This is with regard to the accident that occurred to me due on November 3, 2019 at around 9:00

AM within the 9 Spoons Restaurant, Bay Leaf hotel, Intramuros Manila, due to the wet
slippery floor near the food warmer/chaffing dish (proximate to the comfort room) located within
the restaurant, which slippery floor was lacking any caution signage.

After paying my bill for my breakfast buffet, I went directly to the comfort room inside the
restaurant and after around 8 minutes went my way out. At the end of the hallway from the
comfort room upon turning to the right (just near the food warmer/chaffing dish), all of a sudden
I slipped on the wet floor since it was not apparent that it was wet since no precaution
signage was placed there. It was so fast and hard that I almost fainted due the pain on my nose
and knees which hit hard on the floor, but tried hard to make myself awake all throughout cause I
was alone.

Sara and Susan, the two guests who sat beside the area was one of those who first helped me and
Sara saw exactly how I abruptly slipped and fell hard on the floor face down. She saw my body
lift because of the fast slide before the hard fall.

Next thing I know, my nose and knees was in severe pain. Guys tried to lift me up but I heard a
woman (Susan, whom I have learned was a nurse and aware of first aid precaution) was advising
the guys not to lift me up at once cause the injury might be aggravated. I was advised by her to
have deep breathing and take time before I be lifted to sit and made sure I don't force myself but
only if I am able to. Good thing I was still conscious with the help of the Lord God, though I was
about to faint due to the pain as mentioned earlier.

I was given first aid treatment by the nurse of the hotel, Devz. Whilst the Officer in
Charge/Supervisor named Christian, made arrangements to bring me in the hospital through
ambulance in Manila Doctors.

Hence, after a standard X-Ray on my _________________, I was likewise given Arcoxia,


prescribed Celecoxib, advised to rest for two (2) days, confirmed that no fracture was seen on the
x-ray and to apply cold compress at home, though I was not really seen and attended by the
doctor in Manila Doctors hospital. Due to this, I have to consult a general surgeon the following
day.

Having had this accident occurred to me in The Bay Leaf hotel, this should have been avoided
only if the tiles in the way to the restroom and portion where the buffet meal starts SHOULD
HAVE A SLID FREE RUG and by NOT LEAVING THE FLOOR WET AND SLIPPERY
without any visible warning or caution signage for the customers to easily see so that accidents
could be avoided.

I have sought legal advise regarding the accident I had in your hotel wherein this has been
quoted: Art. 2176. Whoever by act or omission causes damage to another, there being fault or
negligence, is obliged to pay for the damage done. Such fault or negligence, if there is no pre-
existing contractual relation between the parties, is called a quasi-delict and is governed by the
provisions of this Chapter. (Navida v. Dizon, Jr., G. R. Nos. 125078, 125598, 126654, 127856
&128398, 30 May 2011, 649 SCRA 33, 79).

The following day I was forced to go back to the hotel to file the Incident report which I was not
able to do the day it occurred and was accommodated by Mr Ed Vitug, general manager of the
hotel. He was apologetic, humane and subtle to deal on the issue with full responsibility on all
medical and incident expenses caused by the accident I incurred, and I appreciate it.

However, I have to shoulder the expense first, provide receipts and would add more
inconvenience and toll on me? Going to and fro for consultations, medications and not being
paid for sick leaves and moreso for the mere trauma I have experienced.

Having said this all, I sincerely hope this will be dealt and settled in a fair and considerate
manner by your good office and a speedy resolution and response be made.
