PETITIONERS
PETITION UNDER SECTION 13B OF HINDU MARRIGAE ACT 1955
SIR,
The petitioner submits as under:-
1. That the marriage of the petitioner solemnized at the Distt Dehradun On 13/
Feb/ 2011 according to Hindu rights and customs. At the time of marriage
petitioner no. 1 was a bachelor and petitioner no.2 was a spinster.
2. That out of the wedlock of the parties there were no issues. The petitioner 1.
Worked in SIDCUL, Dehradun and petitioner no. 2 teach in Dehradun
university. That the parties have fraternal twins both children are girl aged
about 3 years.
3. That in view of marital discord, the petitioners had been living separately
since 12/Dec/2017. But later they got reconciled and things were optimistic
but later again they got separate in 01/Jan/2018.
4. That the petitioner had been living separately for a period of more than 1 year.
Despite reconciliation efforts they have not been able to live together so they
have finally decided to get their marriage dissolved.
5. That since it is not possible for the parties to live together as husband and
wife, so they have decided to get separate and move on in their life’s.
6. That there is no proceeding or any court case pending between the parties in
any court. Neither they are willing to file any such proceedings in near future.
7. That there is no collusion or conspiracy between the parties in filling of the
present petition.
8. That the petitioner 1 also promised to deposit the sum of rupees 50,000/- per
month and the expenses when asked by petitioner 2 for his two daughters in a
bank account that shall be jointly operated by the couple and that money
would solely will be used for the education purpose for their daughters.
9. That the cause of action for the petition arose on various dates and occasions
mentioned above and the same is ever continuing within the jurisdiction of this
learned Court.
10. That the petition is incapable of valuation. It is however, tentatively valued at
Rs 2.00 lac on which prescribed court fee of Rs 40.00 is paid.
PRAYER
The petitioners prays as follows :-
A. Marriage between the petitioner Dt. 13/Feb/201 Dissolved by decree of
divorce.
B. Any other relief, which the learned court deems fit and proper under the
circumstances of the case also awarded in favour of the petitioners.
