APPENDIX.
NOTIFICATION.
Whereas, for the ease of, and for the expedient compliance of the requirements of certain labour related laws referred to herein and for
the purpose of rationalisation of forms and reports so as to provide trust based efficient public service delivery, it has become essential to frame
separate rules;
And Whereas, the intention to provide for combined and simplified forms and reports is to sub-serve the purposes, electronically or
otherwise, of the said Labour related Laws and the rules made thereunder, wherein provisions have been made for use of such forms and
reports;
And Whereas, the combined and simplified forms and reports provided under these rules will facilitate ease of compliance and
inspection, being as simple as possible and making the information provided there under easily accessible to the public thereby increasing
transparency;
And Whereas, making separate rules for the aforementioned purpose will benefit making use of the forms and reports provided under
different labour related laws simple, which will serve public purpose in a better way;
And Whereas, to achieve the aforementioned purposes, the Rules, namely the Tamil Nadu Rationalisation of Forms and Reports under
certain Labour Laws Rules, 2020 which is proposed to be made in exercise of the powers conferred by,-
(a) section 35 of the Contract Labour (Regulation and Abolition) Act, 1970 (Central Act 37 of 1970);
(b) section 35 of the Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979 (Central Act 30 of 1979); and
(c) section 62 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 (Central
Act 27 of 1996); consultation with the expert committee.

1. Short title and commencement.– (1) These rules may be called the Tamil Nadu Rationalisation of Forms and Reports under Certain Labour
Laws Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
(i) the Contract Labour (Regulation and Abolition) Act, 1970 (Central Act 37 of 1970);
(ii) the Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979 (Central Act 30 of 1979); and
(iii) the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 (Central Act 27 of 1996),
the Forms specified in the Schedule annexed to these rules shall be maintained either electronically or otherwise and used for the purposes of
the aforesaid enactments and the rules made thereunder, as specified therein.
(2) If the Forms referred to in sub-rule (1) are required for inspection by the concerned Inspector appointed under any of the
enactments referred to in the said sub-rule, the concerned persons shall make available such Forms or provide the necessary particulars for the
purposes of accessing the information, as the case may be.
3. Amendment of certain Rules.- The following rules shall be amended, except as respects things done or omitted to be done before such
amendment, in the manner specified below, namely :-
(1) in the Tamil Nadu Contract Labour (Regulation and Abolition) Rules, 1975,-
(a) in rule 17, in sub-rule (1A), for the expression “in Form I”, the expression “ in Form XII annexed to the Tamil Nadu Rationalisation of Forms
and Reports under Certain Labour Laws Rules, 2020” shall be substituted;

(b) in rule 18, in sub-rule (1), for the expression “in Form II”, the expression “ in Form I annexed to the Tamil Nadu Rationalisation of Forms and
Reports under Certain Labour Laws Rules, 2020” shall be substituted;
(i) in sub-rule (1), for the expression “in Form IV”, the expression “in Form II annexed to the Tamil Nadu Rationalisation of Forms and
Reports under Certain Labour Laws Rules, 2020” shall be substituted;
(ii) in sub-rule (2), for the expression “in Form V”, the expression “in Form III annexed to the Tamil Nadu Rationalisation of Forms and
Reports under Certain Labour Laws Rules, 2020” shall be substituted;
(d) in rule 24, in sub-rule (2), for the expression “in Form V-A”, the expression “in Form V annexed to the Tamil Nadu Rationalisation of Forms
and Reports under Certain Labour Laws Rules, 2020” shall be substituted;
(i) in sub-rule (1), for the expression “in Form VI”, the expression “in Form VI annexed to the Tamil Nadu Rationalisation of Forms and
Reports under Certain Labour Laws Rules, 2020” shall be substituted;
(A) in clause (iv), after the expression “settlement or award”, the expression “or by the appropriate Government” shall be
inserted;
(B) in clause (vii), for the expression “in Form VI-A”, the expression “in Form VII annexed to the Tamil Nadu Rationalisation of
Forms and Reports under Certain Labour Laws Rules, 2020” shall be substituted;
(f) in rule 29,in sub-rule (2), for the expression “in Form VII”, the expression “in Form II annexed to the Tamil Nadu Rationalisation of Forms
and Reports under Certain Labour Laws Rules, 2020” shall be substituted;
(h) in rule 77, for the expression “in Form XV”, the expression “in Form VIII annexed to the Tamil Nadu Rationalisation of Forms and Reports
under Certain Labour Laws Rules, 2020” shall be substituted;

(i) in rule 81, in sub-rule (3), for the expression “in Form VI-B”, the expression “in Form VII annexed to the Tamil Nadu Rationalisation of Forms
and Reports under Certain Labour Laws Rules, 2020” shall be substituted; and
(j) existing Forms I, II, IV, V, V-A, VI, VI-A, VI-B, VII, VIII, IX, X, XI and Form XV shall be omitted.
(2) in the Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) (Tamil Nadu) Rules, 1983,-
(a) in rule 3, in sub-rule (1), for the expression “in Form I”, the expression “ in Form XII annexed to the Tamil Nadu Rationalisation of Forms and
Reports under Certain Labour Laws Rules, 2020” shall be substituted;
(b) in rule 4, in sub-rule (1), for the expression “in Form II”, the expression “in Form I annexed to the Tamil Nadu Rationalisation of Forms and
Reports under Certain Labour Laws Rules, 2020” shall be substituted;

ANNEXURE
2. The number of workmen employed as contract labour/migrant workmen in the establishment shall not, on any day, exceed the maximum
number specified in the licence.
3. Except as provided in the Rules, the fees paid for the grant or, as the case may be, for renewal of the licence shall be non-refundable.
4. The rates of wages payable to the workmen by the contractor shall not be less than the rates prescribed for the Scheduled Employment under
the Minimum Wages Act, 1948 (Central Act 11 of 1948), where applicable, and where the rates have been fixed by agreement, settlement,
award, or by the appropriate Government, not less than the rates so fixed.
5.(a) In case, where the workmen employed by the contractor perform the same or similar kind of work as the workmen directly employed by
the principal employer of the establishment, the wage rates, holidays, hours of work and other conditions of service of the workmen of the
contractor shall be the same as applicable to the workmen directly employed by the principal employer of the establishment on the same or
similar kind of work; provided that in the case of any disagreement with regard to the type of work, the same shall be decided by the registering
officer having jurisdiction over the area. Any person aggrieved by the decision of the registering officer may prefer an appeal to the
Commissioner of Labour within thirty days from the date of receipt of such decision and his decision shall be final.
(b) In other cases, the wage rates, holidays, hours of work and conditions of service of the workmen of the contractor shall be such as may be
specified in this behalf by the Commissioner of Labour.
6. Every contract labour/migrant worker shall be entitled to allowances, benefits, facilities etc, as prescribed in the Contract Labour (Regulation
and Abolition) Act, 1970 (Central Act 37 of 1970) or the Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act,
1979 (Central Act 30 of 1979) and rules made there under.
7. In every establishment, where 20 or more women are ordinarily employed as there shall be provided 2 rooms of reasonable dimension for the
use of their children under the age of six years. One of such rooms would be used as a play room for the children and the other as bed room for
the children. For this purpose, the contractor shall supply adequate number of toys and games in the play room and sufficient number of cots
and beddings in the sleeping room. The standard of construction and maintenance of the crèches may be such as may be specified in this behalf
by the Commissioner of Labour.

8. Women shall be employed by any contractor before 6 a.m. or after 7 p.m. with her consent.
9. The licensee shall notify any change in the number of workmen or the conditions of work to the Licensing Officer.
10. A copy of the licence shall be displayed prominently at the premises where the contract work is being carried on.
11. The contractor shall comply with all the provisions of the Act and these Rules.
12. The licensee shall, within fifteen days of the commencement and completion of each contract work, submit a return to the Inspector
appointed under section 28 of the Contract Labour (Regulation and Abolition) Act, 1970 (Central Act 37 of 1970) intimating the actual date of the
commencement or, as the case may be, completion of such contract work in Form - VII.
