there is already condusion qv th€ prlmary- authority ie. the 2"d
respordent herein in respect of thls issue. then it can be said that tlre 1d
reslrondeat i.e. the appellate authoritjr can proceed with his appellate
powerg, but here is a case where the primar,' or original authoritv is
ex€rcising his original powers under Sectioar 3 of the Act and as such it
c,umot be conduded that there is no original groceedingp pending. Had
the primary authorir;- concluded his proceedings, then the pree€nt
proceedings before the primary authoritv would not arise. As such the Ld
respondmt is not proper in taking up the appeal and calting for the
