OFFICE OF THE DIRECTOR OF PUBLIC PROSECUTIONS

COMMUNIQUE

A. On the 26th April 2022, following an application by one Peter Uricek, a Slovak national, the
Honourable Judge in Chambers issued an Interim Order in the nature of an injunction
prohibiting Respondents and Co-Respondents from :

(i) deporting the Applicant from Mauritius without complying with the provisions of the
Deportation Act; and

(ii) extraditing the Applicant and/or removing him from Mauritius prior to the conclusion of
the Extradition hearing (cause No 1670/2022) before the District Court of Port Louis.

B. On the 28th April 2022, the learned Judge was informed by Counsel for Applicant that his client
was taken to the airport by Police officers forcefully and he was made to board “an A 319
Aircraft belonging to the Slovak Government”.

The Learned Judge was also informed :

“ ……..Inside the parking of the Passport and Immigration Office, the police officers got out of
the vehicle …… After a few minutes a number of police officers surrounded the applicant,
manhandled him, assaulted him and handcuffed him while pushing him in the police vehicle.
The police officers then drove off with the applicant to the airport at a very high speed .”

C. On the same day, the Honourable Judge, issued an order, Uricek v The Sate of Mauritius &
Ors (SN 627/2022) referring the matter to the Director of Public Prosecutions for any action he
deems appropriate.

D. Following the Order of the 28th April 2022, the Prime Minister’s Office issued a Communique
dated 30th April 2022, whereby it stated that the Applicant was neither deported nor extradited
from Mauritius but had by notice dated 15 th April 2022 been deprived of his status of resident.
It was further stated that the removal of Mr Uricek from Mauritius was effected by the Slovakian
Authorities after Mr Uricek was handed over by the Mauritius Police. Moreover Mr Peter Uricek
was “the object of an Interpol Red Notice” and was a fugitive wanted for prosecution. He was,
in terms of the Red Notice, armed and dangerous.

The Communique mentions inter-alia:

“This office is also informed that the police have been hindered in the performance of their
lawful duties in the process of handing over Mr Uricek to the Slovakian Authorities and that
appropriate enquiries are being carried out to determine any criminal responsibility. ”

E. The DPP has therefore decided, in the exercise of his discretionary powers under Section 64 of
the District and Intermediate Courts (Criminal Jurisdiction) Act, to require the Honourable
Magistrate of the District Court of Port-Louis to proceed to inquiry and examination into any
offence relating to the circumstances whereby one Peter Uricek, a Slovak National, was
‘removed’ from the Mauritian Territory.
