TOPIC 1:

Situation 1:
You are a nurse assigned to patient Elsa, A 3-year old girl with dengue hemorrhagic
fever. The doctor recommends blood transfusion to replace the blood loss and
increase platelet count, The family does not approve of the blood transfusion because
of a religious belief and conviction.

An Ethical Health Issue?


1. What will be your approach to the client's family?
2. What are the conflicts you can see in the situation stated?

ETHICS
● Greek word “ethos” which means moral duty, character or custom.
● It refers to the practices or values that distinguish one person, organization, or
society from others
● It pertains to the knowledge of what to study about-that is the Goodness or evil of
human conduct.
● Ethics is not feelings - just because you feel that you are right doesn’t mean you
are indeed right. Hatred, envy, and resentment can distort our perception of reality
and decision making.
○ Emotions would influence our ability to perceive our ethical values and to
make ethical judgements.
● Ethics is not religion
○ Ethics is not limited to a religion
➔ Ethics cannot be confined strictly to a particular religion. Islam: one can have
multiple wives while in christian, we can only have 1.
➔ Ethics should not invoke particular beliefs as a justification of its conclusions.
Ethics is strongly connected to one’s belief in God

● Ethics is not a science
● Ethics is not equal to law and some laws are not morally accepted

abortion; not all countries.

workers if they tend to forget about it.

What is Healthcare Ethics for?

1. In a difficult delivery case, what is the best for the mother and what is the best for the
unborn child?
2. What is the best for the patient and his or her relative in his or her present health
condition?
3. What medical records can be disclosed and what must be held in strict

information cannot be disclosed with them unless they are primary folks or

the public will trust and have confidence in receiving.

What is an Emergency Use Authorization?


EUA is a mechanism to facilitate the availability and use of medical countermeasures,
including vaccines, during public health emergencies, such as the current COVID-19
pandemic.Under an EUA, FDA may allow the use of unapproved medical products, or
unapproved uses of approved medical products in an emergency to diagnose, treat , or,
prevent serious life-threatening diseases or conditions when certain statutory criteria have
been met, including that there are no adequate, approved, and unavailable alternatives.
Taking into consideration input from the FDA, manufacturers decide whether and when to
submit an EUA request to the FDA.

Florence Nightingale (1820-1910)

Nightingale identified several characters/character traits:
1. Truthfulness/ Honesty
- Truth-telling is a key issue within the nurse-patient relationship. Nurses make
decisions on a daily basis regarding what information to tell patients.

2. Integrity (closely related to honesty)
- The ability to keep confidences and overall trustworthiness that your patients
see who you are and count on you to do the right thing, as it pertains to their
care and comfort.

NONMALEFICENCE

★ An extension of this is the obligation to protect from harm those who cannot protect

- Fair, equitable and appropriate treatment to others.

or demand something as his/her own.
- The patient has the right to receive all necessary information concerning dx and
treatment in order to be able to give consent based on his/her value system
- Informed consent: refers to knowledge or information about and the consent to a
particular form of medical treatment before the treatment is administered. To agree or
disagree to the procedure that will be performed.

2. Disclosure - refers to the content of what a patient is told or informed about during the
consent negotiation.

1. Necessary information

3. Preparation for moral decision

Comprehension - refers to whether the information given has been understood or not.
Patient was not pressured by anyone else.

Voluntariness - Consent must be voluntary


Voluntariness Includes:
1. Freewill
2. Free from pressure
3. Preparation for moral decision

Methods of obtaining these informed consent:


1. Written - A consent to be filled out and signed by a patient as he/she checks in for
admission in a hospital
2. Verbal - Is usually made after a physician has briefed the patient about the medical
process to be undertaken.
3. Third Party - In case the patient is incapable of giving consent, in order of priority
may give consent: spouse, either parent, immediate relatives, guardian
Other forms of consent:
1. By presumption
- This is reasonably presumed to be present in the subsequent employment
and series of procedures as they are aligned with the primary procedure to
which explicit consent is expressed
- Opt-out system, immediate family is not present, doctors can sign
2. By Proxy
- This is done when the patient is not capable of giving informed consent and is
legitimately represented by a competent surrogate who accts on his behalf.

Stewardship

Roles of Nurses as Steward

Moral Principles
1. Golden Rule - Do to others as you would have them do to you
- So whatever you wish that others would do to you, do also to them.
- Came from the book of Matthew 7:12
- From the medical perspective, the principle of totality would mean that “ all
the parts of the human body, as parts are meant to exist and function for the
good of the whole body, thus naturally subordinated to the good of the whole
body. The term “totality” points to the duty to preserve intact the physical
component of that integrated whole.

2. The Principle of Totality- The whole is greater than its parts.


- Individual acts in nursing care when put together , do good for the wholeness
of the person.
- The existence of its parts indicates the existence of the whole
- It provides that it be removed and sacrificed for the sake of the whole
- Thomas presents three types of ends or final causes for the parts as a whole.
The first is the particular activity to which the individual part is oriented; for
example , the eye is for seeing; the second considers the function as in
operation, a minor (less important) part gives service to a more important
part. For instance, the veins serve the heart in the cardiovascular system.
Third , “the final cause of all the parts is the perfection of the whole that they
comprise. These includes a person’s universal wellbeing

3. Epikia or “Epikeia” - There is always an exception to the rule.


● The reasonable presumption that the authority making the law would not wish
to bind a person in some particular case, even though the case is covered by
the letter of the .
● Example: Restraints: Civil Law, for instance, forbids a nurse to put a patient in
restraints on her own authority. However, a disturbed patient becomes
dangerous, and no doctor is contacted for a prolonged period of time. She
might, by virtue of epikeia, use restranon the emergency.
○ Document time, date, what did the patient do, what did you as a nurse
do, observed behavior.
○ Call and inform the physician and charge nurse

4. The one who acts through as agent is herself responsible- The instrument to a
crime is part of the crime.
- An act done cannot be completed by one person. Any person who becomes a
part of what was done, regardless if it is small, is part of the act.
● For example: A nurse, knowing contraception is immoral but wishing to give
advice and encouragement to a friend in this matter, asks another nurse to
give the advice so that she will not be doing anything wrong. This nurse is
responsible by acting through a third party as her agent.
● A patient wants to have an abortion and asks a nurse if she can do it. The
nurse refuses, but then recommends a doctor who is capable of performing
an abortion. The nurse becomes liable to such crime, since he/she is an
accomplice of the said doctor.
5. No one is obliged to betray herself - You cannot betray yourself. Say only what you
can say.
- When you testify before a court, no one can force any person to answer a question
● Ex. the right to remain silent until mandated by court

6. The end does not justify the means- The method is as important as the goal.
- one common fallacy of the present day’s moral thinking is that if we have a good
purpose in mind, then whatever steps we take to accomplish that purpose is justified.
● For example: A family that thinks a patient’s tranquility will be disturbed if he
realizes he is dying and tells him a lie as to his physical condition is doing
wrong.
- It is wrong for a doctor to administer a lethal dose of drugs to a
patient in order to terminate his suffering and eliminate financial burden on the
family.

7. Defects of nature may be corrected


➔ Given the proper means and resources we may be able to repair a natural defect.
➔ Patients with a cleft palate may have their defects corrected by plastic surgery.

What shall be the role of the nurse in a case in which parents of a severely deformed
newborn child (Down’s Syndrome with intestinal atresia) refuse to feed and allow their child
to starve to death?

➔ Withholding nutrition can constitute nursing neglect and expose the nurse to criminal
charges of negligence or conspiracy to commit suicide.

8. If one is willing to cooperate in the act, no injustice is done to him


➔ The method is as important as the goal.
Example: Suppose a patient subjects himself/herself willingly to an experimental drug and
he/she has been told of the possible effects of the same, is of right age, and is sane, there is
no violation of human rights.

9. A little more or a little less does not change the substance of an act.
➔ The act defines itself not the “amount”.
Example: If a nurse gets medicine from a hospital stock without permission or without
prescription, he/she will be guilty of theft even if he/she got only one tablet of the same.

10. No one is held to impossible


➔ Not a false promise
➔ The nurse should not give false assurance
Example: To promise that a patient with heart transplant will live may be an impossibility.
Yet, such procedures are done in the hope of saving or prolonging a patient’s life. The doctor
or the nurse cannot be held to the impossible if they have done their best to take care of the
patient and the latter dies.
ETHICO - MORAL RESPONSIBILITY OF NURSES

Principle of Totality and its integrity.


- These principles dictate that the well-being of the whole person must be taken into
account in designing any therapeutic intervention or use of technology.
- Therapeutic procedures that are likely to cause harm or undesirable effects can be
justified only by a proportionate benefit to the patient.
- Except to save life itself, the fundamental functional capacity which constitutes the
human person should not be destroyed but preserved, developed, and used for the
good of the whole person and of the community.
- On one side, this principle grants priority for some human values over others and on
the other side, this principle of totality breaks the fundamental integrity of human
person for certain kinds of work except in the most extreme choice between life and
death.

TOTALITY
Refers to the duty to preserve intact the physical component of the integrated bodily
and spiritual nature of human life.
- Whereby every part of the human body exists for the sake of the whole as the
imperfect for the sake of the perfect
- Reveals the good of the whole person.
- For instance, the principle of totality justifies living organ donation and
transplantation.
- Organ transplantation is justified when the functional integrity of the donor is
maintained. Organ transplants are permissible as long as the life of the donor
is not placed at risk.
- Functional integrity - the ability of the body to function in a healthy manner.

To promote human dignity in community, every person must develop, use, care for,
and preserve all of his or her natural physical and psychic functions in such a
way that…

a.) Lower functions are never sacrificed except for the better functioning of the whole
person and even then with an effort to compensate for this sacrifice.

b.) The basic capacities that define human personhood are never sacrificed unless
this is necessary to preserve life

For example, the principle of totality would justify the amputation of a gangrenous
limb, because the person could die if the gangrene spreads.

Conditions:

1. That the organ by its deterioration in function may cause damage to the whole
organism or at least pose a serious threat to it.
2. That there is no other way than taking the indicated action against it or
obtaining the desired good result.
3. That the damage being avoided to the whole is proportional to that which is
caused by the mutilations or incapacitation of the part.

- This principle of totality does not apply to moral organization (family, society, and
humanity), a person is still independent. He is not a subordinate to any group. He is
the subject, and end of all social institutions.

INTEGRITY
Refers to each individual's duty to preserve a view of the whole human person. In
which, the values of intellect , will, conscience, and fraternity are pre imminent
(supreme, very significant).
- Integrity is the state of being whole and undivided
- Example: when we assure our patients that the healthcare team is doing
everything to preserve the life of every patient.

APPLICATIONS in some SPECIFIC PROCEDURES

A . SURGERY

● Is a medical or dental procedure that uses operative manual and instrumental


techniques on a person (1) to investigate or treat a pathological condition
such as a disease or injury, (2) to help improve bodily function, appearance,
or (3) to repair unwanted ruptured areas.

The Registered Nurse (RN) has ethical and moral responsibility to represent the
patient's interests, to respect and protect the patient's autonomy and preserve the
patient's dignity (ICN, 2013).

The Principle of Totality Applied in Surgery


If a patient who has cancer of the uterus submits to hysterectomy, she will not
be able to bear a child. If she does not have the operation, she will die. It is
the gynecologist’s intention to help the mother and not to harm her. The
surgeon’s action is morally good since saving the mother’s life is of primary
importance. Also, the doctor did not will that the patient lose her child-bearing
function.
- Based on a scientific medical basis, the only way to preserve life in this situation is
through surgery or TAHBSO.

B. MUTILATION
● Refers to the procedure that diminishes or destroys the functional integrity of the
human body.
● Cutting off or causing injury to a body part of a person so that the part of that b ni ody
is permanently damaged, detached, or disfigured.
● An act or a chance of destroying , removing, or severely damaging part or other body
parts of a person or a limb.

2 TYPES OF MUTILATION
1. MAJOR MUTILATION
➔ Refers to the procedure that destroys the functional integrity of the human body so
that it becomes incapacitated of its natural functions. This may also be done in
means of surgical procedures.

2. MINOR MUTILATION
➔ Refers to the procedure that diminishes but DOES NOT destroy the functional
integrity of the human body. For instance, circumcision or tooth extraction.
➔ Clitoris are cut off

Functional Integrity
➔ It is the degree of completeness necessary for the performance of functions to the
human body.
➔ Ability of the body to function in a healthy manner.

3 CONDITIONS ON SURGICAL REMOVAL OF A HEALTHY ORGAN THAT IS MORALLY


ALLOWED:

1. That the preservation or functioning of a particular organ provokes serious damage


or constitutes a threat to the whole body .
2. That the damage cannot be avoided or at least notably diminished, EXCEPT by the
amputation or mutilation in question and that its efficacy is well assured.
3. That it can reasonably be foreseen that the negative effect will be compensated by
the positive effect, exclusion of damage to the whole body, mitigation of the pain etc.
- Positive effect is greater than the negative effect.

Organ Transplant
- Surgical operation where a falling or damaged organ in the human body is removed
and replaced with a new one

Graft
- It is the process of removing tissue from one part of a person’s body (or another
person’s body) and surgically re- implanting it to replace or compensate for damaged
tissue. Grafting is different from transplantation because it does not remove and
replace an entire organ, but rather only a portion.

Case Scenario
Janet sat alone in her hospital room with her covers drawn up under her chin. She stared at
a blank television screen and rolled over in her mind fragments of the doctor’s words. Liver
damage. Irreparable. Transplant. She tried to shut her eyes to the question that was trying to
force its way into her thoughts. Powerless to hold them back any longer, the words came
out. “Why me?” Tears welled and fell down her face, but they did not provide comfort.
The Transplant Process
When a person falls ill because one of his or her organs is failing, or because the organ has
been damaged in an accident or by disease, the doctor first assesses whether the person is
medically eligible for a transplant. If so, the doctor then refers the individual to a local
transplant center. The transplant center evaluates the patient’s health and mental status as
well as the level of social support to see if the person is a viable candidate for an organ
transplant. If the patient is a transplant candidate a donor organ must be found.

There are two sources for donor organ


- Cadaveric organs - Organs taken from recently deceased people
- Living Organ - living organs are often related to the patient, but that is not always
the case. Spouses and close friends frequently donate organs to ailing loved ones.

Living people who wish to donate their organs can donate in two ways:
- Donate one-half of a paired organ set.
Example: Kidney
- Donate a portion of an organ that will still be able to function without it.
Example: A portion of the liver.
Example: A lobe of the lun

C. STERILIZATION
➔ Refers to any technique that renders one sterile or unable to exercise the power to
reproduce during the sexual intercourse

TYPES OF STERILIZATION

1. VOLUNTARY OR DIRECT STERILIZATION


➔ A person wills and requests that the procedure be done on him/herself.

2. INVOLUNTARY OR INDIRECT STERILIZATION


➔ It is done by the order of a public authority or a state.

3. THERAPEUTIC STERILIZATION
➔ The removal or a portion of a reproductive organ to save one's life or to
promote bodily integrity.

4. CONTRACEPTIVE STERILIZATION
➔ Intentional prevention of conception through sterilization.

5. EUGENIC AND SOCIAL STERILIZATION


➔ Are performed to hinder the conception and undesirable and physically and
mentally unfit offspring.

6. PUNITIVE STERILIZATION
➔ Is a form of penalty or punishment usually ascribed to sex related crimes

Benefits - It's not only a person's data that is easy to acquire, but Google has also made it
easier for everyone to learn and search for things
Challenges - Misinformation Can easily spread. Patients nowadays can easily search their
symptoms or research about a subject which leads some to just self-diagnose and don't get
immediate treatment. Also misinformation about certain medications and vaccines which is
of course, potentially dangerous.

4. DISTANCE WORK AND SCHOOL FROM HOME


Benefits - Attending classes or meetings through Zoom or Microsoft Teams has been the
new classroom. It made us more creative and forced us to work smarter.
Challenges - It has become more stressful because there is now no boundary between
school, work and home. Most people right now report fatigue of being online almost 18 hours

Benefits - Technologies help us keep track of our health. Tele-health or E-Health provides

Benefits - A large like a terabyte of information can be hand carried. It saves space as well.
Digital information is also easier to find, all you need is a search bar and a click of a mouse.

and another doctor can see his input in real time from another venue. Easy data transfer and
passing it on to another health care worker.
Challenges - Personal data nowadays is very attractive to hackers. There have been
multiple cases wherein big companies, even Facebook, experienced a data breach. It has
been said that these stolen personal data are being sold online in the deep web for who
knows what purpose! If your computer gets wet and if you didn't back up your data, it could
be gone in a flash especially in cases wherein it gets wet or a virus corrupts it.

1. Clinical trials should be conducted in accordance with ethical principles that have
their origin in the Declaration of Helsinki, and that are consistent with GCP and the
applicable regulatory requirement(s).
2. Before a trial is initiated, risks and inconveniences should be weighed against
anticipated benefit for the individual trial subject and society.
3. The rights, safety and wellbeing of the trial subjects are the most important
considerations and should prevail over interest of science and society.
4. The available non-clinical and clinical information on an investigational product
should be adequate to support the proposed clinical trial.
5. Clinical trials should be scientifically sound, and described in clear, detailed protocol.
6. A trial should be conducted in compliance with the protocol that has received prior
institutional review board (IRB)/ independent ethics committee (IEC)
approval/favorable opinion.
7. The medical care given to, and medical decisions made on behalf of subjects should
always be the responsibility of a qualified physician or, when appropriate, of a
qualified dentist.
8. Each individual involved in conducting a trial should be qualified by education,
training, and experience to perform his or her respective task(s).
9. Freely given informed consent should be obtained from every subject prior to clinical
trial participation.
10. All clinical trial information should be recorded, handled, and stored in a way that
allows its accurate reporting, interpretation and verification.
11. The confidentiality of records that could identify subjects should be protected,
