SPECIAL PROVISIONS

5% Municipal Risk Reduction Management Fund (MDRRMF)


1. Use and Release of Fund. The amount herein shall be used in accordance with RA No. 10121, “The Philippine Disaster Risk Reduction
and Management Act of 2010”, which shall include relief, rehabilitation, reconstruction and other works or services including pre-
disaster activities, in connection with the occurrence of natural calamities, epidemics as declared by the DOH, and other catastrophes.
PROVIDED, that the projects and activities are incorporated in the Local Disaster Risk Reduction and Management Plan (LDRRMP), and
integrated in the approved Annual Investment Program. PROVIDED FURTHER, that the utilization of fund shall be in accordance with
the provisions of NDRRMC-DBM-DILG Joint Memorandum Circular No, 2013-1 dated March 25, 2013.

2. Quick Response Fund. The amount appropriated for MDRRM Fund, thirty percent (30%) of which shall be allocated as Quick
Response Fund (QRF) or Standby fund for relief, recovery programs in order that the situation and living conditions of people in the
community or areas stricken by disaster, calamity and epidemics will be stabilized as quickly as possible. The release and use of QRF
shall be supported by a resolution of the Sanggunian declaring the LGU under the State of calamity or a Presidential declaration of State
of calamity.

3. In no case shall be QRF be used for pre-disaster, nor be re-aligned for any other purpose.

SPECIAL PROVISIONS

Gender and Development (GAD) Fund

1. Legal basis for GAD and GAD Planning and Budgeting. Republic Act No. 7192 and Executive Order (E.0) No. 273 mandate agencies
including LGUs to institutionalize GAD concerns in their planning and budgeting process. The allocation of funds for the
implementation of GAD plan is a statutory requirement that must be complied with by agencies concerned.

2. Use and Release of Fund. The amount herein appropriated shall be used for the P/A/P specifically reflected in the GAD Plan for the
budget year which addresses the gender issues and concerns of respective sectors, specifying the targets to be achieved. A GAD
Plan is an integral part of the overall LGU Plan.

Local Child Protection Program (LCPC)

1. Legal Basis. LCPC is an institutional mechanism in all levels of LGU that advocates child rights, plans and
initiates/recommends interventions and monitors children’s programs and projects in the locality. Under which are the
following bases that supports LCPC:
 Presidential Decree No. 603 as amended – “The Child and Youth Welfare Code” this promotes the interests and
development of children and youth and to protect their rights and privileges. That a child has the right to survival,
development, protection and participation in the society regardless of legitimacy, sex, social status, religion,
political and other factors.
 Pursuant to RA 6972 or “the Barangay Level Total Development and Protection of Children Act, this ensure that
every barangay shall have a Day Care Center. Children below six (6) years old may be admitted with consent of
parents or guardian, wherein basic education and primary health care services are provided.
 Republic Act (RA) 9344 – also known as “Juvenile Justice and Welfare Act of 2006”, promotes those rights and
welfare of every child in conflict with the law. A child fifteen years of age under the time of the commission of the
offense shall be exempted from the criminal liability. This ensure the rights of a child not to be tortured, not to
deprived unlawfully, not to be imposed a sentence of capital punishment, not to be treated inhumanely and
furthermore. However, he/she shall be subjected to appropriate proceedings in accordance with the provisions.
 Republic Act (RA) 7610 – “The Special Protection of Children against abuse, exploitation and discrimination act”,
this protects male or female, who for money, profit or any other consideration or due to coercion or influence of
an adult, syndicate or group, indulge in sexual intercourse and other sexual abuse. The LGU implement measures
to ensure the protection and rehabilitation to prepare the abused child for full integration into the mainstream of
the society.

 Use and Release of Fund. The amount herein appropriated shall be used in strengthening and implementation of
programs/projects/activities of the Local Council for the Protection of Children (LCPC) as indicated in its Annual
Plan.
Senior Citizen/Differently-Abled Persons

1. Legal Bases for Senior Citizen and Person with Disability Planning and Budgeting

The Joint Circular No. 2003-02, April 28, 2003 of Department of Budget and Management with the Department of Social Welfare
and Development declaring “All heads of Executive Departments, Bureaus, Offices, Agencies, Commissions and State Universities and
Colleges and all Other Concerned”. Subject: Implementing Guidelines for Section 29 of the General Appropriations Act for FY 2003
Entities “Setting Aside One (1) percent of Government Agency Budget for Programs/Projects Related to Senior Citizen and Disabled”.

1.1 Amended RA 7432 or “An Act to Maximize the contribution of Senior Citizen to nation building, Grant Benefits and Special
privileges and for other purposes”, motivating and encouraging the senior citizens to contribute nation building and to
mobilizing their families and the community they live with, among others.
1.2 Republic Act of 7277 “Known as Magna Carta for Disabled Person”, declaring the rights and privileges of Persons with
Disabilities to equal opportunities to employment, education, health, auxiliary social services, telecommunications,
accessibility and political and civil exercises. Thus, RA 7277 was amended by RA 9442 in year 2012 and also amended in the
year 2016 of expanding benefits on RA 10754.

The budget planning was enacted executed with all the offices and members of the two organization which is the Senior Citizens
and Person with Disability. The allocation of fund for the implementation of local Funded 1% for Senior Citizen and Person with
Disability Plan is a statutory requirement that must be complied with by agencies concerned.

2. Use and Release of Fund. The amount herein appropriated shall be used for the PAP specifically reflected in the 1% of Person with
Disability and Senior Citizen Plan for the budget year which addresses on the project/programs and activities related to Person with
Disability and Senior Citizen Welfare.

SPECIAL PROVISIONS

2% Discretionary Fund

1. Use and Release of Fund. The amount herein appropriated is derived from 2% of the actual collections of Real Property Tax of the next
preceding year and be utilized for the discretionary expenditures of the Local Chief Executive.

Aid to Barangays

1. Legal Bases. Section 324i of the code provides: In the case of provinces, cities and municipalities, aid to component barangays shall be
provided in amount of not less than (One) 1 Thousand Pesos (1,000) per barangay.

2. Use and Release of Fund. The amount allocated herein shall be disbursed purposely for the 25 component barangays’ operational
expenditures, i.e Personal Services, Maintenance and Other operating expenses, Capital Outlay or for any other public purposes for the
reason that the law does not specify as to purpose the same it could be utilized.
