1ST KIIT INTRA CLIENT COUNSELLING COMPETITION

PROBLEM OF KIIT INTRA CLIENT COUNSELLING COMPETITION

Mr. Ram was an employee of the ABC Company. From the inception he had developed
fondness and liking towards sweet and other confectionary items. His habit of eating sweet
foods transformed into an addictiveness for which he was made to pay a heavy price. His
addictiveness subjected him to frequent emiction, which propelled him to seek medical
advice in order to regulate it. But unfortunately after consulting a doctor, he was made to
realize that his problem had acquired the shape of serious ailment, and kidney transplant
was the only solution at hand so as to bring his life back to normal gear. He went under the
knife, only to learn that his disease had not yet been cured and he has been duped.
Thereafter, he decided to sue the doctors at disposal and in return demanded a
compensation amount of rupees 10, 00,000.

The following laws need to be referred for the purpose of problem:

1. Law of Contracts.
2. Civil Procedure Code.
3. Law of Torts.
4. Consumer Protection Act. And any other law that may be applicable.

RULES OF KIIT INTRA CLIENT COUNSELLING COMPETITIONS

Rule No.1: Eligibility Criteria.

 The participants will be portraying the role of Counsel in the competition


 Participants must be from 1st, 2nd, 3rd and 4th Year only.
 Participants in order to participate must make a team of 2. (Solo participation not
allowed)
 Participants from different years can team up together and participate. Such as 1year
teaming up with 2nd year or 3rd year and etc.

Rule No.2: Format of the KIIT Intra Client Counselling Competition.

 The competition will be divided in three rounds i.e. the Preliminary round, Semi finals
Round and the Final Rounds.
 Each round will contain a consultation period, post consultation period and a judge’s
question-answer round.
 4 teams securing the highest marks in the preliminary round will go to the semi finals and
top two teams of the semi finals will go to finals.
 The Preliminary and Semi final round will be of 25 minutes each and the Final round will
be of 35 minutes.

Rule No.3: Consultation, Post Consultation and Judges question-answer round.

 Consultation:
1. The consultation period will be of 10 minutes in the Preliminary round and Semi
final round and of 15 minutes in the Final round.
2. In the consultation period, client will be provided to the counsel, wherein the
counsel should elicit information from the client in order to outline the problem
and resolve the problem.
3. The client might speak Hindi or English and the counsel need to deal with them in
the clients medium of language
4. All consultation situations will be based on this topic. Each consultation, situation
however will involve a different client and a different situation.
 Post Consultation:
1. The post consultation period will be of 7 minutes in the preliminary round and
semi final round and 10 minutes in final round.
2. The teams will be given bareacts and necessary material as the organizing
committee deems fit to be given for reference to the participating teams.
3. No electronic medium can be used during the post consultation period.
4. The Counsels need to discuss their point loudly in front of the judges. The counsel
conversation should be clear and audible to the judges.
5. The team in the prelims and semi final will get 7 minutes, in those 7 minutes- 6
minutes will be for discussion with the co-counsel and 1 minute will be summing
up of points by one counsel to be presented before the court of law. (timing will
be shown by the volunteers)
6. The teams in the finals will get 10 minutes, in those 10 minutes- 8 minute will be
given for discussion with the co-counsel and 2 minutes will be for summing up of
points by one counsel to be presented before the court of law. (timing will be
shown by the volunteers)
 Judges question-answer round:
1. The judges question-answer round will be of 8 minutes in the prelims and semi-
finals and 10 minutes in the finals.

Rule No. 4: Additional Rules to be followed.

 No written submission to be done in the client counseling competition because the


arguments are to be presented on the spot.
 The competition is not revolving around a court room. It is a competition on how you
deal with client in your chamber. Also this competition there is no face off against
another team. The teams will present their case separately.
 Any discussion with the client before competition will amount to disqualification from
the whole competition.
 Actions will be taken against indecent behavior.
 In case of any problem after the competition approach Twinkle Swain (Student
Convener).
 Student who turns up late for the competition will be disqualified from the entire
competition.
 The team code and time will be confirmed and intimidated on 17th January 2018.

 The submission of hard copy to be done on 13th January 2018 at 3p.m. till 7 p.m.
in the legal aid room, to the member of the legal aid clinic so present at that
time.
