The Case of Sonya Gregorio and Her Son, Frank Anthony Gregorio, who were shot to

death by Police SMSgt. Jonel Nuezca

I. FACTS

a. WHEREAS, in December 20, 2020, mother and son Sonya Rufino Gregorio, 52, and
Frank Anthony Gregorio, 25, were shot dead in Paniqui, Tarlac by Police Senior
Master Sergeant Jonel Nuezca after a brief confrontation between Nuezca and the
mother-and-son tandem upon Nuezca's visit to the Gregorios to investigate who were
using bogal in the area;

b. WHEREAS, in the footage of the incident circulating online, Frank Gregorio


appeared to be inebriated and was being hindered by Sonya Gregorio from engaging
in an argument with Nuezca who was trying to arrest him;

c. WHEREAS, after a brief verbal altercation between the three, Nuezca threatened to
killed Sonya Gregorio and within a few seconds shot the woman in the head then
shot Frank Nuezca twice and then shot Sonya for a second time, in front of the
victim's family and relatives;

d. WHEREAS, Nuezca has since surrendered and been charged with double murder
and two counts of murder;

II. APPLICATION OF VIRTUE OF ETHICS

a. There are several points or issues in the news that need to be discuss thoroughly. By
evaluating the whole scenario, the issues that need to talk about are abuse of power that
results to police brutality, bringing and using of police firearms when off-duty, and the
justice system of the country. The power of the police force that are meant for protecting
lives of the innocents, serving the country and a shield against crimes and other inhumane
activity turns out to be on opposite of its purpose. The authority we sometimes seek help
and protection ends up to be someone we should not fully rely on. The power and
authority Nuezca possess is not an excuse for him to kill the innocent mother and son just
because of “boga” as part of the family’s celebration for the upcoming Christmas or their
land dispute. Why use the weapon if he can able to talk over his concerns? Why use
violence when in fact he himself is aware of such wrong deed? He is a public servant and
being angry with the situation and pull the trigger can’t be justify in any possible means.
Power is good not until it is used in a wrong way. The accident happened when Nuezca is
off duty. It clearly shows that he violated a police protocol and that “they only carry
firearms in performance of their duties” is considered as another offense.
b. In addition to Nuezca’s recent case, he had face other six cases over his 10 years in service.
It is a big question how he still roams like nothing happened instead of being inside the
bars. It only shows what kind of justice system our country has. It is biased, unfair and a
disadvantage to the oppressed who holds no power in society. To think, this system must
be reformed if just one official, just one, who have the passion to serve truthfully without
self-interest can reform such system. It isn’t justice anymore but a rubbish system.
Everyone’s aware of it but still nothing changed.
c. The best ethical system to consider in the issue is Deontology theory. Stated in this theory
that we have moral duties to do things which it is right to do and moral duties not to do
things which it is wrong to do. Whether something is right or wrong doesn’t depend on its
consequences. Rather, an action is right or wrong in itself.” Every police officer sworn an
oath “…never employing unnecessary force or violence” therefore it is their duty to keep
it. Immanuel Kant, a great philosopher, talks about our ability to make choices and
decisions as ‘the will’. He assumes that our wills are rational; that is, we can make choices
on the basis of reasons. We do not act only on instinct.
