RESOLUTION RECOMMENDING THE PROCUREMENT AND AWARDING OF CONTRACT BY


VIRTUE OF RULE 16 SECTIONS 48, 49, 50, 51, 52, 53 AND 54 THROUGH ALTERNATIVE
METHODS OF PROCUREMENT, ITS TERMS AND CONDITIONS OF R.A. 9184, THE
IMPLEMENTING RULES AND REGULATIONS AND OTHER GOVERNING LAWS

WHEREAS, the Bukidnon State University (BSU) through its Bids and Awards Committee (BAC) convene,
recommend and move a motion to approve for the procurement of supplies, goods, and services specified in
the item description of herein attached Purchase Request dated on ________________________, and numbered
as____________________, with an actual/estimated budget cost amounting to Php ________________________
as approved by the Head of the Procuring Entity (HOPE);

WHEREAS, the procurement of this supplies, goods and services was a result of failed biddings (2 failed
biddings) and/or the use of Alternative Methods of Procurement, and its Terms and Conditions, respectively
in accordance with the provisions of R.A. 9184, its IRR of Rule 16 Sections 48, 49, 50, 51, 52, 53, as may apply,
and Section 54 of the same Rule;

WHEREAS, the use of Alternative Methods of Procurement and its Terms and Conditions was due to
exigency of time, in cases of, imminent danger on the loss of life or property, unforeseen or inevitable events
occurred to maintain and deliver public service or the prevention of possible slow-down of its vital services,
the amount, nature and usage of supplies, goods, and services involved for procurement;

WHEREAS, the use of Alternative Methods of Procurement, and its Terms and Conditions was the most
advantageous and convenient procurement method/s that can be obtained by government agencies, offices,
and its instrumentalities in continuance of its functions, mission and vision;

WHEREAS, the provisions of RA 9184, and its IRR of Rule 16 Sections 48, 49, 50, 51, 52, 53, as may apply,
through Alternative Methods of Procurement, and Section 54 for its Terms and Conditions was substantially
complied with;

WHEREAS, after the presentation and evaluation of the abovementioned Purchase Request, the Bids and
Awards Committee moved and approved the motion to procure the request/project of this supplies, goods
and services, without any objection, by and through the provisions of R.A. 9184 and its IRR of Rule 16
Sections 48, 49, 50, 51, 52, 53, as the case may apply on Alternative Methods of Procurement, and Section 54
for its Terms and Conditions of the same Rule, and other existing laws;

WHEREAS, the Bukidnon State University through the Head of Procuring Entity (HOPE) together with the
Bids and Awards Committee (BAC) reserves the right to annul, rescind or terminate this procurement and
awarding of contract for a valid cause in accordance with R.A. 9184, its IRR, the provisions of contract, and
other governing laws, where immediate action is necessary to prevent damage to or loss of life or property, or
to restore vital public service without incurring any liabilities to the prospective contractors;

NOW, THEREFORE, We, the Members of the Bids and Awards Committee, hereby RESOLVE as it is
hereby RESOLVED:

A) To recommend the procurement of this supplies, goods and services by virtue on the
provisions of R.A. 9184 and its IRR of Rule 16 Sections 48, 49, 50, 51, 52, 53, as the case may
apply for Alternative Methods of Procurement and Section 54 on its Terms and Conditions to
the Lowest Calculated Responsive Bid/Price Proposal (for goods and infrastructure services), or
the Highest Rated Responsive Bid/Qualification (for consultancy services) of prospective
contractor/s, as the case may be, and as determined by the evaluation of the BAC and its
Technical Working Group for the awarding of contract;

B) To recommend the compliance and attachment of the Request of Bid Proposal/Price


Proposal/Quotation of Prices/, the Curriculum Vitae/Qualifications (for consultancy services),
the Certificate of Exclusive Distributorship/Manufacturer (if any), the Abstract of
Bids/Quotation, the Evaluation Report of TWG, the Purchase Order, and other pertinent
requirements/documents to support this procurement; and

C) To recommend for approval by the President of Bukidnon State University the foregoing
findings;
