AFFIDAVIT
I, VICTORIA RABOY, of legal age, single, Filipino and a resident of Barangay Ayusan
Norte, Vigan City, Ilocos Sur, Philippines, after having been duly sworn to in accordance with law,
hereby depose and say:
1. I personally know DAVID S. HUFANA, SR., ELVIRA RACSA and ROSALINA RABOY,
the respondents in NPS Doc. No. I-14-INV-20J-0089 for FALSIFICATION OF PUBLIC
DOCUMENTS/PERJURY;
2. I personally know the land subject matter of the criminal complaint – Lot 206, Csd-1-003813
(OLT) having an area of 3,152 square meters located at Barangay Ayusan Norte, Vigan City,
Ilocos Sur;
3. I know this being a resident who grew up in the said community and later being a trusted
administrator or “katiwala” of the said parcel of land among others;
4. That this land (Lot 206) was previously owned by the late COLUMBA SINGSON HUFANA
together with the following:

5. That these lots are the remaining properties of COLUMBA SINGSON HUFANA after others
have been placed under the Comprehensive Agrarian Reform Program of the Department of
Agrarian Reform;
6. That these lots were tilled or otherwise cultivated by various farmers under the supervision of
the late COLUMBA SINGSON HUFANA;
7. After the death of COLUMBA SINGSON HUFANA, he was succeeded by his son the late
BENITO S. HUFANA, JR. a.k.a. ARNOLD HUFANA, thereafter, succeeded by DAVID S.
HUFANA, SR.;
8. Since all of them are residing in San Fernando, La Union, management over these properties
were left to a trusted administrator or “katiwala” and that includes me among others;
9. Sometime in January 2013, the various farmers tilling these lands were called for the
execution of a waiver since these lands were named after them after the conduct of the
cadastral survey when in fact they were not;
10. Christopher Raboy came on that day to represent his deceased father, ALIPIO RABOY, who
was the original tiller of Lot 206;
11. That during that time, it was already Christopher Raboy who was tilling the land and who
continued the legacy of his father as far as Lot 206 is concerned;
12. Christopher Raboy further represented that his mother cannot be present during that day
being an elderly with unhealthy condition;
13. I saw Christopher Raboy wrote his name and place his signature on two DEED OF WAIVER
OF RIGHTS1 covering Lot 206 and Lot 199;
14. I know this for a fact because I also signed said deeds as a witness;
15. I signed this counter-affidavit to attest to the truth of the foregoing and to support the
counter-affidavit of DAVID S, HUFANA, SR., ELVIRA RACSA and ROSALINA RABOY
in NPS Doc. No. I-14-INV-20J-0089.
