A BILL
To require a visit to the United States land border with
Mexico and a report thereon by any Cabinet member
appointed by the President to lead efforts related to
immigration or securing such border, and for other pur-
poses.

1 Be it enacted by the Senate and House of Representa-

2 tives of the United States of America in Congress assembled,
3 SECTION 1. SHORT TITLE.

4 This Act may be cited as the ‘‘Border Czar Account-

5 ability Act of 2022’’.

1 SEC. 2. REPORT RELATING TO VISIT TO UNITED STATES

2 LAND BORDER WITH MEXICO.

3 (a) IN GENERAL.—Any Cabinet member appointed

4 by the President to lead efforts related to immigration or
5 securing the United States land border with Mexico shall
6 visit such border at least once every 60 days.
7 (b) REPORT.—
8 (1) INITIAL REPORT.—Not later than 30 days
9 after the date of enactment of this Act, any Cabinet
10 member appointed by the President to lead efforts
11 related to immigration or securing the United States
12 land border with Mexico shall submit to the Presi-
13 dent and Congress a report describing how policy
14 changes that went into effect during the period be-
15 ginning on or after January 20, 2021, and ending
16 on the date of enactment of this Act, including—
17 (A) the effect of such policies on agents in
18 the Department of Homeland Security and local
19 law enforcement and government officials in
20 States, units of local governments, Indian
21 tribes, and territories;
22 (B) the difference in the amount of funds
23 expended in fiscal year 2021 in comparison to
24 fiscal year 2020 to address the unlawful pres-
25 ence of aliens in the United States, including
26 expenditures with respect to border security and

1 education, healthcare, and shelter for aliens un-
2 lawfully present in the United States; and
3 (C) whether funds have been transferred
4 from any executive department or agency to the
5 Department of Homeland Security for the pur-
6 pose of supporting efforts to secure the south-
7 ern border and preventing unlawful entry into
8 the United States.
9 (2) VISIT REPORTS.—Not later than 15 days
10 after each visit referred to in subsection (a), any
11 Cabinet member appointed by the President to lead
12 efforts related to immigration or securing the United
13 States land border with Mexico shall submit to the
14 President and Congress a report that includes—
15 (A) information relating to any issues ei-
16 ther observed or informed of during such visit,
17 including—
18 (i) a detailed list of the Federal
19 agents and local supporting law enforce-
20 ment officers the Cabinet member met in
21 person while on location at a facility oper-
22 ated by U.S. Customs and Border Protec-
23 tion, or at a Border Patrol Duty location,
24 at the United States land border with Mex-
25 ico;

1 (ii) trends at the border with respect
2 to demographics and group size that could
3 contribute to overcrowding of U.S. Cus-
4 toms and Border Protection facilities;
5 (iii) the negative impact unlawful im-
6 migration has had on farmers and ranch-
7 ers near the United States land border
8 with Mexico;
9 (iv) the number of aliens unlawfully
10 present in the United States who are
11 housed in the U.S. Customs and Border
12 Protection facilities, including how the
13 number has changed since the previous re-
14 port;
15 (v) the number and description of il-
16 licit drugs, weapons, and other contraband
17 obtained from aliens unlawfully present in
18 the United States by agents of the Depart-
19 ment of Homeland Security and local law
20 enforcement officers;
21 (vi) the number of unlawful points of
22 entry from which such aliens entered into
23 the United States, including how the num-
24 ber has changed since the previous report;
25 and

1 (vii) the number of aliens unlawfully
2 present in the United States who are re-
3 leased into the local community without a
4 notice to appear;
5 (B) suggestions for improvement of the se-
6 curity and situation at such border, including
7 proposals for legislation relating to—
8 (i) preventing unlawful immigration;
9 (ii) adjusting Federal resources, in-
10 cluding staffing and equipment;
11 (iii) enhancing interoperability be-
12 tween Federal, State, Tribal, territorial,
13 and local governments;
14 (iv) enhancing the processing of traf-
15 fic and commerce;
16 (v) developing procedures to more ef-
17 fectively seize and dispose of drugs, weap-
18 ons, or other contraband;
19 (vi) developing procedures to combat
20 human trafficking; and
21 (vii) developing procedures to address
22 any negative impact unlawful immigration
23 has on farmers and ranchers near the
24 United States land border with Mexico;

3 (c) SANCTION.—No Federal funds may be obligated
4 or expended by any Cabinet member appointed by the
5 President to lead efforts related to immigration or secur-
6 ing the United States land border with Mexico if the re-
7 port under subsection (b) was not submitted, until such
8 time as the report is delivered.
