ORDER
MHA vide their OM No. 45020/2/2018/Legal-II dated 13.4.2018 has informed that the SSC conducted CPO (SI) Exam during the year 2002
for which the final results were declared in the month of Aug’2003 and BSF issued Offers of appointment during the month of Dec’2003 directing candidates to
report Training Centres in the month of Jan’2004. In the mean time, the GOI had introduced a New Pension Scheme vide GOI Notification dated 22.12.2003
which is applicable to the personnel who have entered into Govt. Service wef. 1.1.2004 onwards.

Some of the BSF candidates approached the Hon’ble High Court of Delhi with a prayer that issuing appointment letter after 1.1.2004 is an
administrative lapse on the part of CAPFs / BSF, hence, they may be extended the benefits of Old Pension Scheme by way of filling WPC No. 3834/2013 titled
Parmanand Yadav and 125 others and WPC No. 2810/2016 titled by Inspector Rajendra Singh and 29 others vs UOI and other before the Hon’ble High Court of
Delhi which was allowed vide order dated 12.2.2015 and 27.3.2017 respectively. The MHA after detailed deliberations and in consultation with DoLA & DoP &
PW agreed to implement the Court Judgement i.e. to extend the benefits of Old Pension Scheme without any back wages or seniority in the case of petitioner and
other similar left over candidates. The MHA has further desired that all other CAPFs (Except BSF) may check their records and if any similar case is found, they
may examine and take appropriate action on similar lines, as in the BSF case, to avoid similar litigation in future.

Besides the above, DOP&PW Office Memorandum no. 57/04/2019- P & PW (B) dated 17/2/2020 has issued new guidelines / clarifications on
the subject matter which were circulated to 10 Committees (i.e.1 for GOs under IGP NS and 9 for NGOs under all Zones, ADG CRPF Academy Kadarpur, Trg /
CoBRA / Commn./ RAF ) detailed for the purpose of assessing the suitability of Old Pension Scheme in respect of force personnel on the basis of DOP&PW OM
ibid vide this Directorate letter No. P.III-1/2018-Adm-1-DA-3 dated 23.3.2020. Accordingly, Heads of 9 Committees have submitted their Board Proceedings in
respect of all Non Gazetted Officers of this Force and the following personnel have been found eligible for being allowed the benefits of the Old Pension
Scheme under CCS (Pension) Rules 1972 as per details given below:-

In view of the above, all Heads of offices /DDOs are hereby ordered to allot them GPF account number by ceasing/cancelling their NPS
membership and their NPS subscription be also remitted to their newly allotted GPF Account. Since, all eligible force personnel have already exercised their
option for coverage under Old Pension Scheme as mentioned in the Board proceedings, therefore, all Heads of offices will ensure to initiate action on remaining
points No. 2 and 3 within the timelines prescribed by the DOP&PW vide their OM No. 57/04/2019-P&PW (B) dated 31/03/2021 as per details given below:-

service records of all eligible force personnel. They will also decide their representations/legal notice/Court cases if any, in consultation with the Board
concerned at their end.
It may also be ensured that left out cases if any, be examined by the respective Zonal/Sector HQrs and forwarded to this Directorate through supplementary
Board proceedings by 31/08/2021 for the needful as per the timelines fixed by the GOI, Deptt. of Pension and Pensioners Welfare vide their OM No. 57/04/2019-
P&PW(B) dated 31/03/2021. Thereafter, no further cases will be entertained.

This has the approval of DG CRPF.
