JUDICIAL AFFIDAVIT OF PETITIONER-WITNESS


KENNETH ADRAN SAILAN

I, KENNETH ADRAN SAILAN, Filipino, of legal age, single, with residential


address at Purok 3, Salug, Esperanza, Agusan del Sur, after having been sworn to in
accordance with law, do hereby depose and say the following, that:

PRELIMINARY STATEMENT

I am executing this complaint affidavit after having been examined by Atty.


Juderick C. Ramos at Public Attorney’s Office, Bayugan City, Agusan del Sur.

I hereby state that in answering the questions asked of me as appearing below, I


was fully aware and conscious that I did so under oath and that I may face criminal
liability for false testimony or perjury.

Q1. Please state your name, age and occupation.


A1. I am Kenneth Adran Sailan, of legal age, and a resident of Purok 3, Salug,
Esperanza, Agusan del Sur. I am a High School graduate and is still looking for a job as
of the moment.

Q2. Why are you here?


A2. To stand as a witness in the matter of Petition for Cancellation of Affidavit of
Legitimation with Registry No. 2000-146, cancellation of the remarks/annotations
found in the certificate of live birth of Kenneth Adran with registry No. 2000-594 and to
use the surname of the father RENATO P. SAILAN.

Q3. How are you related to the respondents in this case?


A3. The respondent RENATO P. SAILAN is my father while the respondent REMALYN
D. ADRAN is my mother.

Q4. Please narrated what happened to your mother’s status of marital relationship?
A4. On July 14, 1983, my mother Remalyn G. Adran contracted a marriage with a
certain Pablo Gemina before the Municipal Mayor’s Office, Bayugan City and was duly
solemnized by Hon. Vicente P. Encendencia.

Q5. What happened next?


A5. For reasons unknown to the couple, the marriage did not prosper and so they broke
up few years thereafter and separated from each other for good.
Q6. Tellme what happened after?
A6. After being separated from her husband, Remalyn G. Adran found happiness in the
loving arms of my father Renato P. Sailan, without her first marriage being terminated
and while in the highest peak of their romantic love affair, my mother Remalyn Adran
and Renato Sailan lived together as husband and wife.

Q7. So, what happened after that?


A7. The union of my parents produced children and one of them is me, also known as
Kaypee Adran Sailan, who was born on September 1, 1999.

Q8. What did your parents do after that?


A8. Believing in good faith that my mother’s first marriage with Pablo Gemida was
already terminated after being aware of the possible legal consequence in the future, on
March 10, 2000, my parents Remalyn Adran and Renato Sailan contracted marriage
before the Municipal Mayor’s Office of Mayor Deo S. Manpatilan.

Q9. What happened next?


A9. Eventually, believing in good faith that their marriage was clothed with all legalities
under the law, my parents Remalyn Adran and Renato Sailan presented their
Certificate of Marriage to the Municipal Civil Registrar of Esperanza, Agusan del Sur
and the ltter required them to execute an Affidavit of Legitimation and the Local Civil
Registrar caused the annotation /remarks at the right upper portion of my birth
certificate.

Q10. Did your father execute any affidavit regarding his paternity?
A10. Yes, sir. My father executed an affidavit of Admission of Paternity to attest the
truth that indeed, he is my biological father.

Q11. What happened after that?


A11. Recently, I went to Philippine Statistics Office to get an authenticated copy of my
birth certificate and certificate of marriage of my parents however, I was surprised that
the personnel from the aforementioned office told advised me that my mother had a
previous subsisting marriage with a man other than my father and the same was not yet
terminated.

Q12. What did you do after learning such circumstances before the Office of the
Philippine Statistics Authority.
A12. I went to Public Attorney’s Office to seek for legal help.

Q13. Do you have any thing else to say?


A13. None, as of the moment, sir.

the corresponding answers that the above-named witness gave; and

3. That neither I nor any other person present or assisting me coached the
above-named witness regarding the latter’s answers.
