IN THE MAGISTRATE COURT x x x WILLIAMSON COUNTY, TEXAS. ‘COUNTY OF WILLIAMSON FELONY COMPLAINT i IN THE NAME AND BY AUTHORITY OF THE STATE OF TEXAS: ‘The undersigned Affiant, who after being duly sworn by me, on oath, makes the following statement. My bale! ofthe freging statements based upon Personal Knowiedge ; information provided to me by _, a credible persén who personally observed or gathered such | information |Lhave good reason to believe, and do believe, that Jimmy Allen Tschoerner, on or/about the 25" day of February, 2020, and before the making and fling of this complaint, in Georgetown, Williamson County, Texas, id there and then knowingly or intentionally commit the offense of Murder PC 19.02(c) F1 |, Detective Kirby Shoemake, being duly sworn, do state upon my oath that | have good reason to believe, | do believe, and I charge heretofore, that before the fling ofthis complaint, Jimmy Allen Tschoerner, on or about the 25" day of February, 2020, in Georgetown, Williamson County, Texas, did then and there, intentionally and. knowingly cause the death of an individual, Harvey Ruell Huber, by striking him with an object multiple time. Through the course of an investigation, the Affiant has learned the following facts: 1. On February 26, 2020 Affiant was dispatched to Huber Auto Repair, 2524 N. Austin Avenue, Georgetown, Williamson County, Texas in reference to a missing person who was identified as Harvey Ruell Huber (WIM DOB 07/21/1969). 2. Affiant leamed though several witnesses that Harvey Huber was last seen on the evening of February 25, 2020 at his shop, Huber Auto Repair. 3. Affiant discovered through interviews with Melissa Crawford-Huber ‘re Joshua Northeut, that Harvey Huber had remained at his shop after work on February 25, 2020, and several of Harvey Huber's friends had stopped by, which was normal. Affiant discovered that Harvey Huber was drinking an alcoholic beverage, along with several othet individuals who were at his shop visiting him. Affiant learned that some of the individuals who were present at Huber's shop were, Mike Sills, Dan Adams, Jimmy Allen Tschoeiner, and Joshua “Josh” Northcut. 4. Affiant leamed from Melissa Crawford-Huber that at some point during the evening of February 25, 2020, Josh Northcut argued with Harvey Huber. Jimmy Tschoerner was also present for a short while during the argument but then reportedly departed, Harvey Huber was allegedly cursing and yelling at Josh Northcut and, at one point, came face to face with him. Josh Northcut alleges the argument was about religion. 5. Josh Northcut told me that Harvey Huber told Josh Northcut to “get|the fuck out of here” and that Josh Northcut departed the location. Josh Northcut said he crdsed Austin Avenue and then walked south on the sidewalk (which is on the west side of the foadway). Josh Northcut then walked to the Chevron located at 221 FM 971, Georgetown, Texas 78626. Josh Northout said while he was walking to the Chevron, he called Melissa Crawford-Huber to teli Warantnumbor__§M0-BN- AL her about the argument. Affiant spoke to Melissa Crawford-Huber, and she also advised that the learned from Josh Northcut about the argument, 6. Josh Northout told Melissa that he wanted to speak with Jimmy Tschoemer. Affiant discovered digital evidence from Jimmy Tschoemer’s consensual phone extraction to show that Melissa Crawford-Huber texted Josh Northcut’s contact information to Jimmy Tschoerner. Affiant observed digital evidence from Jimmy Tschoerner's consensual phone extraction to reveal a phone call from Jimmy Tschoemer to Josh Northcut on February 25, 2020 at 9:18 PM. The call lasted 3 minutes 39 seconds. 7. Affiant observed U-Wash-M Video surveillance that captured Jimmy Tschoemner departing the clothes washing business at 9:21 PM (U-Wash-M is located at 1103 S. Main St. Georgetown, TX 78626). Affiant then observed video surveillance from the Georgetown High ‘School, which is located at 2211 N. Austin Ave, Georgetown, TX 78626. The video suneillance from the Georgetown High School showed a flatbed! wrecker truck traveling northbound on Austin Ave at 9:34 PM. Josh Northcut told me that shortly after he had spoken to Jimmy Tschoermer on the phone, he observed a white T..P. Tow truck traveling North on Austin Ave. Josh Northcut said that it continued driving North passed Huber Auto Repair. 8. Melissa Crawford-Huber advised me that she had spoken to Jimmy Tschoemer on February 25, 2020 before texting Jimmy Tschoerner Josh Northcut's phone contact and that she had told Jimmy Tschoerner about the argument between Josh Northcut and Harvey Huber. Josh Northcut said to me that Jimmy Tschoerner was present at Huber Auto Repair when the argument began but then departed after it started 8. Affiant learned from Detective Sarah Lewis that she observed video surveillance from the Georgetown High School on February 25, 2020 that showed a fldtbed tow truck pull up to Huber Auto Repair and then turn off its lights at 9:47 PM. | 10. Affiant learned at 10:04 PM the tow truck lights came back on, ahd the tow truck began to back into Huber Auto Repair. 14. Affiant and Texas Department of Public Safety Texas Ranger Reid Rackley interviewed Jimmy Tschoerner and Jimmy Tschoerner stated he did return to Huber Auto Repair around the time that matches with video surveillance. Jimmy Tschoemer said to Afiant and Ranger Rackley that Harvey Huber was in the office shop. Jimmy Tschoemer described Harvey Huber as being extremely rate and ranting. Jimmy Tschoerer said that he never went into the office, nor did he have any physical altercation with Harvey Huber. Jimmy Tschoemer said he eventually departed. Jimmy Tschoemer told me that when he departed Huber Auto Repair, he closed and locked the exterior front gate while Harvey Huber was still inside. Ranger Rackley asked Tschoerner why he would lock the front entrance gate of a business, that belonged to someone else, while the owner was still inside. Jimmy Tschoerer could not provide a logical explanation. Ranger Rackley asked Tschoerner where he went after departing Huber Auto Repair, but Jimmy Tschoerer refused to tell him. Jimmy Tschoerner Kept teling Ranger Rackley to check the GPS. Ranger Rackley asked Jimmy Tschoemer to {ell him where he went after he departed Huber Auto Repair so Ranger Rackley could help Confirm that he was not involved with Huber’s disappearance, but Jimmy Tschoemer refused to tell Ranger Rackley where he traveled. 12, Affiant viewed video surveillance captured on 2/25/2020, at approximately 10:45 PM, from Georgetown High School which showed a tow truck departing Huber Auto Repair and traveling East on Stadium Drive. Warrant Numbor Ye a \ 13, Affiant viewed video surveillance captured on 02/25/2020 at 10:54 PM from a local business (which is near T,|.P, Tow wrecker service) that captured a white flatbed wrecker that is traveling southwest on Industrial Park Circle in the direction of North Bound 1H 35 frontage road. The video depicts an object on the back portion of the flatbed wrecker, which is consistent in size with being a human corpse. 14. Surveillance from another business near the business described in paragraph 13 also ‘shows a flatbed wrecker with an object on the back. This particular video shows an object that is consistent with being a tarp that is flapping in the wind and covering what appears to be an object that is consistent in size with a human corpse. | 16. Affiant learned from Josh Northout that on February 26, 2020, he noticed a large brown and silver tarp that had previously covered a Honda sedan was missing from Huber Auto Repair. Affiant observed that the Honda, which had the missing tarp, was parked near the front of the business, close to the shop office. Affiant also discovered remriants pieces of brown and silver tarp next to the Honda that was reported to have a missing tarp. 16. Affiant learned that Jimmy Tschoerner was employed by T.1.P Tow Wrecker and that the owner, Trey Hamons, had told me that Jimmy Tschoerner was working and that he was operating a white flatbed tow wrecker. Affiant learned that the white flatbed tow wrecker that Tschoerer was operating had a license plate number of T0584H, Affiant had the wrecker analyzed by a Williamson County Crime Scene Technician who discovered bloodstains on the back and side of the tow wrecker that Jimmy Tschoerer was dperating on February 25, 2020. The bloodstains showed a presumptive positive for human blood. 17. Jimmy Tschoemer's cellular phone was analyzed. Data from Jimmy Tschoerner’s mobile Phone is voluminous. Some of the data shows that on February 25, 2020 and February 26, 2020, Jimmy Tschoemer was at Huber Auto Repair, T.I.P. Tow Wrecker, and a location on the side of highway IH 35, southbound, at a private property entrance, that has an address of 3001 N. IH 35, Georgetown, Texas 78628. These are just threb of the vast multitude of locations discovered. However, the third location described is a private property entrance. There is a tunnel entrance directly under this private driveway. Texas Department of Public Safety Texas Ranger Reid Rackley traveled to this tunnel entrance on March 2, 2020 based upon the evidence gathered during the investigation. Ranger Rackley arrived around 6:00 AM. Ranger Rackley observed the tunnel to be large and constructed of mainly concrete, and nearly square. The tunnel is large enough for Ranger Rackley to walk in without having to bend down. The tunnel is long, approximately 300 yards. Ranger Rackley walked the entire length of the tunnel. Ranger Rackley observed a sizable brownish stain at the entrance to the tunnel that caught his attention. Ranger Rackley arranged! for a Williamson County Crime Scene Technician (Janet Boring) to travel to the location and conduct a field test of the stain. Janet Boring told Ranger Rackiey the stain showed Presumptive positive for human blood. | 18, Ranger Rackley reviewed Jimmy Tschoerner's cell phone extraction data and confirmed the GPS coordinates from the forensic extraction of Jimmy's Tschoemer's cell phone verified Jimmy Tschoerner's phone was near 3001 North IH 35, Georgetown, Williamson County, ‘Texas, on February 26, 2020 at 3:01 AM. On February 26, 2020, at approximately 2:58 AM, the Georgetown Police Department requested tow service at 706 Garden Meadow, Georgetown, TX 78628. The Georgetown Police Department call detail records confirm Jimmy Tschoemer responded to the location and arrived at 3:08 AM. The records also confirm Jimmy Tschoerner completed the tow service at 3:38 AM. | Warrant Number (ANY Wl Z 19. Ranger Rackley processed the crime scene at 3001 North IH 35 with other Texas Rangers. The Texas Rangers discovered and collected multiple bloodstains. The Texas Rangers found and collected evidence that is consistent with being dried bloodstains. The Texas Rangers found and collected two items that are consistent with human bone. One of the bone pieces looked fresh and had ants on it. Ranger Rackley's first impression when he ‘observed it, was that it was a piece of a human skull 20, ‘The Texas Rangers discovered and collected at least two pieces of tarp fragments near the tunnel entrance. The particles were brown on one side and silver on the other. The tarp fragments appeared consistent with the tarp fragments that were discovered next to the Honda sedan that was found at Huber Auto Repair. 24. While Ranger Rackley was processing the tunnel scene location, Jimmy Tschoemner drove past the crime scene on the southbound IH 35 frontage road 22. At the crime scene located at 3001 IH 35 North, Ranger Rackley observed multiple pieces of evidence in a pattern that indicated a heavy object was unloaded on the driveway, drug across a metal guardrail, drug down a concrete embankment, and into the drainage tunnel. The evidence created a discernable route that was marked by smeared bloodstains, dried or coagulated blood, drag marks, bone fragments (later determined to be human skull fragments), and pieces of a tarp. The appearance of the tarp fragments was consistent with type reportedly missing from Huber Automotive and described to Ranger Rackley by Josh Northcut. Inside the tunnel was a larger area of bloodstains. Ranger Rackley observed the evidence to be consistent with the flatbed tow truck being backed into the driveway at the crime scene and the corpse being unloaded from the right rear of the vehicle (where blood evidence was located) and drug across the guardrail. Ranger Rackley also observed the crime scene to be indicative of a human corpse with a traumatic head injury and wrapped in a tarp being drug down the embankment and into the tunnel where the corpse then remained for some time. 23, Additionally, Ranger Rackley observed a circular impression in fn area of dirt inside the tunnel near the large bloodstain. The impression is consistent with a 5-gallon bucket being placed at the spot and having sufficient weight to make an impression. Georgetown Police Officer Wesley Earnshaw stated he had seen Jimmy Tschoerner on multiple occasions riding ‘@ moped around Georgetown, and Jimmy Tschoerner commonly uses 5-gallon buckets attached to the moped to transport various items. 24, On March 3, 2020, Georgetown Police Detective Michae! Mortis took custody of the two pieces of suspected bone fragments that were collected from the tunnel crime scene. Detective Morris traveled to San Marcos and met with Doctor Daniel Wescot, who is the Director of Forensic Anthropology at Texas State University. Dodtor Wescot reviewed the two pieces of the bone fragment, which were labeled evidence items two and nineteen. Doctor Wescot advised, "The two fragments associated with Geotgetown PD report 2020- 057-017 are consistent in thickness and morphology with a human skull. Item #19 includes a small portion of a cranial suture — probably the parietomastoid suture near asterion. The anatomical location of Item #2 was not determined, but its morphology and size are consistent with Item #19. The fragment edges indicate trauma, bul trauma analysis was not conducted at this time.” 25. Affiant reviewed Jimmy Tschoerner’s cell phone data which placed him in the rear area of Huber Auto Repair on February 25, 2020 at around 11:45 PM. Affiant and Ranger Rackley checked the area on March 6, 2020 and located a disabled and abandoned recreational vehicle RV in the back of Huber Auto Repair. Affiant observed several pieced of metal panels ‘on the ground in front of the door to the RV. Affiant also located a large pile of metal panels stacked about 25 feet to the North from the RV. Affiant also remember Josh Northcut had mentioned that metal panels were located outside the RV when they were not there before. Affiant moved the metal panels that were outside the RV and observed the ground was stained, it appeared to be dark red or brown in color. | 26. Affiant and Ranger Rackley then examined the exterior of the RV and discovered bloodstains to the left of the door. Bloodstains were also located on the stairs and on the Panel that is located to the right of the stairs. Ranger Rackley processed the crime scene with Affiant’s assistance. Based upon evidence gleaned at th¢ RV location and other available evidence, Affiant believes the RV crime scene is consistent with the location of Huber's death. 27. During the course of this investigation, Ranger Rackley discoverdd that Jimmy Tschoerner has been having an ongoing sexual relationship with Melissa Crawford-Huber. Affiant and Ranger Rackley knows this because both Jimmy Tschoerner and| Melissa Crawford-Huber admitted to me that they had been involved in this sexual relationship, Melissa Crawford- Humber stated that it has been going on since approximately May pf 2019. Ranger Rackley observed text message conversations between Jimmy Tschoerner and Melissa Crawford- Huber. A few samples of the conversations are as follows. Melissa Crawford-Huber says to Jimmy Tschoerner, “he’s gonna use my phone in a bit, so don't text me; | will let you know when i's ok.” On February 14, 2020, Jimmy Tschoemer text Melisa Crawford-Huber, “call me when you leave love on the regular phone.” On February 14, 2020, Jimmy Tschoerner text Melissa Crawford-Huber, “Happy Valentines to you too babe | love you, babe.” On February 14, 2020, Jimmy Tschoerner texts Melissa Crawford-Huber, “I'm headed to the tunnel now." On February 16, 2020, Melissa Crawford-Huber texts Jimmy Tschoerner, “Love you." On February 20, 2020, Melissa Crawford-Huber texts Jimmy Tschoemer four Photographs of herself. On February 21, 2020, Jimmy Tschoemey texts Melissa Crawford- Huber, “ Cn you delete all the rest of those snap chats other than yours.” On February 24, 2020, Jimmy Tschoemer texts Melissa Crawford-Huber, “I got to go cash those two checks and then when | get done at the bank I'll come back by and get you some love you,” Jimmy Tschoerner then sends a heart emoji, and Melissa Crawford-Huber responds “ok thanks.” On February 25, 2020, at approximately 3:30 PM, Melissa Crawford-Huber texts a photograph to Jimmy Tschoerner that depicts both Melissa Crawford-Huber and Jimmy Tschoerner together ( this photograph was sent to Jimmy Tschoerner about seven hours before the last known time that Harvey Huber was known to be alive). | have embedded below the picture that | just described, 28. The morning after (February 26, 2020) Harvey Huber disappeared, Melissa Crawford-Huber traveled to meet with Jimmy Tschoerner. Melissa Crawford-Huber told Affiant she met with Jimmy Tschoemer on South Bound IH 35 near American Fence & Supply around 8:15 AM. She described the meeting location as a driveway entrance off to the side of the roadway. A review of digital location evidence shows Jimmy Tschoerer on the side of the road on South Bound IH 35 near the exact location that Melissa Crawford-Huber described to Affiant. The time that the digital evidence shows Jimmy Tschoerner at this logation is at 8:19 AM. The GPS coordinates of Jimmy Tschoerer’s cellular phone when he is meeting Melissa Crawford-Huber is 30.690607 1358566 -97.6573464155603. The approximate location from where the above-referenced meeting location was to the entrance of the tunnel previously described in this affidavit is approximately 184.4 meters. Ranger Rackley used draftlogic.com to obtain this approximation ! 29, Affiant and Ranger Rackley spoke with John "Trey" Hammons, owner of T.1.P. tow in reference to a conversation he had with Jimmy Tschoemer on February 28, 2020. Trey Hammons stated he also recorded the conversation. Trey Hammons stated Jimmy Tschoermer told him “without a body and without a weapon, they cannot charge anybody with murder.” 30. Affiant learned from Jimmy Tschoemer's friend, Eddie Trevino, that Jimmy Tschoerner had buckets buried around Williamson County. Eddie Trevino described the location of the buckets as under the IH 35 bridge just North of Hwy 195 near several concrete pillars. Affiant warrant Number ENC AD-ANA located the buckets, and after inspecting the contents of the buckets, discovered that they contained rocks and water. 34. Affiant and Ranger Rackley conducted a follow up interview with Eddie Trevino on March 13, 2020. Trevino explained that he knows about the situation with Jimmy Tschoerner and Harvey Huber. Eddie Trevino stated that Jimmy Tschoemer killed Harvey Humber. Eddied Trevino further explained on Sunday, Marcy 1, 2020, Jimmy Tschoemer had come over to his apartment and had dinner. After dinner Eddie Trevino stated Jimmy Tschoemer went outside and sat in Eddie Trevino's car where Jimmy Tschoemer told Eddie Trevino Harvey is not a problem anymore. 32, Eddie Trevino further stated Jimmy Tschoemer told him "I killed him". Eddie Trevino said Jimmy Tschoerer explained to him that Harvey Huber and Jimmy Tschoerner were in the tow truck and they were doing something or looking for something. Harvey Huber bent over, and Jimmy Tschoerner hit him in the head with a hatchet. Eddie Trevino then said Jimmy Tschoerner put Harvey Huber on the back of the tow truck and took Harvey Huber to the drainage ditch. 33. Eddie Trevino said he asked Jimmy Tschoemer why and Jimmy Tschoerner responded because he could not stand Harvey Huber disrespecting his wife anymore, Eddie Trevino said Jimmy Tschoerner further talked about Melissa refusing to leave Harvey Huber and how Harvey Huber beat and insulted Melissa Crawford-Huber. 34, Eddie Trevino further spoke to Affiant and Ranger Rackley about how Jimmy Tschoerner disposed of Harvey Huber's body. Eddie Trevino stated after Jimmy Tschoerner hit Harvey Huber in the head with a hatchet, he placed Harvey Huber on the back of the tow truck and covered Harvey Huber with a tarp and tires. Jimmy Tschoerner then drove Harvey Huber to the drainage ditch where Jimmy Tschoerner “yanked” Harvey Huber off the back of the tow truck and drug him down to the drainage ditch where Jimmy Tschoemer dismembered Harvey Huber. Eddie Trevino motioned at the locations of the body were Harvey Huber was dismembered (waist, the arms, and the neck). 36. Paragraph #34 reveals information that Trevino provided to the Affiant and to Ranger Rackley regarding Huber’s body being concealed on the back of Tschoemer’s tow truck with a tarp and with tires. Prior to learning this, the Affiant and Ranger Rackley were unaware of Huber’s body being concealed by tires. Ranger Rackley began reviewing further surveillance video and discovered recorded video footage that did indeed show|what appears to be a tire stacked on top of the tarp on the tow truck believed to be transporting Huber's corpse. 36. Eddie Trevino further told Affiant and Ranger Rackley who Jimmy Tschoerner put Harvey Huber's dismembered body in commercial grade black trash bags and disposed of Harvey's dismembers in several unknown dumpsters. 37. Ranger Rackley reviewed Jimmy Tschoerner's cell phone data which shows Jimmy ‘Tschoemer’s phone was near 806 N. Austin, Georgetown, Texas (McDonald's), on February 26,2020 at 12:52 AM. 38. Ranger Rackley collected surveillance video from the Valero, 700 N. Austin Ave, Georgetown, Texas which captures a white tow truck driving on Spring Street next to the McDonald's and driving through the BBVA Compass Bank parking lot, 10 Spring Street, Georgetown, Texas, | 39. Ranger Rackley also collected additional surveillance video from the Valero shows the tow truck pull into the BBVA Compass parking lot and stop on February 26, 2020 at 2:50AM and again at §:07AM. The location the tow truck pulls in is next to the McDonald's trash dumpster. 40. Ranger Rackley checked area where the tow truck stopped in the parking lot and discovered a non-gated side entrance to the McDonald's trash dumpster. Warrant Number Kan Ay \AVY 44. Affiant reviewed Jimmy Tschoerner's cell phone which placed him near Walmart, 620 S. |H 36 Georgetown, Texas on February 26, 2020 at 6:34AM. | 42. Affiant reviewed video surveillance video from Walmart which show Jimmy Tschoerner entering the store at 6:42AM. AMfiant obtained the purchase receipt which shows Jimmy Tschoerner purchased 6 pants and a quilt. 43. Affiant requested the skeletal remain recovered from the drainage site and a swab from the blood stain on the tow truck be sent off for DNA testing. Affiant collected a buccal swab from Harvey Huber's children, Shelby Garcia and Phillip Huber, for comparison. The samples were sent to Bode Technology for processing. 44, Affiant received a report from Bode Technology after they Nad examined submitted evidence. Bode Technology reported the skeletal remains is/consistent with a male contributor based on the nuclear DNA testing at 22 of 22 loci_and the skeletal remains is greater than 99,999% related to Shelby Garcia and Phillip Huber, Bode Technology also reported that the sample from the tow truck is consistent with a male contributor based on the nuclear DNA testing at 18 of 22 loci and the tow truck sample's greater than 9.999% related to Shelby Garcia and Phillip Huber. 45. Based upon the blood patterns, the piece of a human skull, the amount of bloodstain observed, and other previously mentioned evidence, | believe that Harvey Huber is deceased, There is a possibility that at the time of the meeting between Crawford-Huber and Tschoemer, the bulk of Harvey Huber's remains were still in the tunnel, just inside the entrance. Crawford-Huber advised me that when she met with Tsthoemer, he told her that he had already been to Huber Automotive and that Harvey Huber was missing 48. While interviewing Tschoerer, he told me that he told Crawford-Huber on several ‘occasions to divorce Harvey Huber but that Crawford-Huber refused to do it. Crawford-Huber told me that she would never leave Harvey Huber. 47. A criminal history check through the Texas Department of Public Safety confirms Jimmy Tschoerner is a convicted felon and was confined in the Hutchinson Correctional Facility, Hutchinson, Kansas, for Aggravated Robbery, Kidnapping, Solicitation to Murder in the 1st Degree, and Attempted Rape. ‘The case was staffed with the Williamson County District Attorney's Office and based on the statements of fact, investigation, and the totality of the circumstances, Jimmy Allen Tschoerner is being charged with the offense of Murder, which is a Felony of the 1* Degree. ‘The Affiant is a Commissioned Peace Officer for the Georgetown Police Department, Georgetown.
