Notice to All Owners and/or Occupiers of Land in East Fremantle and Fremantle
Pursuant to the powers contained in section 33 of the above Act, you are hereby required on or before
30th day of November, 2010 or within fourteen days of the date of you becoming owner or occupier
should this be after the 30th day of November 2010 to clear inflammable matter from the land in
accordance with the following requirements—
(a) Land having an area of fifteen hundred (1,500) square metres or less—
Clear all inflammable matter from the whole of the land. When mowing or slashing is carried
out, the height of vegetation thereafter must not exceed, one hundred (100) millimetres over the
entire area of the land, as far as reasonably practicable as determined by the authorised
officer.
(b) Land having an area of fifteen hundred (1,500) square metres or more—
(i) Clear firebreaks of a minimum width of three (3) metres inside all external boundaries
of the land and all buildings situated on the land, by ploughing, cultivating or
scarifying; or
(ii) Mow/Slash the whole of the land. The height of vegetation thereafter must not exceed,
one hundred (100) millimetres over the entire area of the land, as far as reasonably
practicable as determined by the authorised officer.
Once installed the firebreak must be maintained up to and including the 31st day of March, 2011.
If it is considered to be impractical for any reason to clear firebreaks as required by this notice, you
may apply to the Council or its duly authorised officer not later than the 15th day of November, 2010
for permission to provide firebreaks in alternative positions on the land. If the Council or its duly
authorised officer does not grant permission, you shall comply with the requirements of this notice.
The penalty for failing to comply with this notice is a fine of not more than $5000 and a
person in default is also liable, whether prosecuted or not, to pay the cost of performing
the work directed in this notice if it is not carried out by the owner or occupier by the date
required by this notice.
NOTE: Burning is prohibited. No permits will be issued.

CHARITABLE TRUSTS ACT 1962
APPLICATION TO VARY TERMS OF TRUST
By clause 6 in her last Will and Testament dated 18 February 1998 amended by clause 7 of her first
Codicil dated 9 May 2003 Josephine Douglas McLarty late of Hollywood Senior Citizens Village
Nursing Home, Monash Avenue, Nedlands, Western Australia who died on 29 September 2004,
created a Trust for The Cottage Hospice.
The Trustees of the Trust are Peter Bernard Giles, Bruce Duncan McLarty and David Ross McLarty.
The Cottage Hospice ceased operation in March 2006 making it impossible for the Trustees to carry
out the purpose of the Trust.
The Trustees have made application to the Supreme Court of Western Australia CIV 2167/10 for
approval of a Scheme under Part III of the Charitable Trusts Act 1962.
The Scheme provides for deletion of “The Cottage Hospice” and substitution of—
“The Cancer Council of Western Australia (Inc) to be applied for the furtherance of palliative care
within Western Australia in accordance with the attached Regulations.”
The Regulations referred to in the Scheme can be inspected at Haydn Robinson, 1/23 Rheola Street,
West Perth weekdays between 9.00 a.m. and 4.00 p.m.
The Attorney-General approved the Scheme on 30 March 2010.
Date of Hearing
The Court will hear the application on Thursday 16 December 2010 at 10.30 a.m. at the Supreme
Court, Perth.
Opposition
Any person desiring to oppose the Scheme must give written notice of his intention to do so to the
Principal Registrar of the Supreme Court at Stirling Gardens, Barrack Street, Perth and to the
Trustees at C/- Haydn Robinson, 1/23 Rheola Street, West Perth and to the Attorney-General at C/-
State Solicitors Office, Westralia Square, 141 St. George’s Terrace, Perth, not less than 7 clear days
before the date of hearing.
