PREAMBLE
we the entire members of the National Association of Kwara State Students (NAKSS) having
firmly and solemnly resolved to live in harmony and unity under a common entity. And to
provide a constitution which shall be a frame of reference in the conduct of the affairs of the
entity, promotion of the welfare of the members and the association in a conducive atmosphere
for the realization of aims and objectives, we do hereby make and give to ourselves this
constitution.

ARTICLE ONE
SECTION ONE:
NAME: The association shall be known and be addressed as The National Association of Kwara
SECTION TWO:
MOTTO: The motto of the association shall be Unity and Strength for Nationalism.
SECTION THREE:
LOGO: The logo of the association shall be the map of Kwara State carrying red touch light, a

ORGANS OF THE ASSOCIATION: The organs of the association shall be General Congress
SECTION FIVE:
CITATION
This constitution shall be cited and referred to as the Constitution of National Association of

SECTION ONE:

II. If the provision of this law (NAKSS) is inconsistent with the provision of the school
shall prevail, while this law shall, to the extent of its inconsistency be void.
III. The association shall not be governed nor shall any person or group of people take
control of the association or any part thereof except in accordance with the provision
of this constitution.
ARTICLE THREE
SECTION ONE
The aim of the association shall at all times and in all spheres conform with the fundamental
objectives and directives principles of NAKSS policy as enshrined in the constitution of the
Federal Republic of Nigeria and accordingly the association shall pursue the political,

the university in other to promote cooperation and understanding among all students of
FUDMA.
ii. To promote and encourage close relationship between local and state government
(NAKSS) nationwide.

v. To initiate and execute programme(s) and activities designed to raise fund for the

ORGANS OF AUTHORITY
SECTION ONE:

i. Every members must assist in protecting, propagating the principles or policies and programs
of the association.
ii. Every member must protect and safeguard the interest of the association.
iii. Every member shall have the right to be voted for except where exempted by other provision
of this constitution.
iv. Every member shall have access to helpful information and details about the association.
v. Every member shall have the right to present his/her suggestion(s) and grievance and shall be
processed.
vi. All members shall have the privilege to make use of facilities provided by the association
vii. All members of the association shall have the right to attend all its activities except where
ix. New members shall have the right to obtain copy of the association constitution upon
registration.
x. Members shall have equal right to the association while their duties may vary.
xi. Any member using associations property shall pay any prescribed amount into the association
purse for maintenance in case of damages as may be agreed upon by 2/3 executive council.
ARTICLE SEVEN
GUARDIANS
SECTION ONE

i. Grand patron shall be the highest ranked official in the school who is an indigene of Kwara
State.
ii. The composition of patrons and patronize shall be four outstanding personality, who are staff
iii. Patrons and patronize has no executive power and their tenure in office is one year re-appoint
able.
iv. The association shall enjoy the influential and financial support of the patrons and patronize.
v. The removal of I, II and III above shall be subjected to the ratification of executive council
SECTION TWO:
i. The association shall have legal adviser whose chamber base in Kwara State or a Kwaran,
ii. The Commissioner of Women Affairs shall be the association’s social adviser or as may be
appointed.
d. The patron and patronize shall be entitled to certificate of participation after their tenure.
SECTION THREE
i. The association shall through the director of finance meet always with the patrons, patronize,
adviser and fellows for the purpose of seeking assistance but with concept of at least 2/3 majority

i. Shall deliberate on all matters brought to its attention either by the executive, senate and

SECTION TWO
POWERS
ii. Shall have the power to question any elected, selected or appointed officials of the association
iii. Shall have the power to dissolve any of the executive council, senate council, judicial council

and any committee if found guilty of collective responsibilities in either misappropriation, bias,
iv. The power of dissolution is subject to 2/3 majority of the congress and such congress must
draw member from at least 2/3 institution with registered structure with Management and
National Headquarters.
v. The congress enjoy the power to suspend any part of the constitution which may cause
hindrance to the progress of the association with at least 2/3 majority of the congress in support
of such motion.
vi. Shall have the only power to impeach any member of the Association.
ARTICLE NINE
OFFICERS
There shall be the following officers for the administration of the association affairs:
- The president
- Vice President
- Treasurer
- Social Director
- Social Directress
- Director of Welfare

SECTION TWO
FUNCTION
i. The council shall direct the affairs of the association and carry out activities delegated by the

secretary general and financial secretary which shall be in conformity to (Article Nine, Section

x. Shall perform such other function(s) as may be conferred to him/her by other provision of this
constitution.
xi. Shall present the annual budget of the association to the executive council at the inaugural
sitting.
xiv. Shall not leave the campus for (4) four consecutive weeks.
xv. Shall have not more than five (5) appointees with the approval of the executive Council
iii. Shall be charged with the responsibility of keeping up-to-date database of the association
iv. Shall perform other functions as may be conferred on him/her by other section(s) of this
constitution.
v. Shall be the assistance to every office especially where his/her attention is called.

3. GENERAL SECRETARY/DIRECTOR GENERAL
ii. Shall after consultation with the approval of the president convene either executive or
iii. Shall in conjunction with the president prepare the agenda for the executive and congress
meeting(s).
iv. Shall record and keep minutes of both executive and congress meeting(s).
v. Shall handle all the association’s correspondence both internal and external.
vi. Shall preside over the executive or congress meetings in the absence of both president and the
vice presidents.
vii. Shall represent the association with any other official in any discussion and deliberation
xi. Shall perform other functions as may be conferred on him/her by other provisions of this
constitution.
ii. Shall be empowered to act and perform all the duty with the rights and powers of the General

5. FINANCIAL SECRETARY (DIRECTOR OF FINANCE)
v. Shall handover all money received by him/her to the treasurer not later than 24hours or deposit
same into association account not later than 48hours in the absence of the treasurer.
vii. Shall present on quarterly basis, the association’s account to the executive Council.
viii. Shall evaluate all projects and/or activities to be undertaken by the association and explore
avenues of cutting down cost while maintaining the quality of such project or activity.
ix. Shall make all financial documents available to the audit committee when requested.
xi. Shall present a written report at the expiration of his/her tenure of office to the congress.
xii. Shall represent the association in all financial matters in relation to other association, clubs,
societies, etc.
xiii. Shall perform other functions as may be conferred on him/her by other provision(s) of this
constitution.
xiv. Shall be held responsible at the first instance for any misappropriation and mismanagement
xv. Shall make available copies of the proposed budget for the association.

6. TREASURER
i. Shall keep the association’s bank pass-book and be responsible for the safekeeping of all
ii. Shall collect any money received by the Financial Secretary/Director of Finance and keep
such for not more than 48hours before depositing such into the association’s bank account.
iii. Shall issue receipts to the Director of Finance for all money received.
v. Shall keep a proper account of all income and expenditure of the association.
vi. Shall keep an impress account of not more than Five Thousand Naira (N5,000) or as may be
vii. Shall not release any money in his/her care except on the presentation of a written request
viii. Shall report any defaulter to the executive Council for the appropriate action(s).
ix. Further to the proceeding sub-section (viii) where the Director of Finance is absent, he/she
shall release such money on the presentation of a written approval by the president and acts on

constitution.
7. PRO I AND II

i. They shall in consultation with the president, prepare and issue release on the association’s
activities.
ii. They shall publicize all the activities of the association prior to and after the occasion(s) in the
iii. They shall make when necessary, personal contacts with other associations on the association

iv. They shall make necessary releases available for the presidents of the affiliated chapters.
v. They shall in consultation with the executive, be responsible for the internal and external

9. DIRECTOR OF WELFARE
i. Shall with the approval of the president be responsible for the maintenance of all social and
welfare properties of the association e.g. vehicle, chairs, public address system, etc. in the
association secretariat.
ii. Shall furnish the Executive Council, Legislative Council and Congress on the welfare
iii. Shall perform such other duties as may be delegated to him/her by other provision(s) of this
constitution.
iv. Shall be the custodian of any of the association properties subject to the approval of the
president
ii. Shall be responsible for organizing of Sport Activities for the association from time to time.
iv. Shall be responsible for the welfare of the association sport men and women.
v. Shall represent association in the meeting related to sport activities called by other bodies

11. AUDITOR
iii. Shall submit his/her findings to the Senate Council on quarterly basis.
iv. Shall submit all relevant report to any external audit committee or auditor set up by the Senate
Council.
v. Shall keep watch of other offices to ensure full performance and proper appropriation of funds

i. The president or any other person so appointed shall present the council’s plan and decisions to
the senate council for notification, ratification and approval. Any approved or ratified decision(s)
shall be constitutionally binding on every member except the two-third (2/3) majority of the

executive council, the doctrine of collective responsibility shall apply in/on all actions or

SECTION FOUR
iii. To give approval to the executive council before any proposed expenditure
exceeding Hundred Thousand Naira (N100, 000) may be made out of the
association’s fund.
vii. To give all major policy decisions of the Executive Council which may include
among others decisions that may affect the existence and/or the image of the

found wanting; and shall also have the power to suspend any erring member of the
executive.
xv. Other principal officers of the Legislative Council shall not enjoy any power of voting in any
xvi. Shall have the power to suspend any officer of the Association.
ARTICLE ELEVEN
PROCESS OF TRANSITION
SECTION ONE
The following guide shall be followed in the process of transition of power within the
association:
i. At about thirty days (30) the last congress to be held, the incumbent executive shall nominate
at least 3 representative from each of three senatorial districts into the electoral committee and
submit such to the General Secretary for onward transmission to the Senate Council for scrutiny
and inauguration.
ii. The body set up by virtue of Sub-Section (1) above shall have the power and responsibilities

iii. The setting up of the Electoral Committee shall not mean the dissolution of the incumbent
Executive Council.
iv. The electoral committee shall make arrangements for the swearing of the new officers
immediately after the election subject to the notification of the general member.
v. The electoral committee shall not be influenced in its action by anybody or body of persons in
anyway.
vi. The electoral committee will conduct bye-election subject to the recommendation of the
executive Council.
SECTION TWO
ELECTION
ii. Any officer(s) removed shall not be eligible to contest any election to any office.
iii. Any member shall not be eligible to contest for more than two (2) times and not for the same
office provided it is not in contrary to Article Five of this constitution and satisfied other

vi. A lone contestant must secure (2/3) of the total votes cast otherwise there must be another
vii. In the event of having two or more candidates scoring the same and the highest votes, the
election to that office must be declared NULL and VOID and another election must be effected.
SECTION THREE

i. Shall have power to accept or reject the application of the candidates if the papers are not well
submitted or the candidate has been found wanting to any committee before, which automatically
ii. Shall approve all the candidates’ agents for the election once they have been registered with
iii. Ban on campaign activities shall be lifted twenty (20) days to the Election Day.
vi. The electoral committee shall conduct manifestoes which every contestant must participate.
vii. Manifesto day shall be a day prior to the Election Day and no campaign shall be allowed on
viii. The ballot paper shall be counted before and immediately after the elections in the presence
of candidate agent(s).
ix. The results shall be released immediately after the ballot paper has been counted.
x. Reference to Section (2) Sub-Section (vii) and (viii), the bye-election must be conducted by
xi. Nomination shall be accepted for the provision of the Section Two, Sub-Section
(vii) if the papers are submitted within one hour after election was announced.
xiii. There shall be a voter’s register i.e. the name of each voter marked after he/she has obtained
a ballot paper.
xiv. Shall accept nomination forms a day i.e. 24hours before the election.

xvi. A contestant must have at least one semester ahead before contesting.
xvii. An executive of one Local Chapter shall not be eligible to contest for any National post at

TENURE OF OFFICE
i. The tenure of office of all officials of the association shall be 365days from the day of
inauguration.
ii. Any candidate elected at the General Election shall hold office till the next transition day
iii. Any candidate elected at the General Election shall resign upon graduation.
iv. No member of association may hold one or more of the offices in the association for more

i. Any officer is free to resign provided that the Council accepts his/her resignation.
ii. Any officer who wants to resign shall hand-over his/her letter of resignation to the President

anything contrary to the provision of the constitution, failure to discharge his/her duties as
required by this constitution and/or if he/she fails to abide by the stipulations of his/her oath of
office.
ix. In Suspending/Impeaching any officer of the association from office, the following

i. Detailed income and expenditure account shall be prepared and presented in quarterly bases to
the executive Council by the Director of Finance and copies be made to the various organs of
authority.
ii. Such person shall within one week of collecting such money render a proper account of how

iv. On no account shall the Treasurer release any money or Director of Finance approves any

properties entrusted in his/her care and handover same to his/her successor by means of a well
prepared document designed for his purpose by the Finance Committee not later than one week

SECTION ONE

ii. Auditing committee and any other committee as may be necessitated by circumstances with

Members of the committees mentioned above in Article Sixteen, Section One, except Alternative
Dispute Resolution Committee and Section Two shall not be more than seven members.

vi. Secretaries of the committees shall be answerable to the Executive Council on the action of
the committee.
SECTION FOUR
A. FINANCIAL COMMITTEE
ii. Shall assist the Financial Secretary on the collection of Financial assistance o donations and
dues.
iv. The Financial Secretary shall be answerable to the Executive Councils for the actions of the
committee.
v. The tenure of office of the committee shall explore at the same time with that of Financial
Secretary.
vi. Secretary of the committee shall be answerable to the Executive Council on the actions of the
committee.
B. PUBLICITY COMMITTEE
iii. Shall assist the Public Relations Officers in discharging their duties.
iv. Shall create social awareness and improve the image of the association.
v. The Public Relations Officers I, II and III shall be answerable to the executives for the actions

of the committee.
vi. The committee shall undertake the publication of journals or any other official publication of
the association.
vii. The tenure of the office of the committee shall expire at the same time with that of the PRO
I, II and III.
viii. Secretary of the committee shall be answerable to the Executive Council on the action of the
committee.
C. SOCIAL COMMITTEE
i. Shall be headed by the Social Director and be assisted by the Social Directress.
iii. The tenure of the committee shall expire at the same time with that of Social Director and the
Social Directress.
iv. The Secretary of the Committee shall be answerable to the Executive Council on the activities
of the committee.
D. AUDIT COMMITTEE
ii. Shall Audit the Association’s account and submit their report on quarterly bases to the
Executive Council.
iii. The tenure of the committee shall expire the same time with that of the Auditor.
iv. The Secretary of the Committee shall be answerable to the Executive Council.

vii. The quorum for the hearing shall be 15 percent of the members of the Association.
viii. The committee shall present the proposed constitution to the Senate Council for ratification.
iv. The proposed constitution shall be ratified by 2/3 majority of the members of the Executive
