    AN ORDINANCE REGULATING THE CURFEW HOUR OF THE RESIDENTS FROM 10:00PM


    TO 4:00 AM AT BARANGAY SAN CARLOS, VALENCIA CITY, BUKIDNON.

    Proponent: Hon. Junnie P. Gabucan

    EXPLANATORY NOTE

    WHEREAS, several persons were roaming at the Barangay during night time without any
    reasons at all, but merely creating disturbances to populace of the Barangay
    concerned;

    WHEREAS, such acts apparently affect the daily lives of the residents of Barangay San Carlos,
    having no sufficient slept and rest during nighttime;

    WHEREAS, the said ordinance will probably deter the existing commission of crime
    within the Barangay;

    NOW THEREFORE, on motion of Hon. Junnie P. Gabucan. duly seconded by Hon. Virgilio A.
    Labitad Jr. and all Sangguniang barangay members present,

    BE IT RESOLVED, AS IT IS hereby resolved, to pass an ordinance regulating the curfew hour


    of the residents from 10:00PM to 4:00Am at Barangay San Carlos,Valencia City,
    Bukidnon.

    BE IT ORDAINED by the Sangguniang Barangay of Barangay San Carlos in session


    assembled that.

    Section 1.TITLE– This Ordinance shall be known as “ AN ORDINANCE REGULATING THE


    CURFEW HOUR FOR THE RESIDENTS OF BARANGAY SAN CARLOS,
    VALENCIA CITY, BUKIDNON, FROM 10:00 PM TO 4 O’CLOCK DAWN”.

    Section 2. Scope of Application. This ordinance shall regulate the curfew hour for the
    residents roaming around the Barangay without any justifiable reasons from10:00
    P.M to 4:00A.M and likewise prescribe the penalty thereof.
    .
    Section 3. Definition of Terms. For purposes of this ordinance, the following terms are defined
    to wit.

    3.A Resident- a person who live in a place permanently or in a long term basis.

    3.B Apprehension- taking of person into custody for safekeeping and


    verification of his status in the Barangay.

    3.C Curfew- an act of regulating anybody from roaming around barangay San
    Carlos area of responsibility without any justifiable reason.

    3.D Curfew Hours- regulated hours from 10:00P.M to 4:00A.M.

    3.E Safekeeping- an act of keeping the latter secured.

    3.F Role of engagement- lawful taking of person into custody.

    Section 4. Administrative Clause.

    4.A This Ordinance shall be applied within the territorial limits of Barangay San
    Carlos.

    4.B The Barangay Officials, Purok Officials and Barangay Tanod of Barangay
    San Carlos are tasked to implement this ordinance and effect the
    immediate apprehension of violators thereof, and to provide penalty
    therein.

    4.C Copies of this Ordinance shall be published in a conspicuous public places


    and massive information drive through radio and Pulong-pulong.

    4.D Copy of this Ordinance will be submitted to Sangguniang Panlungsod of


    Valencia City, for further comment and approval.

    Section 5. Exemptions. A curfew hour is automatically lifted in time of:

    5.A Araw ng Barangay, Fiesta Celebration and other similar Barangay Affairs.

    5.B Emergency Cases.

    5.C Company Employees with night shift schedules.

    5.D Other special occasions such as Birthdays, Wedding celebrations as well


    as funeral wake.

    Section 6. Mode of Apprehension.

    6.A Barangay Officials shall maintain an official log book and properly record
    any violation thereof.

    6.B Apprehension must be in accordance with the role of engagement; thus,


    abide the law governing the apprehension of person without warrant of
    arrest.

    Section 7. Penal Clause. Any violators of this Ordinance will be penalized of:

    7.A For the 1st Offense – 300.00 pesos

    7. B For the 2nd Offense –500.00 Pesos

    7.C For the 3rd and final Offense- 1,000.00 pesos.

    7.D Barangay San Carlos will not issue barangay clearance or any certifications
    unless violators will comply the above penalty/penalties.

    Section 8. Effectivity Clause. This Ordinance shall take effect upon its enactment and
    approval.

    ENACTED.

    Ordinance which was duly approved by the Sangguniang Barangay during the 8 th Regular
    Session held on April 15, 2019.
