public Relations Officers I, II and III shall be answerable to the executives for the actions

of the committee.

vi. The committee shall undertake the publication of journals or any other official publication of

the association.

vii. The tenure of the office of the committee shall expire at the same time with that of the PRO

I, II and III.

viii. Secretary of the committee shall be answerable to the Executive Council on the action of the

committee.

C. SOCIAL COMMITTEE

i. Shall be headed by the Social Director and be assisted by the Social Directress.

ii. Shall undertake all Social activities of the association.

iii. The tenure of the committee shall expire at the same time with that of Social Director and the

Social Directress.

iv. The Secretary of the Committee shall be answerable to the Executive Council on the activities

of the committee.

D. AUDIT COMMITTEE

i. Shall be headed by the Auditors of Association

ii. Shall Audit the Association’s account and submit their report on quarterly bases to the

Executive Council.

iii. The tenure of the committee shall expire the same time with that of the Auditor.

iv. The Secretary of the Committee shall be answerable to the Executive Council.

E. ALTERNATIVE DISPUTE RESOLUTION COMMITTEE

i. Shall be collectively constituted by the Executive of the association, as recommended by the

three (3) principal officers subject to the ratification of the Executive Council.

ii. Shall be a five (5) man committee, three of whom must be recommended by the President, one

by the vice President and one by the Sec.Gen. of the association.

iii. One of the president recommendations must be a past president.

iv. Shall play advisory role during the time of dispute within the association.

v. Shall include ex-officials of the association who have distinguished themselves in character,

experience and integrity.

F. CONSTITUTION REVIEW COMMITTEE.

i. The Executive Council in a span of some years shall have power to review the constitution of

the National Association of Kwara State Students.

ii. The Deputy President of the Association shall be the Chairman of the Constitution Review

Committee.

iii. The Committee referred to in Section 2 of this Article shall include seven (7) men of good

character.

iv. The Constitution Review Committee referred to above shall include

Four (4) members of the Executive

One (1) Student Legal Practitioner

And three(3) members of the Association.

v. The Committee shall call for recommendations from members of the Association.

vi. The committee shall hold a public hearing after the amendment of the constitution.

vii. The quorum for the hearing shall be 15 percent of the members of the Association.

viii. The committee shall present the proposed constitution to the Senate Council for ratification.

iv. The proposed constitution shall be ratified by 2/3 majority of the members of the Executive
